PROFESSIONAL SERVICE CONTRACT FOR
LEGAL SERVICES
WHEREAS, there exists a need for legal services in the defense of Police Officer
Charles Kitz in the matter of Phyllis Volk vs Borough of Carteret Et Al; and
WHEREAS, legal services are a a professional service exempt from the requirement
of public bidding pursuant to NJ.SA 40A:I 1-5 (1) (a); and
WHEREAS, the Local Finance Officer has certified that funds are available.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the
Borough of Caneret does hereby approve the appointment of Carl Palmisano, Esq.
a maximum cost not to exceed $2,500.00 billable at $125.00 per hour.
BE IT FURTHER RESOLVED that the Mayor and Municipal Clerk are hereby
authorized to execute said contract.
IT IS FURTHER RESOLVED that the contract is awarded without competitive
bids in accordance with NJ. SA 40A:11-5 (1) (a) due to the specialized and
professional nature of the services provided.
IT IS FURTHER RESOLVED that a notice of this action shall be published in the
Home News Tribune on May 25, 1999..

and certified as a true copy of the original
