At the request of the Town of Brewster and the Brewster Ponds Coalition, J.M. O'REILLY &
ASSOCIATES, INC, has prepared a Proposed Site Plan for the existing boat ramp at Walker's Pond,
adjacent to Slough Road. The Proposed Site Plan (Plan) outlines improvements to the stormwater
controls prior to the Pond. The following is a brief narrative outlining the Plan and the specific
improvements to the water quality of the Pond.
Wetland Resources:
The property is adjacent to Walker's Pond. The wetland resources associated with the area are
Land Under the Water (pond), Inland Bank, Bordering Vegetated Wetland and Bordering land
Subject to Flooding. The most restrictive resource for the property is the small Inland Bank on
either side of the existing ramp. Please refer to the Plan for additional details and the location
of the applicable Buffer Zones.
Project Narrative:
The project site is the existing paved boat ramp into the waters of Walker's Pond. The existing
conditions include a paved parking area, to the south, a paved access drive, running north to
south and the paved boat ramp. The existing ramp is a conduit of stormwater runoff from a
portion of the parking area, the entire area of access drive and the adjacent surrounded
woodlands to Slough Road. The goal of the improvements is to improve the quality of
stormwater ultimately getting into the Pond, from the project area. Given the limited area for
leaching and grade changes, the Plan outlines improvements so as to address the 'first flush' of
stormwater prior to discharge into the Pond.

The parking area to the south is relatively flat in grade and generally sheds water to the east of
the parking area, into the woodlands. A small portion of the parking area does pitch towards the
access drive down to the ramp area. The Plan calls for a small asphalt berm to be placed at the
beginning of the access drive so as to minimize the water runoff down the access ramp. The
berm will be sized so as to direct water to the east, into the adjacent woodland area.
The southern access drive slopes down to the ramp area at about a 17.4% grade. The northern
access drive slopes down to the ramp area at about a 13.5% grade. The steep pitch of the drives
is compounded in that each drive pushes water towards the gutter line closest to the Pond. Given
the limited area and topography the stormwater is being collected as best possible methods.
The Plan calls for two (2) precast concrete trench drains to be installed on each access drive. The
trench drains, on the southern drive, will be connected to 6 inch ADS piping. The piping will
outfall into a grassed channel with check dams. The trench drains, on the northern drive, will be
connected to 6 inch ADS piping, also. The piping will outfall into a grassed channel with check
dams. Both channels are proposed to discharge to a grassed swale area for further treatment.
The channel shall be planted with a grass seed mixture for steep channel flow.
The grassed swale will serve as a stilling area for the stormwater. The stormwater will be allowed
to pond within the swale, prior to discharge to a catch basin inlet. The swale has been graded so
as to provide about a 6 inch ponding depth, prior to the catch basin inlet. The swale is to be
planted with a drought tolerant grass product.
The catch basin inlet is a precast concrete gutter inlet box unit. The inlet unit will be connected
to a subsurface leaching facility. The leaching facility is a series of 500 gallon precast units with
stone on ends and sides. The bottom of the leaching facility is proposed 18 inches above the
groundwater elevation (pond).
The overall design is designed to handle the first flush of the contributory area. Typically, the
first flush is the first inch of rainfall. The proposed drainage facility is designed to handle the first
flush. During events that the leaching facility is maximized and full, the stormwater will then
sheet flow from the grassed swale and outlet towards the Pond.
Variance Request:
A large portion of the project is proposed within the 50-foot Buffer Zone. As required, the project
must receive a variance from the Brewster Wetlands By-Law and Regulations. The following is
an alternative analysis to the proposal.
• Expand Scope to remediate all stormwater discharge:
The alternative to the current proposal would be to expand the scope of the drainage
improvements. The expanded scope could include pervious pavement for both access
roads and Increase the stormwater capacity by expanding the leaching facility.
Due to available funding limitations and the significant increase of costs, the expanded
scope was eliminated.

The Department of Natural Resources proposed the installation of two pre cast concrete trench drains
to be installed on each access drive. The trench drains are proposed to connect by way of 6 inch ADS
piping to a grassed outfall channel with check dams and then to a grassed swale which will serve as a
stilling area for stormwater prior to discharge to a catch basin inlet. The drainage improvements are
proposed to mitigate the first flush of stormwater and contribute to water quality improvements for

Request for Determination of Applicability (RDA) Filing Checklist
Before you submit your Request for Determination of Applicability to the Conservation Commission and
other applicable agencies, please complete and sign this check -list, showing that you understand and
have completed all of the forms and procedures required for a Request for Determination filing. The
Conservation Commission will not open the hearing if the filing is not complete.
Submit only ONE copy of this checklist.
The Conservation Commission requires one (1) electronic copy and ten (10) paper copies of the Notice
of Intent and attached plans of the RDA and attached plans for each filing. Include each item of the
application, with pages numbered consecutively and in the order designated on the checklist. Staple
these pages together, and attach the plan(s) to the RDA with a paper clip. All of the pages and plan
represent one copy of the application. Send one copy of the RDA by US Certified, Return Receipt Mail, to
the DEP Southeast Regional Office, 20 Riverside Drive, Lakeville, MA, 02347. Submit the Certified
Receipt Postal Service Form 3800 to the Conservation Commission with the RDA.
Application
1. Obtain a certified abutters' list from the Brewster Assessors' Office and a photocopy of the
appropriate section of the Town of Brewster Assessors' map, showing the property of the project and
all abutting properties required for a legal wetland filing under the BWP By-law. This list will provide the
names of all direct abutters to the property (first abutters), all that abut the first abutters (second
abutters) if they are within 300 feet of the lot lines of the property, and lot(s) directly across the street
from your lot. The street is the first abutter and lots directly across, second abutters.
If abutters are in another town, obtain a certified list of the abutters from the assessors' office in
that town. and submit it and the appropriate assessors' map in the application also.
Submit the certified abutters' list and the Assessors' map. as part of the application
2. Notify all abutters on the list of your proposed project on the RDA "Notice to Abutters" form
letter, by Certified, Return Receipt mail or hand delivery before or on the day of filing, and
submit the Certified Mail receipts (Form 3800) as part of the filing. Submit the US Postal
Service Form 3811 at the hearing.
3. Complete and include the state RDA application (WPA Form 1).
q 4. If applicable, include DEP Appendix G. Field Data Forms for bordering vegetated wetlands.
Submit one form for each area tested; one form for the wetland area and one for the upland.
5. Include a photocopy of an 8" by 10" section of the appropriate United States Geological Survey
(USGS) Quadrangle Map clearly showing the location of the project.
6. Include a clear narrative. describing all aspects of the project.
L2' 7. Include a professional site plan in accordance with the enclosed Brewster Conservation
Commission "Policy for Plans Used for Wetland Permitting". Designate buffer zones and wetlands
in color (blue line = 100 feet, red line = 50 feet, green line = wetland).
D / 8. Include a copy of the RDA "Notice to Abutters" form letter.
q t. 9. If the lot is an undeveloped, secluded, or otherwise unidentifiable area, identify the lot on the plan
by the number of the nearest telephone pole or the nearest road intersection. If there is no pole on
the lot, describe the lot's proximity to the nearest; for example, "The lot is twelve feet
east of telephone pole no.167".
E 10. The town filing fee for a Request for Determination of Applicability is $75.00, with an advertising
fee of $15.00 and a $20.00 fee for processing and mailing. Include this as one check for $110.00
payable to the Town of Brewster, with the application. The state does not assess a fee for an RDA.
IV 11. Fold each plan separately, right side out with the title visible, and paper clip it to each copy of
the application.

13. Properly stake and flag the project site to identify all portions of the project, prior to the day of
filing.

• Clearly identify all stakes and flags in the field, showing the 100 foot and 50 foot

• Designate each wetland type on the flag as "BVW" (bordering vegetated wetland),
'`TOB" (top of bank), "LSF" (land subject to flooding). etc.
Department staff and Conservation Commissioners will inspect the site.
Unless a holiday interferes, the filing deadline for applications is noon on the Friday at least ten
(10) business days before the hearing. The hearing must be advertised in a local newspaper (at
the time, the Cape Codder newspaper) no less than five business days before a hearing. When a
holiday interferes with the Friday production, the newspaper will notify the town of its earlier

RE: Ellis Landing Park Condominium – Bank Protection – Revetment Repair DEP File
No. SE9-1872 – Beach Nourishment Summary
To the Conservation Commission,
In advance of the May 11 public hearing, we are providing a summary of the beach nourishment
reasoning and additional reasoning for the scope of work as modified from the initial proposal.
Attachments - Two plans are attached with this summary. Both have been adjusted in size to be
consistent with a 1 in. = 40 ft. scale for direct comparison: The 1979 plan shows a top of Coastal
Bank trace as measured at that time and the 1994 stone revetment plan shows the 1994 top of
bank location with a traced image of the 1979 bank top on it. As we’ve indicated some of the
land form on the east end was likely coastal dune prior to its eroded departure accounting for the
greater retreat rate in that easternmost segment. These maps and the changes across the site are
the basis of the sediment calculation.
Project Reasoning and Third-Party Review - The low-profile stone buttress proposed for the
landward edge of the revetment cap zone effectively “steps” the revetment back, providing far
more effective wave energy absorption than a higher, shallower angled stone face. The increase
in protection by an approximate 1.5 to 2 ft. elevation increase makes the revetment more
consistent with the revetment cap heights that exist to the west. The choice to add the stone is
the same change but smaller in height as the Scherzo revetment height increase project, DEP File
No. SE9-1620, located several hundred feet to the west. This project, though greater in length,
but being smaller in height but similar in all other ways as a nearby approved project might not
warrant a third-party technical review. Mr. Berman’s summary of the reduced project scope was
positive: “Compared to the previous plan, the 02/18/2021 design should have less impact on the
coastal resource areas. It should also serve to reduce scour along the top of the revetment and
reduce the negative impact of the existing structure, which may extend the lifespan of the
structure before it needs a complete rebuild.” I believe we are in close agreement on the
sediment topic and acknowledge that sediment is necessary intended to make up for past years
when nourishment was not supplied.
Beach Sediment and Revetment Conditions - The sediment budget along this segment of
Brewster shoreline has been effectively starved by an efficient stone groin existing 700 ft. to the
west. The groin’s effect to sediment supply is visibly greater than that caused by a lack of

coastal bank erosion. For example, the coastal bank to the west of the groin is not eroding and
the beach is extensive. The stone revetments that exist for a distance of 430 ft. east of the stone
groin are all constructed to elevations approximately matching the top of the coastal bank,
ranging in elevation from elev. = 17 to elev. = 20. Going east, that revetment system cap
elevation transitions down approaching the 102 Kingfisher Cartway property and Ellis Landing
Park Condominium site to elev. = 15. The lower elevation proves to be problematic with over-
topping action. At the time the Ellis Condominium revetment was approved, the criteria were
not so much related to an erosion rate, but rather the building locations would not tolerate any
further erosion hence the low crested revetment was attempted as a low intensity design and
approved. Robert Oldale, a geologist contributing for the geologic maps of Cape Cod spoke
with me at that time and related that the vast offshore Brewster sand flats represented thousands
of years of eroded sediment and those flats routinely exchanged sediment with the beaches. This
observation and the estimated coastal bank sediment contribution provides a basis to expect
benefits from beach sediment nourishment but in combination with the natural process.
Observations at the Ellis Condominium beach show that a beach routinely develops adjacent to
the revetment. Prior to the revetment installation the land form was a reflective, almost vertical,
consolidated clay soil cliff with perched water breaking out as indicated in past correspondence.
(See Figure 1 below). Since the revetment was installed, the beach condition has been observed
to be sandier than the conditions appearing in Figure 1.

Erosion Rate and Sediment Nourishment - Using the two plans, 1979 and 1994, the estimated
17-year average rate of bank retreat resulted in a 0.25 ft. / year estimated retreat rate. The
evaluation included the larger retreat shown to occur on the east end of locus (likely dune, some
of which remains toward Ellis Landing). The 17-year retreat over the central portion of locus was
near zero. Erosion was greater to the west. The commonly given erosion rate of 0.5 ft. / yr.
applied to glacial coastal banks appears excessive given observations during my own 40-year
career. For comparison, the Cape Cod National Seashore documented coastal bank erosion rate
caused by the Atlantic Ocean is approximately 3 ft. / yr. with constant action by long distance,
deep water ocean waves and storm action with no significant shoaling. The shore system losses
in Brewster during the last 40 years have largely been dune land losses with many areas avoiding
glacial retreat altogether. Otherwise, if there was 20 ft. of glacial bank retreat along the Brewster
coast, we would be observing more significant cleaving off of glacial coastal banks, with trees,
stumps and rubble remnants on the beaches. The specter of such an erosion result has not been
observed except in discreet locations, Sears Point, for example, where the beach and bank is
burdened by a nearby stone groin. In contrast to the Sears Point condition, for several hundred
feet west of Breakwater Landing, for most of the Governor Prence Rd. north-facing properties,
the coastal bank erosion is virtually nil since the early 1970s. Similar near zero glacial bank
erosion rates exist along much of the Brewster shoreline east of Breakwater Beach. Although
several properties have coastal protection, of the approximate 80 buildings between Breakwater
Beach and the Ellis Condominium project locus, none can be observed to have eroding coastal
banks between the buildings and the beach.
Some locations are more erosion - active than others and observations during the past 10 years
have revealed significant erosion, focused in locations with beach sediment affected by the old
existing stone groins. The Ellis Landing Park Condominium project area is also burdened by an
efficient stone groin built in the late 1950s. (See figure 2). As shown in Figure 1 the Ellis
Landing Park Condominium c. bank is comprised of a mix of clay and sand. Eroded clay

remains in suspension and does not serve as beach nourishment. This factor reduces the sand
volume portion of any cross section. Given this reasoning, the A 0.25 ft. per year bank erosion
rate would be a suitable rate to calculate a sediment mitigation program.
In the current case, a larger volume sediment program would be appropriate to begin with as an
effort to mitigate for the sediment volume not donated since the revetment was first constructed.
Twenty - five years at 61 c.y. (calculated) per year is 1,525 c.y. Rather than over-dose the
sediment system in a single dose, extra volume may be added to the annualized volume
previously recommended of 70 c.y. For example, it is recommended that 300 c.y. be provided at
the initial construction time, with 100 c.y. added to the suggested 70 c.y. annual volume ( as
rounded up) for 12 years (170 c.y. / yr. ) to arrive at a zero-balance due the beach. From that
point forward the sediment dose returns to the 70 c.y. as suggested. Periodic monitoring is
advised to monitor for storm occurrence and the beach sediment condition. With findings related
to storm count and beach conditions, there may be adjustments to the sand nourishment practice.
Stabilization Planting – The plan calls for intensive beach grass in the disturbed areas of the
slope. The existing shrub cover above and surrounding the work area will be preserved. Added
native over- seed treatments and added shrubs can be included however these additions can be
assessed based on the stability of the work area as the work is accomplished and its final
condition. The goal is to preserve existing terrain and vegetation. Beach grass is known to
provide the quickest stabilizing effect.
The applicants are building owners who were not involved in the 1995 project. They are
collectively bringing the application to the Commission in order to make repairs and relatively
minor adjustments to manage the erosion above this low-crested stone revetment and with re-
visiting the sediment nourishment aspects, in a manner that is similar and consistent with recent
nearby projects (SE9-1620). It is their hope that the Commission can accept the reasoning and
details as presented to enable the work to proceed to the benefit of all interests.

During our last meeting, the Applicant inquired about the moving of accumulated sand within
the pathway on a seasonal basis. Having talked with the Applicants, they would like to propose
the following addition to the project scope.
The accumulated sands within the existing pathway shall be pushed out towards the upper
portion of the Coastal Beach.
• The sand would be graded out towards the beach so as to provide an even and smooth
pathway to the beach area.
• A small "dingo" type machine will be used to push the sand out to the beach. A skid-
steer or larger track excavator are not be used.
• Sand relocation shall occur annually and take place during the spring season.
• No vegetation shall be disturbed as a result of the sand relocations.
• The Commission's Agent shall be notified as to when the sand will be relocated so as to
review the site conditions. A minimum of 5 days' notice to the Agent will be required.
We hope the Commission finds this proposal is in keeping with maintaining a pathway to the
beach which is serves many homes of the area. We look forward to attending your next virtual
