HomeMy Public PortalAboutOrdinance 1554r ORDINANCE NO. 1554 CHAPTER 5 Sec. 5-197: AN ORDINANCE AUTHORIZING THE ENFORCEMENT OF THE ILLINOIS VEHICLE CODE ON PRIVATE ROADS WITHIN THE LAKELANDS SUBDIVISION BY THE VILLAGE OF PLAINFIELD. WHEREAS, 625 ILCS 5/11-209.1 provides that where the owners, operators or representatives of a residential subdivision, development, or single-family residences file a written request requesting their law enforcement agency enforce the provisions of the Illinois Vehicle Code on all private streets or roads, the local authority may grant such request by the adoption of an enabling ordinance; and WHEREAS, the Lakelands Corporation, an Illinois Corporation, has filed such a Petition with the Village of Plainfield requesting the above; and WHEREAS, upon the adoption of such an enabling ordinance, all such private streets ar roads shall be considered highways only for enforcement purposes of the Illinois Vehicle Code; and WHEREAS, said statute provides that the local authority may require that any person who files a request for the installation of traffic signs to pay for the cost of such traffic signs; and WHEREAS, the Lakelands Corporation has agreed to pay for such costs. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF PLAINFIELD, AS FOLLOWS: T. That all private streets or roads contained in the territory known as the Lakelands Subdivision as depicted on the attached map shall be subject to the regulation and traffic enforcement by the Village of Plainfield as set forth in the Illinois Vehicle Code and the local. ordinances of the Village of Plainfield. II. That the filing of the written regrxest in question in no way constitutes a dedication to public use of any street, road, driveway, trail, terrace, bridle path, parkway, parking area or other roadway open to or used by vehicular traffic, nor does it prevent such requesting party from requiring additional regulations than those specified by the Village of Plainfield or otherwise regulating such use as may seem best to such requesting authority so long as they do not conflict with the powers granted to the local authorities under Section 11-208 of the Illinois Vehicle Code. III. This ordinance shall be in full Force and effect from and after its passage, approval and publication as required by law. Mr. Clark has filed a petition for police services and will be responsible for all traffic signs and markings needed to enforce traffic laws within this development. Mr. Jim Harvey has made the necessary ordinances to allow this enforcement to occur. DEB/kj cc: file
