CALL TO ORDER CITY COUNCIL TEMPLE CITY, CALIFORNIA REGULAR MEETING FEBRUARY 4, 2014 AGENDA ITEM ?.A-2 Mayor Sternquist called the City Council Regular Meeting to order at 7:30 p.rn. in the Council Chambers located at 5938 Kauffman Avenue, Temple City. 2. ROLLCALL PRESENT: ABSENT: ALSO PRESENT: 3. Halifax, provided the Invocation. 4. PLEDGE OF ALLEGIANCE Public Safety Commissioner Nimri led those present in the Pledge of Allegiance to the Flag. 5. CEREMONIAL MATTERS-PRESENTATIONS A INTRODUCTION OF CAMELLIA FESTIVAL ROYAL COURT Dawn Tarin, General Chairman, presented the Camellia Festival Royal Court to the City Council: King Austin Bateman, Queen Ella Clinton, Princesses Isabella Realzola and Emily Shivley, Princes Grant Brown and Jaden Joe, and Banner Carriers Megha Arun, Nichole Shih, Judah Douglas and Jeremy Kim. City Council Minutes February 4, 2014 Page 2 of 11 Mayor Sternquist and the City Council presented a proclamation to Ms. Tarin and Certificates of Recognition and City gift bags to each of the Royal Court members. B. PET OF THE MONTH Pat Brayer, San Gabriel Valley Humane Society President, gave a presentation on the featured pet of the month for February. Those interested in adopting a pet can call the San Gabriel Valley Humane Society at (626) 286- 1159. C. FOOTHILL TRANSIT COLLEGE PASS PROGRAM PRESENTATION Katie Gagnon, Special Projects Manager for the Foothill Transit, gave a brief presentation regarding their discount rate program for college students. 6. PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA Michael Cacciotti, South Coast Air Quality Management District Board Member, also South Pasadena Councilman, gave a presentation regarding air quality and the health risks from polluted air. 7. CONSENT CALENDAR Councilmember Chavez pulled item 7F for further discussion. F. ADOPTION OF RESOLUTION NO. 14-4969, APPROVING A STREET BANNER POLICY The City currently provides opportunity for non-profit or other similar community organizations to advertise community events or fundraisers by displaying a temporary banner over public streets. With the completion of the Rosemead Boulevard Safety Enhancement and Beautification Project, there will be new streetlights that can accommodate banners (i.e., there are currently streetlight banners along Las Tunas Drive and Temple City Boulevard) but there are no regulations for the approval, installation, or maintenance of these banners. Staff recognized that a policy was needed to regulate banners that are hung over both public streets and on streetlights, ensuring any installed banner is attractive and maintained. This new City Council Policy would combine the existing Administrative Policy for street banners with regulations for streetlight banners. Councilmember Chavez made a motion to continue this item until the second City Council meeting in April 15, 2014 to allow the City Code Review Standing Committee to further discuss and review this policy. Seconded by Councilmember Vizcarra and unanimously carried. City Council Minutes February 4, 2014 Page 3 of 11 City Clerk Kuo announced a correction to Consent Calendar Item 7D, "Adoption of Resolution No. 14-4971 ordering the Engineer's Report to establish Lighting and Maintenance District Assessment Rates for Fiscal Year (FY) 2014-15". Under the "Fiscal Impact" section of the staff report, appropriation for the ordering of the Engineer's Report was included as part of the FY 2013-14 City Budget and not the FY 2014-15 City Budget. A. APPROVAL OF MINUTES The City Council is requested to review and approve: 1) Minutes of the City Council Regular Meeting of January 21, 2014; and 2) Minutes of the City Council Special Meeting of January 29, 2014. Action: Approved. B. PARKS AND RECREATION COMMISSION ACTIONS -MEETING OF JANUARY 15,2014 The City Council is requested to review the Parks and Recreation Commission actions of their meeting of January 15, 2014. Action: Received and filed. C. RELEASE OF SECURITY FOR PARCEL MAP NO. 068199 FOR SANITARY SEWER IMPROVEMENTS AT 6306-6312 OAK AVENUE The developer (i.e., !Home L.P.) submitted a Certificate of Deposit in the amount of $84,150 to ensure that sanitary sewer improvements were completed at Parcel Map No. 068199. The Los Angeles County Department of Public Works notified the City that the street tree improvements were waived due to insufficient space. Therefore, the City can now release the Certificate of Deposit. Action: Approved the work that has been completed, accepted the sanitary sewer improvements for public use and authorized the release of the security in the amount of $84,150 for Parcel Map No. 068199. D. ADOPTION OF RESOLUTION NO. 14-4971 ORDERING THE ENGINEER'S REPORT TO ESTABLISH LIGHTING AND MAINTENANCE DISTRICT ASSESSMENT RATES FOR FISCAL YEAR (FY) 2014-15 Pursuant to the 1972 State Lighting and Landscape Act, an Engineer's Report must be prepared for each fiscal year in which assessments are levied and City Council Minutes February 4, 2014 Page 4 of 11 collected for the District The Engineer's Report identifies eligible program expenditures, establishes the District's operating budget, updates individual property assessments, and documents the City's compliance with all applicable laws. Staff has prepared the appropriate resolution ordering the Engineer's Report for City Council's review and adoption. Action: Adopted Resolution No. 14-4971 (Attachment "A") ordering the preparation of the Lighting and Maintenance Assessment District Annual Engineer's Report (Engineer's Report) for FY 2014-15. E. FIRST AMENDMENT TO THE DIGITAL BILLBOARD ADVERTISING AND AMORTIZATION AGREEMENT BETWEEN THE CITY OF TEMPLE CITY AND TEMPLE CITY GATEWAY, LLC Two years ago, the City Council approved the Digital Billboard Advertising and Amortization Agreement with an understanding that a subsequent amendment be executed to formalize conditions of the City's advertising slots, as well as to address any unforeseen circumstances. The proposed First Amendment defines three key operative provisions for ease of use and greater clarification on certain terms. It also memorializes the City's efforts to mitigate any visual interference of the billboard by the installation of street trees and fixtures inclusive of the Rosemead Boulevard Safety Enhancements and Beautification Project Action: Reviewed and approved the First Amendment to the Digital Billboard Advertising and Amortization Agreement between the City and Temple City Gateway, LLC; and authorized the Acting City Manager to execute said Amendment with Temple City Gateway, LLC. G. AUTHORIZING FACSIMILE SIGNATURES FOR THE DRAWING OF CITY WARRANTS AND CHECKS In order to ensure the City is in accordance with Government Code Section 37203, adoption of a resolution requiring joint (2) signatures on all warrants and checks is recommended. Action: Adopted Resolution No. 14-4970 approv1ng a change in the authorized signers for City warrants and checks. H. ACTING PAY FOR ADMINISTRATIVE SERVICES DIRECTOR City Council Minutes February 4, 2014 Page 5 of 11 It is common and industry standard that when an employee who is temporarily appointed to and assumes the responsibilities of another position that is higher within the organization, acting pay is granted. Further, the City's Personnel Rules addresses and allow for an employee who is in an acting appointment receive a salary increase of five percent (5%) to his/her base salary during the duration of the acting appointment. It is recommended that due to the additional responsibilities assumed by the Administrative Services Director, serving in the acting capacity of the City Manager, and to ensure consistency with the Personnel Rules for all employees with regards to this type of pay, the City Council grant five percent (5%) Acting Pay to the Administrative Services Director, effective January 14, 2014, until an Interim City Manager is hired. Action: Approved five percent (5%) Acting Pay for Administrative Services Director Hause, effective January 14, 2014, while she is in the acting capacity of the City Manager. I. PETTY CASH AND VISA CARD REPORT The City Council is requested to review, receive and file the Petty Cash and Visa Card Report. Action: Received and filed. J. ADOPTION OF RESOLUTION NO. 14-4972 APPROVAL OF PAYMENT OF BILLS The City Council is requested to adopt Resolution No. 14-4972 authorizing the payment of bills. Action: Adopted Resolution No. 14-4972. K. FISCAL YEAR (FY) 2013-14 CITY BUDGET-SECOND QUARTER BUDGET AMENDMENTS Throughout the fiscal year, staff monitors revenues and expenditures and makes recommendations for revised revenue estimates and adjustments to appropriations quarterly, if necessary, and at mid-year. Action: Authorized staff to revise various budgeted appropriations for the FY 2013-14 City Budget to ensure actual spending levels are within budgeted appropriations during the current fiscal year. APPEAL OF PARKS AND RECREATION COMMISSION DECISION TO NOT REMOVE A HOLLY OAK TREE (QUERCUS ILEX) LOCATED AT 5349 PERSIMMON AVENUE The resident at 5349 Persimmon Avenue has appealed the decision by staff, upheld by the Parks and Recreation Commission, to not remove a City owned tree located in the public right-of-way. The City Council is requested to uphold the decision of the Parks and Recreation Commission to not remove the Holly Oak tree located at 5349 Persimmon Avenue, but to undertake spot pruning to trim the tree away from the driveway. Councilmember Chavez recused himself from the discussion of item SA due to owning a property within 500 feet of the boundary of 5349 Persimmon Avenue. Parks and Recreation Director Burroughs presented a brief summary of the staff report. Rob Cruse, City Arborist, responded to City Council questions. Mayor Sternquist opened public comment. Joanne and Eddie Coco, Temple City resident, spoke in favor of removing the Oak tree on their property at 5349 Persimmon Avenue. Mayor Sternquist closed public comment. Councilmember Vizcarra made a motion to uphold the Parks and Recreation Commission's decision to not remove the tree at this time but to remove the branch over the driveway within the next two weeks and undertake corrective pruning closer to the summer but no later than July 31, 2014. Seconded by Councilmember Yu and unanimously carried by the following vote: AYES: Councilmember --Vizcarra, Yu, Blum, Sternquist NOES: Councilmember --None ABSENT: Councilmember --None ABSTAIN: Councilmember --Chavez B. FIRST READING AND INTRODUCTION OF ORDINANCE NO. 14-987 REPEALING AND ADOPTING A NEW CHAPTER OF THE TEMPLE CITY MUNICIPAL CODE (TCMC) TITLE 3 (PUBLIC SAFETY) CHAPTER 1 (FIRE CODE) ADOPTING BY REFERENCE THE 2014 LOS ANGELES COUNTY City Council Minutes February 4, 2014 Page 7 of 11 FIRE CODE (TITLE 32) AS THE CITY OF TEMPLE CITY FIRE CODE The National Model Fire Code is published periodically in response to improved safety standards and changing construction technology. The California State Fire Marshall's Office adopts and amends each of these codes every three years as part of the California Code of Regulations. The 2013 California Codes were published on July 1, 2013 and became effective on January 1, 2014, which included the California Code. Temple City is part of the Consolidated Fire Protection District for Los Angeles County. The District provides fire protection and reviews plans for new construction Citywide. As part of the District, the City of Temple City is required to operate under the Los Angeles County Fire Code, except when making amendments for local conditions. Planning Manager Starns gave a brief summary of the staff report and amended staff's recommendation to hold a second reading and adoption of this ordinance on March 4 instead of February 18's City Council meeting as Los Angeles County will not adopt its 2014 Fire Code until February 25. Mayor Sternquist opened public comment. Mayor Sternquist closed public comment. Mayor Pro Tem Blum made a motion to introduce Ordinance No. 14-987 for first reading by title only repealing existing and adopting a new Chapter to the Temple City Municipal Code (TCMC) Title 3 (Public Safety), Chapter 1 (Fire Code), thereby adopting by reference portions of the 2014 Los Angeles Fire Code (Title 32) as the City of Temple City 2014 Fire Code; and set a public hearing date for March 4, 2014, to consider adoption of Ordinance No. 14-987 establishing a new Fire Code for the City of Temple City. Seconded by Councilmember Yu and unanimously carried. 10. COMMUNICATIONS-None 11. RECESS TO SUCCESSOR AGENCY TO THE TEMPLE CITY COMMUNITY REDEVELOPMENT AGENCY MEETING At 8:39p.m., the City Council recessed to the Successor Agency Meeting. UPDATE FROM CITY MANAGER Acting City Manager/ Administrative Services Director Hause announced upcoming City events: Thursday, February 6, 5:30 to 7:30 p.m., Neighborhood Watch Meeting at Temple City High School library for neighborhoods bound by Camino Real, Temple City Boulevard, Las Tunas Drive, and Rosemead Boulevard; starting Monday, February 10 through Friday, February 21, construction crews will be resurfacing Rosemead Boulevard to enhance driving conditions and pavement longevity. Rosemead Boulevard Improvement Project Standing Committee (Councilmember Yu and Mayor Pro Tern Blum)-Formed 6/3/2011 Mayor Pro Tern Blum reported that the committee met on Friday, February 1, and discussed the grand opening of the project. Committee will meet again on Feb. 21. B. School District/City Standing Committee (Councilmember Chavez and Mayor Pro Tern Blum)-Formed 1/3/2012 Councilmemeber Chavez reported that the committee met on Tuesday, January 28. The standing committee discussed the Temple City Unified School District's Facility Bond and the possible City/District Joint Projects; School Resource Officer, possible Funding Sources (i.e., Grants); update on the Safe Routes to Schools Projects; community celebration of the completion of the Rosemead Boulevard Project. Public Safety and Services Manager Sahagun gave an update about the January 25 Neighborhood Clean Up event. B. COUNCILMEMBER VIZCARRA Commended Sing Tao Newspapers and staff on the Chinese New Year Street City Council Minutes February 4, 2014 Page 10 of 11 Festival. Requested an update from Parks and Recreation Director Burroughs regarding the Parks and Open Space Master Plan. Parks and Recreation Director Burroughs reported that she will be able to provide an update to the City Council in March. C. COUNCILMEMBER YU Commented on the Chinese New Year Street Festival and Coffee with City Council. D. MAYOR PROTEM BLUM Complimented everyone on a successful Chinese New Year Street Festival. E. MAYOR STERNQUIST Mayor Sternquist established the Facilities, Public Works, and Infrastructure Ad Hoc Committee and appointed Councilmembers Chavez and Mayor Pro Tem Blum to the committee. 16.
