Mr. DePatie provided an overview of extending the Susan DeGozzaldi Memorial Trail by clearing vegetation with hand tools to create a loop for extending the hiking trail and installing a wooden footbridge over a wetland resource area. It was noted that wildlife brush piles could be created in the buffer zone with any of the cut vegetation. The Commission determined the project qualified as an exempt activity.  The Commission reviewed the Request for Certificate of Compliance application (188-316) submitted by Corey, 6 Downey Place. The Commission determined the submission of the as-built plan noted under condition number 14 of the Order of Conditions was required.  Mr. Harrow made a motion to approve the draft minutes of 30 April 2019. The motion was seconded by Ms. LeBlanc and it was passed by everyone except Mr. Ciriello who abstained. 7:43 PM Nation, 1,3,5 Whisper Way, 0,0,129 Wood Street DEP File No. 188-1665 Notice of Intent - continuation Mark Arnold, Goddard Consulting; Ron Nation, Chris Nation, Craig Nation, applicants Mr. Arnold submitted and provided an overview of site plans dated 24 May 2018 with a final revision date of 03 June 2019. He detailed how the overall scale of the project had been reduced. A discussion was held about the Lucas Environmental memo dated 28 May 2019. A discussion was held about the Goddard Consulting memo dated 04 June 2019. It was noted more time would be needed to review the submitted information and that electronic copies would need to be submitted. A discussion was held about any potential hydrological impacts to the vernal pools. The Commission noted a rationale needed to be submitted to document that there would not be any negative impacts to the functioning of the vernal pools. A discussion was held about the reduced amount of proposed plantings and the need of the wetland replication area to meet the MassDEP wetland replication guidelines. A discussion was held about the previous invasive plant species management plan and why it was not included as part of the newly scaled down project. Hopkinton Conservation Commission 04 June 2019 Page 2 of 2 A discussion was held about the appearance of the project not complying with General Conditions, 17, 18, 19e, and 23 of the Massachusetts General Permit (GP) under Section 404 of the Clean Water Act. It was noted that self-verification is only applicable under the MA GP if the General Conditions are met and a Pre-Construction Notification to the U.S. Army Corps of Engineers is required if self-verification is not applicable. It was noted that the point of the discussion was to avoid any delays at the time of construction subject to the Commission’s standard condition that notes construction shall not commence until all required permits and approvals have been obtained. The hearing was continued to 18 June 2019. 8:14 PM REC Hopkinton, 0 South Street DEP File No. 188-1667 Abbreviated Notice of Resource Area Delineation The applicant requested a continuation to 18 June 2019. 8:15 PM Commission Business  A discussion was held about the status of the Order of Conditions (OOC) for DEP File Number: 188- 319, 61 West Elm Street. It was noted that the single family home was not constructed by the time the OOC was expired. The Commission signed an Invalid Certificate of Compliance for the record.  A discussion was held regarding the exemption request from Egbuna, 3 Sadie Lane (188-1130) to cut down and remove three (3) live trees. The Commission determined the activity qualified as an exempt activity subject to replacement of the trees with shade tolerant native species.  A discussion was held regarding the exemption request from Kiriakakos, 46 Lake Shore Drive to remove the existing concrete patio and replace it with a slightly larger patio block area within the existing lawn area. The Commission determined the activity qualified as an exempt activity subject to the work area being covered by a tarp at the end of each work day.  A discussion was held about the online process for Commission members to apply for reappointment to the Commission.
