The motion was seconded by Mr. Harrow and it passed unanimously.  A discussion was held with Ms. Cynthia Esthimer, 118 Hayward Street, regarding the proposed installation of a fence in the buffer zone. The Commission determined the activity qualified as an exempt activity with conditions.  A discussion was held regarding the exemption request for Fitzgibbons, 4 Teresa Road (188-294), to install a shed on the landscaped portion of the property. The Commission determined the activity qualified as an exempt activity with conditions.  A discussion was held with Mr. James Blackburn, Eversource, regarding the waiver request for condition number 60 of the Order of Conditions (HCC-34) for the LNG Facility at 52 & 55 Wilson Street. A discussion was held regarding the waiver request and the letter dated 17 June 2019 from Eversource. Mr. Blackburn noted the desire to initiate the project during summertime conditions. It was noted that the erosion controls have been installed and the site vegetation has been cleared. A discussion was held about the first two Building Department permits, the first for an office trailer and the second for foundations, that were initially denied and were overturned by the state board of appeals. Mr. Blackburn noted it will be turned back over to the Building Department to be resolved. The Commission noted given the unique utility use of the site and assurance that the facility improvements will be constructed in due course, they can understand utilizing a segmented approach to the redevelopment of the site. Ms. Reed made a motion to allow the waiver request. The motion was seconded by Mr. Harrow and it passed unanimously. 7:56 PM Lyons, 24 Wedgewood Drive RDA 2019-1 Request for Determination of Applicability Don Scott, Don Scott LA Design; Michael Lyons, applicant/owner Mr. Scott provided an overview of the Request for Determination of Applicability application and the site plan dated 18 June 2019. A discussion was held about the Lucas Environmental review dated 17 June Hopkinton Conservation Commission 18 June 2019 Page 2 of 3 2019. A discussion was held about the layer of gravel material located within the disturbed area identified on the site plan. Mr. Lyons noted that he would like to remove the gravel material that was placed in the disturbed area and restore the area with native plantings. Ms. Recos made a motion to close the hearing and issue a negative Determination of Applicability with the standard and noted special conditions. The motion was seconded by Mr. Ciriello and it passed unanimously. 8:09 PM Petrozzi, 0 Leonard Street HCC – 39 Notice of Intent – continuation Lou Petrozzi, Wall Street Development Corp. Mr. Petrozzi submitted and provided an overview of a site plan dated 04 April 2019 with a final revision date of 09 July 2019. A discussion was held about the revised site plan. A discussion was held about the previous request for information from the Commission subject to the applicant providing consultant fees for a peer engineering review to be performed for the project. Mr. Petrozzi noted that he does not think the scale of the project warrants a peer engineering review. Mr. Petrozzi noted the Commission could deny the application and then he could look into other avenues for removing the culvert discharging stormwater onto his property without an easement. A discussion was held about the proximity of the proposed activity to the bordering vegetated wetland (BVW) located south of Leonard Street. Mr. Petrozzi noted that he would demarcate the BVW and the limit of the proposed berm in the field and contact the Conservation Staff when the site would be ready for further review. A discussion was held about potential changes the project may have on existing stormwater management conditions and any impacts to the wetland resource areas. The hearing was continued to 09 July 2019. 8:25 PM Petrozzi, 0 Leonard Street (U19 52 0) HCC – 33 Notice of intent – continuation Mr. Petrozzi noted that he wanted to continue the public hearing to 09 July 2019. Mr. Petrozzi noted that he wanted to have an informal discussion to provide the Commission with an update on the status of the application for the proposed roadway currently before the Hopkinton Planning Board. Mr. Petrozzi noted there are a few remaining issues being reviewed such as, access and a turnaround area for emergency vehicles, potential for extending fire hydrants on Maple Street Extension, snow removal, and the creation of a homeowners association for responsibility of maintaining the roadway. The development of the lots is being tabled until a final determination on the roadway has been reached. 8:30 PM Petrozzi, 0 Leonard Street (U19 52 0), Lot 1A HCC – 35 Notice of Intent – continuation 8:30 PM Petrozzi, 0 Leonard Street (U19 52 0), Lot 2A HCC – 36 Notice of Intent – continuation 8:30 PM Petrozzi, 0 Leonard Street (U19 52 0), Lot 3A HCC – 37 Notice of Intent – continuation 8:30 PM Petrozzi, 0 Leonard Street (U19 52 0), Lot 4A HCC – 39 Notice of Intent – continuation The applicant requested continuations to 09 July 2019 Hopkinton Conservation Commission 18 June 2019 Page 3 of 3 8:31 PM Commission Business  A discussion was held about the MA Division of Fish & Wildlife Turtle Roadway Mortality Study https://www.linkinglandscapes.info/database-projects.html and how the public can participate in the turtle study and the other roadway wildlife studies. It was noted that any signage for turtle crossings should be seasonal as permanent signs tend not to be noted by drivers over time.  The Commission reviewed the Request for Certificate of Compliance application from Garland, 3 Whitman Lane (188-913). The Commission noted the adequate barrier required per condition number 35 was not installed and that the barrier should be installed and identified on a revised as- built plan.  Review of the 04 June 2019 draft minutes was tabled until 09 July 2019  A discussion was held with Ms. Kathleen Towner, 9 Kruger Road, regarding the testing for the presence of pesticides on the Trails at Legacy Farms subdivision site (188-1649) that required sampling to be performed by an independent third party. The Commission noted the applicant would be contacted to provide the date when the anticipated pesticide testing report would be submitted for review.
