A RESOLUTION APPROVING AN INTERLOCAL AGREEMENT AS TO THE FUNDING AND
MAINTENANCE OF THE GRAND COUNTY HIGH SCHOOL TENNIS COURT LIGHTING
SYSTEM, BY AND BETWEEN THE GRAND COUNTY SCHOOL DISTRICT, THE CITY OF MOAB
AND THE GRAND COUNTY RECREATION SPECIAL SERVICE DISTRICT k I
WHEREAS, the City of Moab supports a broad range of recreational activities for City and Grand County
residents, and
WHEREAS, the Grand County Recreation Special Service District #1 has allocated funds for installation
of a lighting system at the Grand County High School, and
WHEREAS, the Grand County School District has the means of covenng the costs associated with
customary maintenance of said lighting system, but does not have sufficient funds to pay utility costs
associated with the lighting system, and
WHEREAS, the City of Moab, to its support of a broad range of recreational activities, has the means to
fund utility costs for the Grand County High School Tennis Court Lighting System
NOW, THEREFORE, we, the Governing Body of the City of Moab do hereby approve aforementioned
agreement in substantially the form presented to this meeting of the Moab City Council, and authonze the
appropnate officials to sign and execute said agreement
This resolution shall take effect immediately upon passage

INTERLOCAL AGREEMENT
AS TO THE FUNDING, INSTALLATION AND MAINTENANCE OF THE GRAND COUNTY
HIGH SCHOOL TENNIS COURT LIGHTING SYSTEM, BY AND BETWEEN THE GRAND
COUNTY SCHOOL DISTRICT, THE CITY OF MOAB AND THE GRAND COUNTY
RECREATION SPECIAL SERVICE DISTRICT #1
Pursuant to the Interlocal Cooperation Act, Title 11-13-1 et seq Utah Code Annotated and for the mutual
benefit of the citizens, inhabitants and constituents of the Grand County School Distract ("School
District"), the City of Moab ("City"), and the Grand County Recreation Special Service Distnct #1
(Recreation Distnct"), the School Distnct, the City and the Recreation Distnct hereby agree as follows
1 Purpose The purpose of this agreement is to provide for the funding, installation and
maintenance of the Grand County High School Tennis Court Lighting System (lighting
system")
2 Provision of Services The School District agrees to develop contract specifications for purchase
and installation ofa lighting system for the Grand County High School Tennis Courts, to
coordinate public bidding of the project and to act as contract administrator for the project The
School Distnct agrees to perform customary maintenance on the lighting system after installation,
including light bulb replacement
3 Funding
A The Recreation Distract agrees to pay up to $52,000 toward the cost of installation of
the lighting system, necessary appurtenances and initial materials and supplies The School
Distract shall submit invoices to the Recreation District, which shall pay the contractor(s) directly
B The City agrees to pay all power costs associated with the lighting system The City
will have a separate account with the power service provider for this purpose
C The School Distract agrees to pay all costs associated with customary maintenance of
the lighting system, including light bulb replacement
D The parties agree that funding and coordination for major and/or uncustomary
maintenance or improvements to the lighting system shall be determined by the Administrative
Committee as provided for herein
E If the contract pnce(s) for the lighting system installation exceeds S52,000, the parties
agree that the terms and conditions of this agreement shall not apply unless the parties make
provisions for additional funding by amendment to this agreement
4 Administration of Agreement This agreement shall be administered by an Administrative
Committee compnsed of the School District Supenntendent, the Recreation Special Service
Distract Board Chair and the Moab City Manager This committee will coordinate the provisions
of this agreement as provided for herein and as needed
5 Control of Property Once installed, the lighting system shall become the sole property of the
School Distnct Pursuant to Section 11-13-7, Utah Code Annotated, each party to this agreement
shall exercise control over and liability for its respective property
6 Effectiveness and Duration of Agreement This agreement shall become effective immediately
upon approval by resolutions of the Moab City Council, the Grand County School Board and the
Grand County Special Services Recreation District Board and upon execution by the appropnate
City, School District and Recreation District officials This agreement shall remain in effect until
60 days after a notice of termination is given by any party hereto to the other two parties hereto
IN WITNESS WHEREOF, the parties hereby execute this agreement on this 14th day of May, 2002
