MINUTES

MEETING: Planning Commission Special Meeting
PLACE: Town Hall Board Room
PRESENT
Commission: Commissioners: Chair -Steve Sumrall, Vesta Shapiro, Philip Naill, Scott
Brent, Fran Cook, and Peggy Smith. Katie Soles arrived at 7:15 p.m.
Staff: Town Planner Catherine Trotter
Chairperson Sumrall called the meeting to order at 6:35 p.m.
1. Roll Call
2. Approval of September 30th, 2009 special meeting minutes.
Comm. Smith moved, and Comm. Cook seconded the motion to approve the minutes
as amended. Motion carried: 6 -0.
3. Open Forum
4. Discussion and Possible Action Regarding
a. Possible Amendments to Fraser Zoning Code on Medical Marijuana
Dispensaries (MMD)
TP Trotter briefed the PC and the audience on the process of regulating MMD within the
Town. Due to the recent Colorado Court of Appeals decision and the CDPHE
emergency rulemaking and the fact that the current moratorium is due to expire on
December 14 2009, Staff is recommending that the Town Board extend the
moratorium for another 90 days. In addition, we anticipate that the legislature will be
discussing this topic at length in January. A second countywide meeting is
scheduled for tomorrow. The PC took public comment on the matter. No action was
taken.
b. Possible Amendments to Fraser Zoning Code on Adult Entertainment
Establishments
The PC discussed the various sample ordinances in the packet. TP Trotter was directed
to mesh the Frisco and Breckenridge ordinance and bring it for future action.
c. Re- appoint Chairperson for 2010
Comm. Naill moved, and Comm. Cook seconded the motion to approve the re-
appointment of Steve Sumrall as Chairperson and Scotty Brent as Vice Chairperson for
2010. Motion carried: 7 -0.
d. Recommend approval of the 3 mile plan
Comm. Brent moved, and Comm. Shapiro seconded the motion to recommend
approval to the Fraser Town Board of the 3 Mile Plan. Motion carried: 7 -0.
5. Comprehensive Plan Workshop
6. Staff Choice. TP Trotter stated that we are scheduling a joint PC/TB public hearing on
December 2 2009 at 6:00 p.m. to consider amendments to the subdivision regulations
as a result of the pending dissolution of the Fraser Sanitation District. Year end thank
you gifts were distributed to the PC. Thank you for all your time and effort.
7. Commissioners' Choice
Comm. Shapiro moved, and Comm. Brent seconded the motion to adjourn. Motion
carried: 7 -0. Meeting adjourned at p.m.
