CALL TO ORDER Mayor Vizcarra called the City Council Regular Meeting to order at 7:31 p.m. in the Council Chambers located at 5938 Kauffman Avenue, Temple City. 2. ROLL CALL PRESENT: Councilmember - Arrighi, Capra, Wong, Zovak, Vizcarra ABSENT: Councilmember -None ALSO PRESENT: City Manager Cole, City Attorney Martin, Assistant City Manager /Parks and Recreation Director Burroughs, Community Development Director Dawson, City Clerk Flandrick, Senior Management Assistant Flod, Public Services Director Stroud 3. PLEDGE OF ALLEGIANCE Linda Payne, President of the Temple City Chamber of Commerce, led those present in the Pledge of Allegiance to the Flag. 4. CEREMONIAL MATTERS Mayor Vizcarra, on behalf of the City Council, presented a proclamation to Frank Den Hartog, owner of Sir Jax Deli, on the occasion of his retirement. 5. PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA — None 6. CONSENT CALENDAR Councilmember Capra moved to approve the Consent Calendar, seconded by Councilmember Wong and unanimously carried by the following roll call vote: AYES: Councilmember - Arrighi, Capra, Wong, Zovak, Vizcarra NOES: Councilmember -None ABSENT: Councilmember -None ABSTAIN: Councilmember -None A. APPROVAL OF MINUTES Approved as presented: 1) Minutes of the Special Meeting of January 10, 2004; and 2) Minutes of the Regular Meeting of January 20, 2004. B. PLANNING COMMISSION ACTIONS — MEETING OF JANUARY 27, 2004. Received and filed the Planning Commission actions of their meeting of January 27, 2004. C. BUDGET AMENDMENT TO INSTALL AN 800 MEGAHERTZ FIXED BASE RADIO IN THE CITY'S EMERGENCY OPERATIONS CENTER Amended the budget for the installation of one (1) 800 megahertz fixed base enhanced digital access radio communication (EDACS) system to be installed in the City's Emergency Operations Center (EOC) to allow direct radio contact with the Los Angeles County's "County Wide Integrated Radio System" (CWIRS). F. REQUEST FOR TRAVEL AUTHORIZATION Authorized conference attendance and travel for a Commissioner. G. APPROVAL OF PROGRESS PAYMENT NO. 13 TO RKA CIVIL ENGINEERS, INC. FOR THE CRAIGLEE STREET NEW SEWER SYSTEM IMPROVEMENT PROJECT (CIP P02 -08) Approved progress payment No. 13 in the amount of $929.43 to RKA Civil Engineers, Inc. for work performed on the Craiglee Street New Sewer System Improvement Project (CIP P02 -08). H. ADOPTION OF RESOLUTION NO. 04 -4240 — APPROVAL OF PAYMENT OF BILLS Adopted Resolution No. 04 -4240, a RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY ALLOWING CLAIMS AND DEMANDS IN THE SUM OF $405,049.52 DEMAND NOS. 11989 THROUGH 12088. 7. UNFINISHED BUSINESS — None 8. NEW BUSINESS A. CONSIDERATION OF ADOPTING RESOLUTION NO. 04 -4241 RESTRICTING PARKING OF ANY COMMERCIAL VEHICLE ON ROSEMEAD BOULEVARD AND SETTING VIOLATION PENALTIES FOR ALL TRUCK ROUTES WITHIN THE CITY; AND ADOPTING RESOLUTION NO. 04 -4242 REGULATING VEHICLE PARKING ON ROSEMEAD BOULEVARD DURING SPECIFIC TIMES FOR STREET MAINTENANCE City Manager Cole presented two proposed resolutions to address a long standing problem of commercial vehicle parking on Rosemead Boulevard. Rosemead Boulevard is one of the busiest thoroughfares through the City and also a state highway, with Caltrans responsible for maintenance. Council was asked to consider Resolution No. 04 -4241 to restrict parking of commercial vehicles on Rosemead Boulevard. Permission would also be required from Caltrans. Currently, the Temple City Municipal Code limits the parking or standing of any commercial vehicles on established truck routes to one hour. Adoption of Resolution No. 04 -4241 would also establish specific penalties for violation of commercial vehicle parking along any truck route within the City. Resolution No. 04 -4242 would regulate vehicle parking along Rosemead Boulevard and its service roads during specific time periods for street maintenance purposes. These proposed resolutions will further the City Council's goal for improving the appearance of Rosemead Boulevard within the City. City Manager Cole and Public Services Director Stroud responded to questions from Council, stating similar parking restrictions have been implemented in the Cities of Rosemead and El Monte. Existing parking regulations would apply throughout town. The definition of commercial vehicle, as a vehicle in excess of 80" in width, is contained in the resolution. The City's Traffic Engineer, present to answer Council's questions, did review and concur with this proposal. Sylvia Almstadt, Callita Street, said it was impossible to see around commercial vehicles parked on Rosemead Boulevard for residents attempting to turn either left or right onto Rosemead. She felt this was a major issue of safety. She also mentioned 1 1 1 1 City Council Minutes February 3, 2004 Page 3 informing Code Enforcement about a problem of a transport truck parking in the red curb area between Callita Street and Emperor Avenue. Mayor Pro Tem Zovak moved to: 1) adopt Resolution No. 04 -4241, a RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY RESTRICTING THE PARKING OF COMMERCIAL VEHICLES ON ALL PORTIONS OF ROSEMEAD BOULEVARD WITHIN THE CITY BOUNDARIES AND ESTABLISHING THE PENALTY FOR PARKING VIOLATIONS ON ALL ESTABLISHED TRUCK ROUTES WITHIN CITY LIMITS; 2) adopt Resolution No. 04 -4242, a RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY REGULATING VEHICLE PARKING ON ROSEMEAD BOULEVARD AND THE ROSEMEAD BOULEVARD SERVICE ROADS FOR THE PURPOSES OF STREET MAINTENANCE; and 3) authorize the City Manager to obtain an encroachment permit from the California Department of Transportation for the installation of appropriate signage. seconded by Councilmember Wong and unanimously carried by the following roll call vote: AYES: Councilmember - Arrighi, Capra, Wong, Zovak, Vizcarra NOES: Councilmember -None ABSENT: Councilmember -None ABSTAIN: Councilmember -None B. CONSIDERATION OF PROPOSED RESOLUTION NO. 04 -4243 AUTHORIZING PARTICIPATION OF THE CITY OF TEMPLE CITY AS A FINALIST FOR SELECTION AS A RECIPIENT OF THE CHAMPIONS OF SMALL CITY MANAGEMENT AWARD FOR 2004 City Manager Cole announced the City was selected as a finalist for the Champion of Small City Management Award for 2004 by Pat Summerall Productions. City Manager Cole explained the City did not apply for this award, but rather was sought out by Pat Summerall Productions, which for eight consecutive years has selected organizations that exhibit a clear vision of where they are going and how they will get there. In addition to its Champions of Industry Award, Summerall Productions is selecting 25 cities nationwide to receive the Champions of Small City Management Award. Ultimate recipients will exemplify characteristics such as: commitment to economic development, public safety, exemplary schools, reasonable tax assessments, and city bond rating. Additionally, a recipient city will also exhibit an "understanding for the culture and history of their city and a vision for its future." This award would be an honor to City Council for their management of the City and something the citizens could take pride in. It would also mesh with Council's ongoing Business Retention and Attraction Program. Each recipient would be featured in a "Champions of Small City Management" two minute announcement that airs on Headline News Network, as well as streams on Forbes.com, and receive a 5 -6 minute marketing video. The proposed resolution authorizes the City to pursue the award, and if selected, appropriate $24,000 from the General Fund to absorb the production costs of the marketing video that would result from the City's award. City Manager Cole, in responding to Mayor Pro Tem Zovak's concern of the amount of money involved, stated the type of notoriety and level of positive exposure for the City merited that amount. Mayor Pro Tem Zovak asked how many cities were nominated and agreed there was benefit to the City but would have felt stronger if they City had applied for this award. City Council Minutes February 3, 2004 Page 4 Mayor Vizcarra said he was under the impression there was no money involved. City Manager Cole clarified, if the City did not receive the award, there would be no expenditure of money. It is not uncommon for a company to recoup direct costs of production. Previous awardees included the Santa Clara Water Company. Councilmember Arrighi suggested the recognition could be used on City stationary, etc. and Councilmember Capra felt the recognition alone was worth spending the $24,000, and it won't cost the City anything to apply. Councilmember Wong agreed the cost of marketing would be worth it if the City won the award. City Manager Cole stated the finalists would be announced in May. Councilmember Arrighi moved to adopt Resolution No. 04 -4243, a RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AUTHORIZING PARTICIPATION OF THE CITY OF TEMPLE CITY AS A FINALIST FOR SELECTION AS A RECIPIENT OF THE CHAMPIONS OF A SMALL CITY, seconded by Councilmember Wong and unanimously carried by the following roll call vote: AYES: Councilmember - Arrighi, Capra, Wong, Zovak, Vizcarra NOES: Councilmember -None ABSENT: Councilmember -None ABSTAIN: Councilmember -None 9. COMMUNICATIONS — None 10. RECESS TO COMMUNITY REDEVELOPMENT AGENCY At 8:06 p.m. the City Council recessed to the Community Redevelopment Agency meeting. Minutes of the Agency Meeting are set forth in full in the Agency's records. RECONVENE AS CITY COUNCIL The City Council meeting reconvened at 8:09 p.m. with all Councilmembers present. 11. COUNCIL REPORTS REGARDING AD HOC OR COMMISSION MEETINGS Councilmember Capra reported tentative meeting dates of February 23rd or 26th for the Ad Hoc School District Committee. Mayor Pro Tem Zovak stated the RFP Task Force would be meeting on February 17tH 16. COUNCIL ITEMS SEPARATE FROM THE CITY MANAGER'S REGULAR AGENDA A. COUNCILMEMBER ARRIGHI Councilmember Arrighi suggested purchasing large trash receptacles with the City's logo and donating them to the Temple City Post Office for the front of their building to aid them in cleaning their property. City Manager Cole responded, if Council appropriated the money, he would approach the Post Office to see if they have a process for receiving gifts from 1 1 1 1 1 City Council Minutes February 3, 2004 Page 5 government entities. Assistant City Manager /Parks and Recreation Director Burroughs said she could research the use of recyclable grant funds for this purpose. B. COUNCILMEMBER CAPRA Councilmember Capra commented on the nice turnout at the Chinese New Year event at Temple City Park and felt it would only get bigger each year. C. COUNCILMEMBER WONG Councilmember Wong thanked Council and staff for their support and attendance at the Chinese New Year event and asked for suggestions for future years. Councilmember Arrighi added that Councilmember Wong did an excellent job of emceeing the program and the Dance Academy's presentation was excellent. D. MAYOR PRO TEM ZOVAK At the request of Mayor Pro Tem Zovak, City Manager Cole updated Council on the status of signage at the shopping center on the northwest corner of Rosemead Boulevard and Las Tunas Drive. E. MAYOR VIZCARRA — None 17. LITIGATION UPDATE The City Council reviewed the most recent litigation update provided by the City Attorney. 18. CLOSED SESSION — None 19.
