HomeMy Public PortalAbout06 Southshore Capital LLCTOWN OF TRUCKEE Truckee, California Ordinance 2001-06 An Ordinance of the Town of Truckee Approving a Development Agreement Between the Town of Truckee and South Shore Capital, LLC The Town Council of the Town of Truckee does hereby ordain as follows: Section 1. The Truckee Town Council does hereby approve that development agreement concerning the Truckee Town Homes Project and Related Tentative Map and Use Permit Approval which is on file in the office of the Town Clerk and incorporated by reference herein as if fully set forth. Section 2. In support of its approval of the development agreement, the Town Council makes the following findings as required by the Truckee Development Code and State law: 1. On September 27,2001, the Truckee Planning Commission held a duly noticed public hearing and has reported to the Council its unanimous recommendation that the proposed development agreement be approved and made the findings required by Resolution 2001-23. 2. As required by the Development Code, the Town Council hereby finds, based upon substantial evidence in the record, that the agreement: a_ Is consistent with the objectives, policies, general land uses and programs specified in the general plan and any applicable specific plan; b Is compatible with the uses authorized in, and the regulations prescribed for, the land use zone(s) in which the real property is located; c_ Is in conformity with public convenience, general welfare and good land use practices; d Will not be detrimental to the health, safety and general welfare of persons residing in the immediate areas nor be detrimental or injurious to property or persons in the general neighborhood or to the general welfare of the residents of the Town as a whole; e Will not adversely affect the orderly development of property or the preservation of property values; f_ Is consistent with the provisions of Government Code Sections 65864 through 65869.5. The development agreement is in the best interest of the Town because it promotes a well designed residential project that incorporates units targeted to moderate income households and provides for a pedestrian connection to the downto;vn that are beyond what could be achieved through the standard development review process. Section 3. The Town Manager is hereby directed to execute the attached development agreement upon execution by the property owner. This authorization shall be valid for a period of 30 days from the effective Town of Truckee Ordinance No. 2001-06 date of this ordinance at which time the authorization to execute the agreement provided by this ordinance shall become null and void. Section 4. The execution of the development agreement by the property owner and the Town shall complete the rezoning of the property (APN 19-420-18) as provided in Town Ordinance 2000-03, Sections 1 and 4. Section 5. All ordinances and parts of ordinances in conflict herewith are hereby repealed. Section 6. This ordinance shall be published in its entirety one time in the Town newspaper of general circulation and shall take effect (30) thirty days after its second reading and adoption. The foregoing Ordinance was introduced at a regular meeting of the Truckee Town Council held on the 18th day of October, 2001, and adopted at a regular meeting of the Truckee Town Council on the 1 st day of November, 2001, by Councilmember Florian, who moved its introduction, which motion was seconded by Councilmember Susman was upon roll call carried by the following vote: AYES: Councilmembers Owens, Susman and Mayor Pro Tempore Florian NOES: None ABSTA1N: Councilmember Schneider and Mayor McCormack Ron Florian, Mayor Pro Tempore ATTEST: ~at{ Osbom~MC, Town Clerk
