AUTHORIZING DECOTIIS, FITZPATRICK & COLE, LLP TO SERVE AS
SPECIAL LABOR PROSECUTOR WITH REGARD TO FIRE DEPARTMENT
PERSONNEL MATTERS AND AS MAY BE ASSIGNED FROM TIME TO TINIE
WHEREAS, the Borough of Carteret, ( "Borough "), is in need of specialized legal
services with regard to the prosecution of Civil Service Disciplinary Charges lodged
against certain municipal firefighters; and
WHEREAS, DeCotiis, Fitzpatrick, & Cole, LLP ( ° DeCotiis ") possess the requisite skill
and expertise to provide such specialized legal services; and
WHEREAS, the Law Director of the Borough of Carteret has recommended the
appointment of DeCotiis to serve as the Borough's Special Prosecutor in the above
matters at an initial cost not to exceed 575,000.00; and
WHEREAS, the Chief Financial Officer has certified that fiords are or will be available
for said purpose.
NOW, THEREFORE, BE IT RESOLVED by Nlayor and Council of the Borough of
Carteret, that DeCotiis, Fitzpatrick & Cole, LLP are hereby appointed as special
prosecutor on behalf of the Borough of Carteret in the above referenced matters at an
initial cost not to exceed $75,000.00, in accordance with DeCotiis' Response to the
Borough's previous Request for Qualifications for Special Legal Counsel; and
BE IT FURTHER RESOLVED that this appointment is made as a professional services
contract pursuant to N.J.S.A. 40A:11- 5(1)(a) in accordance with the Borough's Fair and
Open Process as authorized by law.
