HomeMy Public PortalAboutRES-CC-2002-18RESOLUTION 18-2002 A RESOLUTION TO APPROVE AN INTERLOCAL AGREEMENT BETWEEN THE CITY OF MOAB AND GRAND COUNTY, GRAND WATER AND SEWER AGENCY, SAN JUAN COUNTY AND THE STATE INSTITUTIONAL TRUST LANDS ADMINISTRATION WHEREAS, the City of Moab has an interest in development that occurs m Spanish Valley, and WHEREAS, the City of Moab operates and owns a sewer treatment plant that serves Spanish Valley, and, and, WHEREAS, regional development of infrastructure requires regional planning, WHEREAS, there has been established a roundtable partnership of regional Iunsdictions looking at development along the south comdor of Spanish Valley, and, WHEREAS, the City of Moab has procured a grant from the State Quality Growth Commission to fund an assessment and analysis of future development along the south comdor of Spanish Valley, and, WHEREAS, the City of Moab has the authonty to enter Into iterlocal a agreements with other jurisdictions, NOW, THEREFORE, BE IT RESOLVED that the City of Moab adopt the attached mterlocal agreement in substantially the form submitted to this meeting of the City Council See attached Iterlocal Agreement PASSED, ADOPTED AND APPROVED by the Moab Governing Body of the City of Moab in open session this 28s' day of May 2002 The resolution shall take effect immediately upon passage ATTEST Rachel Ellison City Recoidei David L Saknson, Mayor State Institutional Trust Lands Administration Date /��� o0 2 San Juan County By .4r`.t� Date 4,117)Z Ty Lewis, Chairman Attest Approved as to Form By �'li i, /h / Walter Bird, Deputy County Attorney San Juan County Attorney Date /p) fl /d C 02_ Date O/J%)aO(iL INTERLOCAL AGREEMENT By and Between the City of Moab, Grand Water & Sewer Agency, Grand County, State Institutional Trust Lands Administration and San Juan County Regarding Development Planning for the South End of Spatursb Valley This Interlocal Agreement is made and entered into this_. _day of .lWt L 2002 by and between the City of Moab, Grand Water & Sewer Agency, Grand County, State Institutional Trust Lands Administration and San Juan County Recitals Whereas, development is now occumng and will likely continue to occur in the future in the south end of Spanish Valley, and, Whereas, the City of Moab owns and operates a regional sewer treatment facility that will likely service the area and wishes not to undermine existing businesses, and, Whereas, the Grand Water & Sewer Agency will most likely be the provider of water and sewer services to most of Spanish Valley including the south end, and, Whereas, Grand County is a neighbor and adjacent jurisdiction to this area and wishes to strengthen economic stability, and, Whereas, State Institutional Trust Lands Administration is the pnmary land owner in the south end of Spanish Valley, and, Whereas, San Juan County is the junsdiction under which south end development will occur, and, Whereas, Spanish Valley is an integrated geographical area where a regional development strategy could be important, and, Whereas, all of the parties to this Agreement wish to reduce potential conflict and confusion, and promote reasonable development Agreement The parties agree as follows A Participation in Proposed Study- Parties agree to participate in the following study I Confirm/define existing/potential southern service boundaries (sewer/water/roads & trails) for Spanish Valley 2 Research Land Use Ordinances for Grand and San Juan Counties with the intent of finding areas of agreement, with an emphasis on a finding mutually agreeable planning processes and goals 3 Identify the respective parties philosophical goals and Integrate these goals into "mutually agreeable" planning processes/goals 4 Produce general land use plans on State Institutional Trust Lands lying within the determined southern service boundary limits that show current and potential land uses 5 Survey funding options for all services potentially extended into the southern service boundary area 6 Produce Interlocal Agreements concerning the process and goals of future development in the southern service boundary area B Funding of Study - Parties agree to fund the preceding Study up to a cost of $30,000 dollars according to the following percentages of responsibility State Institutional Trust Lands Administration 72% San Juan County 7% Grand County 7% The City of Moab 7% Grand Water & Sewer Agency 7% C Decision Making — All decisions of the parties shall be reached by consensus D Administration of Study -
