ADMINISTRATIVE SERVICES DEPARTMENT MEMORANDUM DATE: February 4, 2014 TO: The Honorable City Council FROM: Tracey L. Hause, Acting City Manager/Administrative Services Director SUBJECT: AUTHORIZING FACSIMILE SIGNATURES FOR THE DRAWING OF CITY WARRANTS AND CHECKS RECOMMENDATION: The City Council is requested to adopt Resolution No. 14-4970 (Attachment "A"), approving a change in the authorized signers for City warrants and checks . BACKGROUND: 1. On November 3, 2009, the City Council adopted Resolution No. 09-4640 authorizing facsimile signatures for City warrants and checks. 2. On April 3, the City Council adopted Resolution No. 12-4808, appointing Tracey Hause as the City Treasurer. 3. On January 13, 2014, the City Council terminated City Manager Jose Pul ido's employment agreement. ANALYSIS: Pursuant to Government Code Section 37203, the mayor shall draw a warrant or warrants upon the city treasurer specifying the purpose for which drawn and the fund from which payment is to be made. The city clerk shall countersign the warrant. The legislative body, by ordinance or resolution , may prescribe an alternative method of drawing warrants and checks. The City in recent years had prescribed an alternative method for drawing (i.e. "signing ") the City's warrants and checks. The City Council by Resolution No. 09-4640, authorized all warrants and checks have joint signatures (2) from the following authorized signatures: City Council February 4, 2014 Page 2 of 3 • City Manager; Jose E. Pulido; • Deputy City Treasurer, Mary R. Flandrick; • Deputy City Treasurer; Monica Molina; and • Director of Parks and Recreation, Cathy Burroughs. While it is not clear why the City Clerk and the Financial Services Manager, were named Deputy City Treasurer, as staff could not locate any official documentation (i.e., Classification Plans or other appointing Resolutions) that would identify them in this capacity, staff is recommending the proposed Resolution for adoption include the adopted and accurate titles of the staff that are being suggested as authorized signatures. The separation of City Manager Pulido caused staff to review the current Resolution and recommend revisions to the authorized signatures. Since it may be a number of months before a permanent City Manager is appointed, it is recommended the City Council adopt the attached Resolution in the interim, removing City Manager Pulido name as an authorized signature and update the current authorized signatures. It is also recommended the City add the current City Clerk, Peggy Kuo as an authorized signer. When a permanent City Manager is appointed, staff will then once again return to the City Council with a Resolution that will include his or her name, title and signature. CONCLUSION: In order to ensure the City is in accordance with Government Code Section 37203, adoption of the attached Resolution No. 14-4970 is recommended; requiring joint (2) signatures on all warrants and checks of the following officers: • Administrative Services Director/City Treasurer, Tracey L. Hause; • Director of Parks and Recreation, Catherine Burroughs; and • City Clerk, Peggy Kuo FISCAL IMPACT: There is not fiscal impact of this action to the Fiscal Year (FY) 2013-14 City Budget. Resolution No. 14-4970 ATTACHMENT A RESOLUTION NO. 14-4970 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY AUTHORIZING FACSIMILE SIGNATURE FOR THE DRAWING OF CITY WARRANTS AND CHECKS THE CITY COUNCIL OF THE CITY OF TEMPLE CITY DOES HEREBY RESOLVE, DETERMINE AND ORDER: SECTION 1. Pursuant to Government Code Section 37203 the following method is prescribed for the drawing of all warrants and checks: All warrants and checks shall be drawn upon the joint signatures of two of the following officers: • Administrative Services Director/City Treasurer; • Director of Parks and Recreation; and • City Clerk SECTION 2. Jose E. Pulido as City Manager, is hereby removed as an authorized signer effective January 13, 2014. SECTION 3. The City Council of the City of Temple City does hereby authorize the City Treasurer to utilize Facsimile Signatures for the following personnel pursuant to Section 37203 of the Government Code. Tracey L. Hause Administrative Services Director/ City Treasurer Peggy Kuo City Clerk Catherine M. Burroughs Director of Parks and Recreation SECTION 5. These signatures are hereby approved for the drawing of warrants and checks. SECTION 6. The City Clerk shall certify to the passage and adoption of this resolution.
