A RESOLUTION AMENDING THE CITY OF MOAB PERSONNEL POLICIES AND
PROCEDURES MANUAL
WHEREAS, the City of Moab Personnel Policies and Procedures Manual contains rules of
general application concerning hinng, promotion, pay, benefits, and discipline, and
WHEREAS, the Manual should be reviewed and revised on a penodic basis to ensure
compliance with employment laws and contemporary personnel management practices, and
WHEREAS, the Moab City Council has determined that the Manual should be revised, and
WHEREAS, the amendment to the City of Moab Personnel Policies and Procedures Manual has
been presented to this meeting of the Moab City Council
NOW, THEREFORE, we, the Governing Body of the City of Moab do hereby resolve to
approve the revised Moab Personnel Policies and Procedures Manual in substantially the form
presented to this meeting of the City Council
This resolution shall take effect immediately upon passage
Passed and adopted by action of the Governing Body of the City of Moab in open session
this 23`d day of Apnl, 2002

1 5 Recrwtment and Selection
(A) Recruitment - The City's policy is to give equitable consideration
to all qualified applicants for employment vacancies on the basis of individual
qualifications, potential, and job performance Statutory appointees are excluded
from the provisions of this section The City abides by the Utah Veteran's
Preference Act and will offer preference to qualified veterans as defined in Utah
State Code Annotated Chapter 10

Classified employees, statutory appointees, and contractual employee; receive
longevity pay after completion of five (5) years of employment Longevity pay,
as applicable, will be paid flung the pay penod in which the employee's
anmVersary date falls
Longevity pay shall be as follows
(1) 1% of base annual salary upon completion of five (5) full years of
continuous service,
(2) 2% of base annual salary upon completion of ten (10) full years of
continuous Service,
(3) 3% of base annual salary upon completion of fifteen (15) full years of
continuous senate,
(4) 5% of base annual salary upon compleuon of twenty (20) full years of
contmuous service
4.4 Admfnhltratroo of Skk Leave
(A) Repon regmrement In order to be paid for sick lave, an employee
must notify the department had, or the person designated by the department had
to receive such notice, within a reasonable time prior to the start of the work shift
(B) Illness or accident When it is established to the City's satisfaction
that an employee is mcapacitated because of siclmess or mjury to a degree that he
or she would not be able to perform his/her duties safely, sick lave, if
accumulated, will be granted, or if the employee does not have any sick lave, the
lime will be deducted from other lave balances
(C) Death m family When death occurs m the employee's immediate
family, sick lave will be granted Department heads may approve an employees'
use of sick lave to attend funerals
(D) Emergency sick lave When an emergency or unusual situation

exists which directly affects the health, safety and welfare of a member of the
employee's immediate family, the employee may be granted emergency sick leave
with the approval of the department head.
(E) Medical certification Medical certification may be required to
substantiate sick leave In the event there is a reason to beheve that an employee
rs abusmg sick leave, the employee may be required to furnish, at the City's
expense, medical certificates and a wntten statement of the reasons for any penod
of sick leave
(F) Return to work If an employee has been absent from duty because
of sickness or mjunes for a penod of three (3) or more working days, the
employee may be regwred to satisfy the City, with medical certification, that
he/she can perform normal job functions pnor to being permitted to return to
work
(G) Job -related minims Any employee absent from work because of a•
job -related injury m entitled to use all available sick leave
pnor to receiving worker's compensation benefits for any
penod m which the employee is eligible for such benefits
In no instance shall the employee be entitled to sick leave
pay and worker s compensation for the same penod of
disability or mury Where applicable, the City may require
that the injured employee assign any worker's
compensation wage replacement benefits (exclusive of
payments for medical expenses and the hke) to the City in
partial reimbursement for this benefit and to the extent
necessary to prevent a double payment
(H) A sick leave bank shall be available for classified employees who
meet the requirements for sick leave usage and require
lave in excess of their own accruals Sick leave bank
usage and amounts must be approved m advance by the
City Manager and shall not exceed 80% of the lave
,available in the bank Any classified employee may donate
sick leave to the bank Employees may not donate an
amount that would reduce their personal accrual to less
than 120 hours
S 10 Leaves of Absence
(A) Leaves of absence without pay may be grunted for penods not to
exceed one year to non -probationary classified employees and statutory
appomtees because of illness or infirmity, for educational or religious purposes, or
for other similar reasons Lave is available subject to the discretion of the
supervisor and the appomtmg authonty Leave shall not be granted where it will
result m fiscal or operational hardship to the City Factors wluch may influence
the decision to grant leave mclude the employee's performance record, length of

service, and related factors Request for leave shall be made in writing to the
appomhng authority Employees on leave status do not accrue additional benefits
(includinnqg health insurance unless the requirements of section 4 13 are met) and
leave time is excluded from the calculation of length of service The City cannot
guarantee that ao employee on voluntary leave will be returned to the same
position or rate of pay upon return to active duties Where leave is sought due to
illness or medical condition, leave taken under the Family and Medical Leave
Act, as described in Sechon 5 9 shall be counted against the one year limitation of
leave under this section. Failure to report for duty upon expiration of leave under
this section is grounds for discharge
7 6 Procedures for Mule Vacancies
(A) The basis for selecting candidates for appointment and promotion
m the classified service will be without m accordance nth the Equal Employment
Opportunity Policy
(B) When a position opens m a department or a need anses to create a
temporary position, the department head shall submit a ropiest to the personnel
officer Mtmmum quahScations of education and expenence shall be outhned for
temporary positions
(C) The personnel officer shall post the opening where all City
employees will be made aware of the opportunity for promotion A reasonable
time after the completion of the internal posting, and providing that the position is
not filled by promotion, the personnel officer shall comply with recnutmg per
section 7,5(B)of these rules
7 7 Appointment of Classified Employees
(A) An appointment to the classified service of the City is an
appointment to a full-hme posihon for an mdefimte term unless otherwise
specified m the appomtmg action
(B) Probation All appointees to the classified sernce must serve a
probationary penod, which is for the purpose of observmg the employee's ability,
work habits and fitness for employment m the position During the probationary
penod the employee is enhtled to no expectation of continued employment The
normal penod of probation is six (6) months for regular classified employees and
one (1) year for commissioned police officers A probationary employee may be
termmated at any time during the penod of probauon, with or without cause
(C) All classified employees transferred, promoted or demoted shall be
subject to the probahonary penod m the new position unless the department head
waived the probation penod An employee whose service m a particular class is
terminated dunng the promotional probationary penod followmg a promotional
appointment, or whose appointment at the conclusion thereof is not made

permanent, will be remstated to his/her previous position or a similar
classification and pay grade for which the employee is qualified, provided a
position vacancy exists
(D) gmploye,e benefits Classified employees shall be entitled to• { imolai (o>
employee benefits provided by the City Vacation, sick
leave and eligibility for retirement benefits begin accrung
at the date of employment
(El Non-exempt employees appointed to exempt positions shall accrue
benefits based on the years of service as an exempt
employee with the exceppon that benefits shall not be
reduced as a result of the aopomtment
t 3 Wnttm Reprimand
A department head and/or approved supervisor may repnmand an employee for
cause Such repnmand shall be m wntmg and be addressed to the employee A
signed copy shall be delivered to the recorder for mclusron m the employee's

11 f Clandred Service
The classified service consists of the regular full June employees, 3/4 full time
employees and seasonal classified employees of the City, except the City
Manager, statutory appomtees, elected officials, contractors, statutory employees,
and members of pohcy, advisory, review and appeal boards, or similar bodies
11 20 Employee. MI Time
An employee who may or may not be in the classified service and who works at
least 40 hours per week and who accrues benefits under these rules m accordance
with that number of hours of weekly employment Full tune employees work at
least 40 hours per week unless reportmg authonzed leave

11.21 Employee.3/4 Full Time
An employee who may or may not be m the classified service and who works at
least 30 hours per week and who accrues benefits under these rules m accordance
with that number of hours of weekly employment. 3/4 full tmgemployees are
entitled to benefits equal to full tune employees with the exception of !lave time
accrtals,whichyall be extrapolated based on the percentage of hours worked
compared to 40 hours per week.
1141 ytmolovee. Part -tune
An employee who is not m the classified service who works less than 3ahours
per week and who is not entitled to employment benefits except as otherwise
provided mthese rules.
111,2 Zmolovee. Seasonal
A temporary employee, not m the classified semce, who works dunes a defined
penod of a calendar year, not to exceed six months
11 24 Employee. Permanent Seasonal,
A permanent seasonal employee is a classified employee who works at least 1.044
hours per year of which at least three months are worked at 40 hours per week
Permanent seasonal employees are subject to seasonal furlough Permanent
seasonal employees are entitled to ve,ar-round benefits equal to full time
employees with the exception of leave time accrual. which shall be determined as
follows
al Vacation hours shall be accrued annually using a percentage based ow
the number of hours worked duumg the precedingyear as compared to
12 months of full time employment
bl Sick hours shall be accrued monthly using a percentage based on the
number of hours worked during that month as compared to full time
employment.
