ADMINISTRATIVE SERVICES DEPARTMENT MEMORANDUM DATE: February 4, 2014 TO: The Honorable City Council FROM: Eric Vail, City Attorney SUBJECT: ACTING PAY FOR ADMINISTRATIVE SERVICES DIRECTOR RECOMMENDATION: It is recommended that the City Council approve five percent (5%) Acting Pay for Administrative Services Director Hause, effective January 14, 2014, while she in in the acting capacity of the City Manager. BACKGROUND: 1. On September 2, 2008, the City Council adopted Resolution No. 08-4569 adopting and amending the current Personnel Policies and Regulations (Policies). 2. On December 18, 2012, the City Council adopted Resolution No. 12-4878 amending and adopting Personnel Rules for full time employees. 3 . On January 15, 2013, the City Council adopted Reso lution No. 13-4885 amending Personnel Rules for full time employees allowing for and implementing a cap on compensatory time earned. 4. On January 13, 2014, the City Council terminated the employee agreement with City Manager Pulido. 5. Also on January 13, 2014, the City Council appointed Administrative Services Director Hause Acting City Manager, effective January 14, 2014. ANALYSIS: It is common and industry standard that when an emp loyee who is temporarily appointed to and assumes the responsibilities of another pos it ion that is higher within the organization, acting pay is granted. Further, the City's Personnel Rules addresses and allow for an employee who is in an acting appointment receive a salary increase of five percent (5%) to his/her base salary during the duration of the acting appointment. City Council February 4, 2014 Page 2 of 2 While Administrative Services Director Hause is an at-will employee and the terms of her employment are within her employment agreement, it is recommended the City remain consistent with the Personnel Rules for all employees with regards to acting pay. CONCLUSION: It is recommended that due to the additional responsibilities assumed by the Administrative Services Director, serving in the acting capacity of the City Manager, and to ensure consistency with the Personnel Rules for all employees with regards to this type of pay, the City Council grant five percent (5%) Acting Pay to the Administrative Services Director, effective January 14, 2014, until an Interim City Manager is hired. FISCAL IMPACT: There will be a fiscal impact to the Fiscal Year (FY) 2013-14 City Budget with this action. The amount will depend on the duration of the acting appointment Five percent (5%) Acting Pay of the Administrative Services Director's current salary is $631 monthly. If the appointment is short in duration, it is anticipated the additional amount can be absorbed in the adopted FY 2013-14 City Budget If staff finds it necessary, they will return to the City Council during the FY 2013-14 Mid-Year City Budget Review process with a recommendation for an appropriation adjustment
