AN ORDINANCE REPEALING AND RE-ENACTING SECTIONS 7-
10-1 THROUGH 7-10-12 OF THE CITY CODE OF IONA, IDAHO;
PROVIDING FOR THE ADOPTION OF THE INTERNATIONAL
FIRE CODE, 2003 EDITION; MAKING CERTAIN AMENDMENTS
THERETO; PROVIDING FOR SEVERABILITY; PRESERVING
PRIOR ORDINANCE; AND ESTABLISHING EFFECTIVE DATE.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
IONA, IDAHO THAT:
Section 1. Adoption of Sections 7-10-1 through 7-10-12, Iona City Code.
Sections 7-10-1 through 7-10-12 of the City Code of Iona, Idaho, are hereby repealed
and re-enacted as follows:
7-10-1: INTERNATIONAL FIRE CODE ADOPTED.
(A) Fire Code Adopted: The International Fire Code, 2003 Edition, as
published by the International Code Council, Inc., including all
Appendices, are hereby adopted as an official code of the City, save and
except such portions as are hereinafter deleted, modified or amended by
the provisions of this chapter.
(B) Code on File: One (1) copy of the International Fire Code, 2003 Edition,
duly certified by the Clerk shall be retained by the City Clerk for use and
examination by the public.
7-10-2: ESTABLISHMENT AND DUTIES: FIRE PREVENTION & EDUCATION
BUREAU.
(A) The International Fire Code shall be enforced by the Fire Prevention &
Education Bureau of the Fire and Public Safety Division. The Code
Official, under the supervision of the Fire Chief, shall manage the code
process, and the assigned Division Chief shall manage the education
duties.
(B) The Chief of the Fire and Public Safety Division may detail members of
such division as inspectors, as necessary. The Fire Chief shall
recommend to the Mayor the employment of technical inspectors who
shall be selected through an examination to determine their fitness for the
position.
7-10-3 DEFINITIONS: Whenever found in the International Code, the following
words shall have the meanings ascribed to them herein:

LIFE -SAFETY SYSTEM: Automatic fire -extinguishing system, fire alarm and
detection systems, fire pumps and related equipment.
7-10-4: ESTABLISHMENT OF LIMITS OF DISTRICTS IN WHICH STORAGE OF
FLAMMABLE OR COMBUSTIBLE LIQUIDS IN OUTSIDE ABOVEGROUND TANKS IS
PROHIBITED.
(A) The limits referred to in Sections 3404.2.9.5.1 of the International
Fire Code in which the storage of flammable and combustible liquids in
outside aboveground tanks is prohibited, are hereby established as
follows: The Corporate Limits of the City.
Exceptions:
(1) The Code Official, with approval of the Fire Chief, may allow
protected above ground tanks at motor vehicle fuel
dispensing stations where underground rock formations or
water levels make it extremely difficult or impossible to install
underground tanks. These tanks must meet the UL 2085
listing and comply with Sections 1106.2 and 2206.2.3, and
3404.2.9.5 of the International Fire Code. Each approved
tank shall be limited to twelve thousand (12,000) gallon
capacity, and no more than forty-eight (48,000) gallons may
be stored in this manner on any one property within the City.
(2) The Code Official, with approval of the Fire Chief, may allow
the use of temporary aboveground storage tanks at
construction sites, earth moving projects or gravel pits. Such
tanks shall comply with Section 3406.2 thru 3406.2.8.1, of
the International Fire Code.
(B) The storage of flammable or combustible liquids in above -ground tanks,
and the dispensing of flammable or combustible liquids into vehicles from
above -ground tanks, shall not be permitted in the following zones as
defined by the City Zoning Ordinance and located by the Official Zone
Map: RP, RP -A, R-1, R-2, R-2A, R-3, R-3A, P-B and RMH.

LIQUIFIED
(A)
The limits in which new bulk plants in accordance with Section 3406.2.4.4,
where flammable or combustible liquids are received by tank vessels,
pipelines, tank cars, or tank vehicles, and are stored or blended in bulk for
the purpose of distributing such liquids by tank vessels, pipelines, tank
cars, tank vehicles or containers are prohibited are hereby established as
follows: The Corporate Limits of the City.
ESTABLISHMENT OF LIMITS OF DISTRICTS IN WHICH STORAGE OF
PETROLEUM GASSES IS TO BE RESTRICTED:
The limits referred to in Section 3804.2 of the International Fire Code, in
which the storage of liquefied petroleum gas is restricted, are hereby
established as follows: all zones except l&M-1 and l&M-2, Industrial and
Manufacturing Zones as defined and designated in the City Zoning
Ordinance.
Exception:
(1) In particular installations, this capacity limit shall be
determined by the Code Official, after consideration of
special features such In particular as topographical
conditions, nature of occupancy, proximity to buildings,
capacity of proposed containers, degree of fire protection to
be provided, and the capabilities of the fire department.
7-10-6: ESTABLISHMENT OF LIMITS OF DISTRICTS IN WHICH STORAGE OF
EXPLOSIVES AND BLASTING AGENTS IS TO BE PROHIBITED:
The limits referred to in Section 3301.2.3 of the International Fire Code, in which
storage of explosives and blasting agents is restricted or prohibited, are hereby
established as follows: The corporate limits of the City.
7-10-7: AMENDMENTS TO THE INTERNATIONAL FIRE CODE: The
International Fire Code, 2003 Edition, is amended and changed in the following
respects.
(A) Section 103.2 is amended as follows:
The code official shall be appointed by the chief appointing authority of
the jurisdiction.
(B) Section 105.7.1 is amended as follows:
105.7.1 Automatic fire -extinguishing systems. A construction permit and
life safety license is required for installation of or modification to an
automatic fire extinguishing system. Maintenance performed in
accordance with this code is not considered a modification and does not
require a permit.
(C) Section 105.7.3 is amended as follows:
105.7.3 Fire alarm and detection systems and related equipment. A
construction permit and life safety license is required for installation of or
modification to fire alarm and detection systems and related equipment.
Maintenance performed in accordance with this code is not considered a
modification and does not require a permit
(D) Section 105.7.4 is amended as follows:
105.7.4 Fire pumps and related equipment. A construction permit and
life safety license is required for installation of or modification to fire
pumps and related fuel tanks, jockey pumps, controllers, and generators.
Maintenance performed in accordance with this code is not considered a
modification and does not require a permit.
(E) Section 901.6.2 is amended by adding the following provision:
An additional copy of all inspection and test reports shall be sent to the
lona Fire Prevention Bureau by the contractor (person) doing the
maintenance or inspection.
(F) Section 903.2.7 is amended by adding the following exception:
EXCEPTION: Automatic sprinkler systems are not required in 3 or 4 unit
Group R buildings.
(G) Section 907.2 is amended by adding the following provision:
An approved addressable fire alarm system meeting the provisions of this
code, and NFPA 72, shall be installed when the gross square footage of a
building is equal to or greater than the area as specified in Sections
903.2.1 through 903.2.10 inclusive, subject to the authority having
jurisdiction or by Section 907, whichever is more restrictive.
Exception:
(1) Buildings with eight or less initiating devices may be zoned
systems provided only one device is used per zone. Each
device shall have a plain English LCD (liquid crystal display).
7-10-8 ADDITIONS TO THE 2003 INTERNATIONAL FIRE CODE
(A) Add a New Section 112 — "Permits"
A permit shall be obtained from the Fire Department Administrative
Offices, prior to engaging in activities, operations, practices or functions
as set forth in Section 105 of the International Fire Code. Fees for
operational and construction permits, that are required by the Code, shall
be paid to the City of lona at the Fire Department Administrative Offices.
(B) Add a New Section 112.2 — "Permit Fees"
1. Each operational permit fee shall be fifty dollars ($50.00)
2. Each construction permit fee shall be fifty dollars ($50.00)
(C) Add a New Section 112.3 — "Penalties for work completed without
permit"
Failure to obtain a permit, prior to engaging in activities, operations,
practices or functions, as set forth in the International Code, shall
constitute a violation of the Code. The activity, operation or practice will be
stopped until a permit has been obtained and a double permit fee
collected.
(D) Add a New Section 113 — "Life Safety License"
All installations, modifications, maintenance or servicing of life -safety
systems are to be performed by an approved licensed business or
person(s). A business or person(s) shall obtain a " Life Safety License"
from the Fire Administrative Office, to do work in the City of lona. Licenses
shall expire one year from the date of issuance unless otherwise noted on
the license.
(E) Add a New Section 113.1- "Life Safety License Fee"
Each life safety license fee shall be one hundred twenty five dollars
($125.00) annually.
(F) Add a New Section 113.2 — "Penalties for Violation of Licenses"
Any person who violates any rules or regulations, as written on the license
application, shall be guilty of a misdemeanor and upon conviction shall be
punished by a fine of not more than three hundred dollars ($300.00) for
each day of violation.
(G) Add a New Section 114- "Plan Review Fees"
1. Structural plan review fees will be charged at a rate of $50 per
5000 square feet, or portion thereof, up to a maximum of $500.
2. Fire Alarm plan review fees will be charged at a rate of $50 per 100
devices, or portion thereof, up to a maximum of $150.
3. Fire Sprinkler System fees will be a flat rate of $100
4. Fire Pump fees will be a flat rate of $100
(H) Add a New Section 115 — "Mitigation Reimbursement fees"
(l)
Reimbursement fees that are actual and necessary expenses incurred in
carrying out the mitigation of specialized emergencies including, but not
limited to, hazardous materials, specialized rescue, and crime scenes
(including arson) shall be invoiced to the responsible person, firm or
corporation. An available Fee Schedule shall be reviewed and posted
annually by the Fire Administration Office. Fees may include, but not be
limited to, personnel compensation, apparatus use, equipment use, and
specialized contract labor associated with the mitigation of the
specialized emergency.
Add a New Section 116 — "Tags"
Tags for inspection of fire suppression systems, fire extinguishers and fire
alarm systems are required to be purchased from the lona Fire Prevention
Bureau for use in the City of lona.
(J) Add a New Section 907.2(a)
Addressable fire alarm systems shall be monitored by a UL listed
monitoring station.
(K) Add a New Section 907.9.3 — "Zone and Address Location Labeling"
Fire Alarm panels shall have all zones and address points plainly and
permanently labeled as to their location, on the outside of the panel or on
an easily readable map of the building.
(L) Amend Section 907.15 — "Monitoring", to read as follows:
When required by this chapter, or the Code Official, an approved UL listed
remote station in accordance with NFPA 72, shall monitor fire alarm
systems to provide for the immediate and automatic notification of the Fire
Department.
Exception:
(1) Supervisory service is not required in one and two family
dwellings.
7-10-9 SUPPLEMENTAL STANDARDS OF REFERENCE:
The Code Official, or his nominee may, when it is deemed appropriate to assure
safe conditions, refer to the current addition of the National Fire Protection
Association (NFPA) Standards to clarify and/or augment the design, installation,
or maintenance of the following:
Fire extinguishing systems, fire alarm systems, fire detectors, emergency voice
alarm communication systems, and notification devices.
7-10-10 APPEALS:
Whenever the Code Official shall disapprove or refuse to grant a permit or
license applied for, or when it is claimed that the provisions of the Code do not
apply or that the true meaning of the Code has been misconstrued or wrongly
interpreted, the applicant may appeal the decision to the Board of Appeals within
thirty days from the delivery of the decision to the applicant. The procedures set
for appeals shall be as set forth in Appendix A of the 2000 Edition of the
International Fire Code. "Delivery" is defined as depositing in the U.S. Mail,
postage prepaid, addressed to addressee on application.
7-10-11 NEW MATERIALS, PROCESSES OR OCCUPANCIES WHICH MAY
REQUIRE PERMITS:
The Code Official and the Fire Chief shall act as a committee to determine and
specify, after giving affected persons an opportunity to be heard, any new
materials, processes or occupancies that shall require permits, in addition to
those now enumerated in said code. The Code Official shall post such list in a
conspicuous place in his office and shall deliver a copy thereof to any interested
person, upon their request.
7-10-12 PENALTIES:
Each and every violation of this Code shall constitute, and be punishable, as a
misdemeanor.
Section 2. Severability. The provisions of this Ordinance are severable. In
the event any provisions shall be determined to be void or unenforceable for any
reason, such determination shall not affect the enforceability of the remaining
provisions.
Section 3. Preservation of Prior Ordinance. All portions of the City Code
repealed by this Ordinance shall be preserved to permit the arrest, prosecution and
punishment of any person who violates such repealed section prior to the effective date
hereof.
Section 4. Effective Date. This Ordinance shall become effective on January
1, 2005, provided it has just been passed, executed and published in the manner
provided by law.
