AN ORDINANCE OF THE CITY OF IONA, IDAHO,
REPEALING AND RE-ENACTING SECTIONS 7-11-1 AND 7-
11-2 OF THE CITY OF CODE OF IONA, IDAHO; PROVIDING
FOR THE ADOPTION OF THE 2003 INTERNATIONAL
ENERGY CONSERVATION CODE; PRESERVING PRIOR
ORDINANCE; PROVIDING FOR SEVERABILITY; AND
ESTABLISHING EFFECTIVE DATE.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF IONA,
IDAHO THAT:
Section 1. Repeal and Re-enactment of Sections 7-11-1 and 7-11-2, City Code.
Sections 7-11-1 and 7-11-2 of the City Code of Iona are hereby repealed and re-enacted
as follows:
7-11-1: INTERNATIONAL ENERGY CONSERVATION CODE ADOPTED:
(A) International Energy Conservation Code Adopted: The International Energy
Conservation Code, 2003 Edition, published by the International Code Council, Inc.,
is hereby adopted as an official code of the City, except the portions deleted,
modified or amended by the provisions of this chapter.
(B) Code on File: One (1) copy of the International Energy Conservation Code, 2003
Edition, duly certified by the Clerk, shall be retained by the City Clerk for use and
examination by the public.
Section 2. Preservation of Prior Ordinance. The sections of the City Code
amended or repealed by this Ordinance shall be preserved to the extent necessary to allow
the arrest, prosecution and punishment of any person who violates such provisions prior
to the effective date hereof.
Section 3. Severability. The provisions of the Ordinance are severable. In the
event that any provisions shall be determined to be void or unenforceable for any reason,
such determination shall not effect the enforceability of the remaining provisions.
Section 4. Effective Date This Ordinance shall be effective on January 1, 2005,
provided it has just been passed, executed and published in the manner provided by law.
