Whereas, the Village of Plainfield and the State of Illinois, under date of , 195 entered into an Agreement for transfer of jurisdiction of Plainfield/Naperville Road to the Municipal Street System. Now, therefore, be it ordained by the President and Board of Trustees of the Village of Plainfield, that Plainfield/Naperville Road fram east edg® of pavement of IL Route 59 northeasterly to 2.88 miles to the south edge of pavement of 127th street be added to the Municipal Street. System. The Village Clerk is directed to forward a certified copy of this Ordinance to the State of Illinois through its District Engineer's Office at Schaumburg, Illinois. W I T N E S SET H: WHEREAS, the VILLAGE proposes to improve Lockport Street (FAP Route 349, US Route 30), by installing an ornamental highway lighting system from IL Route 126 to IL Route 59, said work to be included in a project designated as Village Section: 90-00021--QO-LT, State section: 14L, State Job No. C-91-569-93, and hereinafter referred to as the "VILLAGE'S PROJECT"; and WHEREAS, the STATE proposes to improve FAU Route 0324 (Naperville Road) from IL Route 59 northeasterly 2.88 miles to 127th Street by milling 1-1/2 inches the existing 11 ft through traffic lane in each direction and resurfacing with 1-1/2 inches of bituminous concrete, said PROJECT to be known as STATE Section: 36RS-1, and hereinafter referred to as the "STATE'S PROJECT"; and WHEREAS, in consideration of STATE financial participation in the VILLAGE PROJECT and provided the STATE PROJECT is completed, the VILLAGE is agreeable to assuming jurisdiction of Naperville Raad within the aforedescribed STATE PROJECT limits; NOW, THEREFORE, in consideration of the mutual covenants contained herein, the parties hereto agree as follows: I. VILLAGE PROJECT 1. The VILLAGE agrees to make the surveys, prepare plane and specifications, receive bids and award the contract, furnish engineering inspection during construction and cause the improvement to be built in accordance with the plans, specifications, and contract. • ~ .. . 2. The VILLAGE agrees to pay all construction and engineering costs, subject to reimbursement by the STATE as hereinafter stipulated. 3. It is mutually agreed by and between the parties hereto that the estimated construction cost of this improvement is $250,000. 4. The STATE agrees tv reimburse the VILLAGE for 100$ of all construction costs subject to a maxirqum of $50,000. Upon award of the contract and receipt of an invoice, the STATE agrees to pay the VILLAGE an amount equal to 95$ of its obligation incurred under this AGREEMENT and will pay the remainder of the obligation upon completion of the improvement based upon final costs. 5. The VILLAGE, at no expense to the STATE, shall cause private and public utilities to be adjusted ar~d/or relocated. 6. The VILLAGE agrees, prior to advertising for bids, .to secure a letter from the STATE approving the final plans and specifications as prepared. The PROJECT shall be constructed in accordance with plans approved by the STATE and the STATE's policies and procedures. 7. The VILLAGE shall maintain, for a minimum of five years after the completion of the PROJRCT, adequate books, records, and supporting documents to verify the amounts, recipients, and uses of all disbursement of funds passing in conjunction with this Agreement. All books, records, and supporting documents related to the PROJECT shall be available for review and audit by the Auditor General and other State Auditors. The VILLAGE agrees to cooperate fully with any audit conducted by the Auditor General and to provide full access to all relevant materials. Failure to maintain the books, records, and supporting documents required by this paragraph shall establish a presumption in favor of the STATE for the recovery of any funds paid by the STATE under this Agreement for which adequate books, records, and supporting documentation are not available to support their purported disbursement. -2- 8. The VILLAGE agrees to comply with all applicable Executive Orders and Federal Highway Acts pursuant to the Equal Employment opportunity and non-discrimination regulations required by the Illinois Department of Transportation. 9. Upon completion of the ornamental street lighting improvement, the VILLAGE agrees to maintain, ar cause to be maintained, the ornamental lighting system including energy, in its entirety. IT. STATE PROJECT 1. The STATE agrees to make the surveps., prepare plans and specifications, receive bids and award the contract, furnish engineering inspection during construction and cause the improvement to be built in accordance with the plans, specifications, and contract. 2. The STATE agrees to pay all construction and engineering coats estimated to be $350,000. 3. The VILLAGE agrees to provide, prior to the STATE's advertising for the work to be performed hereunder, approval of the plans and specifications as prepared, by resolution or letter. 4. The VILLAGE shall exercise its franchise right to cause private utilities to be relocated at no expense to the STATE, if made necessary by the construction of this Agreement. 5. The VILLAGE agrees to cause its utilities located on right of way acquired by the STATE ar installed within the limits of a roadway after the said roadway was taken aver for maintenance by the STATE, to be relocated and/or ad~usted at no expense to the STATE, if made necessary by the construction of this improvement. -3- - - ~ PLAN APPROVAL , WHEREAS, in order to facilitate the improvement of Naperville Rond, known as State Section: 36115-1, the Village of Plainfield hereby approves the plans and t~pecifications for the proposed construction. VAN VOOREN, VILLAGE ADMINISTRATOR ~~- MARCH 3, 1994 JOINT AGREEMENT IDOT - NAPERVILLE/PLAINFIELD ROAD BACKGROUND: At the February 21, 1994 regular meeting of the President and Board of Trustees, the Board received a copy of the prapased Joint Agreement between IDOT and the Village of Plainfield. The purpose of the agreement is as follows: 11 State of Illinois will provide up to 5250,000 for construction and engineering of the ornamental lighting plan for Lockport Street in Downtown Plainfield. 2) State of Illinois will provide all the necessary funding to resurface Naperville/Plainfield Road from II. Rt. 59 to 127th Street. 31 Village will accept a jurisdictional transfer of maintenance of Naperville/Plainfield Road. 4) Village will accept all costs associated in maintaining, including energy of the ornamental street lighting. At the request of the Board, I did discuss this agreement with both Mr. Ed Zak and Mr. John Romamo of IDOT. The purpose of this discussion was to verify the date March 9, 1994 for ratification, as well as some operational questions. As to the date, the Village has been granted an extension to March 24, 1994. Regarding my operational questions, I asked and received the following: 1) Will Village have ability to set a weight limit on Naperville/ Plainfield Road? MARCH 3, 1994 PAGE TWO 2) Will Village have ability to set speed limit on Naperville/Plainfield Road? Both IDOT representatives stated Village will have ability to control speed limit. 31 Could Village close the intersection of Naperville/Plainfield Road at Route 597 Both representatives said that as long as proper safety controls (curbs or barricades) and IDOT's permits were obtained the intersection could be closed and would be potentially supported by IDOT. Finally, I have asked Mr. Romamo, as well as Mr. Steve Rosato, Perm9t Section, if IDOT could complete the restoration of the drainage ditch adjacent to Lenwood Estates. Both indicated this could be included in the resurfacing project and see no problem with request. In conclusion, for the past three years, the Village has debated how to fund the ornamental lighting project of Lockport Street. By this agreement, we address the funding for this project. There is however, a cost to be borne by the Village, that being long term maintenance of Naperville/Plainfield Road. A decision will need to be made shortly. I am willing to assist in any further discussion you may have, but the Board must come to a conclusion on the agreement. Said plans reflect the Village's original concern as outlined in my letter of March 8, 1994 to Mr. Steve Rosato, IDOT Permits. since that letter, however, ane additional concern has risen regarding an existing permit project for the Lakelands entrance on Naperville/Plainfield Road. In our conversation regarding this matter, we suggest the following: 1) Lakeland's will complete all necessary landscaping as outlined in their permit. 2) Lakeland's will overlay the entire permit area with an 1 1 /2 inches of binder course asphalt. 3} IDOT - in the Naperville/Plainfield project will delete all grinding (surface removal) within the Lakeland's Permit limits. 4) IDOT - in the Naperville/Plainfield project will overlay the entire Lakeland's Permit limits with 1 1 /2 inch of surface asphalt. 5) IDOT - in the Naperville/Plainfield project will install all necessary pavement markings including those within the Lakeland's Permit limits. 6) All other improvements as stipulated in the plans and correspondence dated March 8, 1994 for the Naperville/Plainfield Road Project will be completed. 1400 NORTH DIVISION STREET •PLAINFIELD, ILLINOIS 60544 • (815) 436-7093 • Fax (815) 436-1950 RAY RITCHIE/IDOT NAPERVILLE/PLAINFIELD RD.
