RESOLUTION AUTHORIZING RAILROAD PAVEMENT, MARKINGS
AND SIGNAGE AT THE PROPOSED RAILROAD GRADE CROSSING
AT PORT CARTERET DRIVE
WHEREAS, the Borough of Carteret, Middlesex County has been ordered by the
Commissioner of Transportation (the Commissioner") in decision and order, Docket
No. 30-98P, to erect and install Railroad Pavement markings and signs on Port
Carteret Drive at the crossing of the Consolidated Rail Corporation; and
WHEREAS, the Comtnissioner has advised the Borough that the initial cost of the
aforementioned work is eligible for reimbursement by the Federal Government and/or
State provided that the Borough agrees to maintain the subject devices; and
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the
Borough of Carteret, that pursuant to the order by which the costs for all
improvement are to be done by Consolidated Rail Corporation and Amax Realty
Development, Inc. ("AMAX") the Borough will install railroad pavement markings
and signs at the Port Carteret Drive crossing, and provided the Commissioner's order
is revised to reflect that the costs associated with the maintenance of the subject
devices are to done by Con Rail and AMAX, the Borough will maintain the subject
devices, and that upon completion of the installation the Borough will provide the
Department of Transportation with a certification that all the work was done in
accordance with the manual of Uniform Traffic Control Devices for Streets and
Highways
BE, IT FURTHER RESOLVED, that a copy of the Resolution be forwarded to the
Department of Transportation.
