THE CITY OF RICHMOND,INDIANA,JUNE 3,1999
The Board of Public Works and Safety of the City of Richmond,Indiana,met at 5 p.m.Thursday,June 3,
1999,in the Community Room in the Municipal Building. Chairperson Bob Goodwin presided with Bruce
Metzger,Robin Henry and Assistant City Attorney Steve Rabe present.The following business was
conducted:
APPROVAL OF MINUTES
There were no minutes available for approval.
CLAIMS FOR PAYMENT
Claims for payment submitted by the City Controller's office were read by Henry,who reported that they
totaled$730,305.56 and moved for approval,second by Metzger and the motion was carried on a
unanimous voice vote.
REQUESTS
A. Fire Chief Mike Allen may recall Firefighter John Pierce has been suspended since October
16, 1998,while criminal charges resulting from incidents which allegedly occurred on July 4
and September 21, 1998 were pending.Pursuant to state statute,no disciplinary action may be
taken against a firefighter until after disposition of any criminal charges relating to the
incidents.Although these charges are still pending,information obtained during the course of
the Fire Department's administrative inquiry has led him to believe that Firefighter Pierce
should be placed on disability pension under the 1977 Police Officer and Firefighter Pension
Fund.Pursuant to I.C. 36-8-8-12.3 a,the Board of Works may request that the local Pension
Board hold a hearing to determine if a firefighter has a covered impairment and should
therefore be placed on disability.
Chief Allen said he is recommending that this Board formally make such a request of the
local Pension Board.Rabe said he did research the issue that the Pension Board could hold
that hearing in executive session due to the nature of the information it would receive,
however,they would have to publicly meet to take any final action.Metzger moved to request
the local Pension Board to hold a hearing regarding John Pierce and whether or not he has a
covered disability,second by Henry and the motion was carried on a unanimous voice vote.
ADJOURNMENT
There being no further business,on a motion duly made,seconded and passed,and carried on a unanimous
voice vote,the meeting was adjourned.
