AN ORDINANCE AMENDING SECTION 8-2-34 OF THE CITY
CODE OF IONA, IDAHO; RELATING TO PAYMENT OF
DELINQUENT WATER ACCOUNTS; ESTABLISHING
METHODOLOGY; PROVIDING FOR SEVERABILITY; AND
ESTABLISHING EFFECTIVE DATE.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF IONA,
IDAHO, THAT:
Section 1. Amending of Section 8-2-34 of lona City Code. Section 8-2-34 of the
Iona City Code is hereby amended as follows:
8-2-34: DELINQUENT ACCOUNTS: Whenever a customer account is not paid within
fifty (50) days from the past due date, the City Clerk shall assess a delinquency charge in
the amount of $2 for each month the account is delinquent. The City may also terminate
water service to the delinquent customer and in such event a disconnect fee in the amount
of $1-025 shall be added to the bill. Interest at a rate of one percent (1%) per month shall
accrue on the unpaid balance of all delinquent accounts, including any unpaid delinquency
charges or disconnect fees. If service is terminated for delinquency, it shall not be restored
until the account is brought current -and, the delinquency charge and the disconnect fee are
paid in full, and a reconnect fee of $25 is paid in full or a written agreement for payment
is approved by the Council. The disconnect fee shall be payable whenever a service trip
is made for the purpose of disconnecting water service even though service is not actually
disconnected. Partial payments shall be applied first to any unpaid delinquency charges
or disconnect fees and then to the outstanding utility charges in the same order as the
utility charges were accrued.
Section 2. Methodology. For the purpose of this Ordinance, text that is
underlined in the preceding sections means new text added to the former Ordinance or City
Code Section, and text that is stricken through means text that is being deleted from the
former Ordinance or Code Section. Text that is moved from one location in the former
Ordinance to another is similarly shown as underlined text.
Section 3. Severability. The sections and subsections of this Ordinance are
severable. The invalidity of any section or subsection shall not affect the validity of the
remaining sections or subsections.
Section 4. Effective Date. This Ordinance shall become effective upon its
passage, execution and publication within the manner provided by law, and shall be
effective with respect to all customer accounts billed after the date the Ordinance becomes
effective.

Falls, Idaho; said Post Register being a consolidation of the Idaho Falls Times,
established in the year 1890, The Idaho Register, established in the year 1880
and the Idaho Falls Post, established in 1903, such consolidation being made on
the First day of November, 1931, and each of said newspapers have been
published continuously and uninterruptedly, prior to consolidation, for more
than twelve consecutive months and said Post Register having been published
continuously and uninterruptedly from the date of such consolidation, up to and
including the last publication of notice hereinafter referred to.
That the notice, of which a copy is hereto attached and made a part of
this affidavit, was published in said Post Register for 1 consecutive (days)
weeks, first publication having been made on the 25TH day of JANUARY 2008,
last publication having been made on the 25TH day of JANUARY 2008 at the
said notice was published in the regular and entire issue of said paper on the
respective dates of publication, and that such notice was published in the
newspaper and not in a supplement.
