A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD
DISPENSING WITH THE FORMAL BIDDING REQUIREMENTS, AWARDING A
FIVE YEAR CONTRACT TO TRIMMING LAND COMPANY, INC., IN THE
AMOUNT NOT-TO-EXCEED $200,000 ANNUALLY, FOR TREE TRIMMING
MAINTENANCE SERVICES AND AUTHORIZING THE MAYOR TO EXECUTE
THE AGREEMENT
WHEREAS, City Council has directed staff to negotiate a new tree
trimming contract with the current tree trimming contractor, Trimming Land
Company, Inc. (TLC); and

WHEREAS, TLC has submitted a proposal for grid trimming with no
increase in price for the five year duration of the contract and for other tree
maintenance services; and
WHEREAS, staff has met with TLC to review the details of their proposal
and has completed contract negotiations with TLC; and
WHEREAS, the tree trimming maintenance prices provided by TLC are
very competitive when compared with surrounding cities and beneficial to the
City; and
WHEREAS, Lynwood Municipal Code section 6.3.13.a.3 authorizes the
City Council to dispense with formal.bidding requirements when the services may
be acquired more economically and efficiently through direct negotiations.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD
DOES HEREBY FIND, PROCLAIM, ORDER AND RESOLVE AS FOLLOWS:
Section 1. That TLC;be awarded a five year contract for the trimming
and maintenance services for a not-to-exceed cost of $200,000 per year, or
$1,000,000.00 for the contract's five year duration, based on their proposal
(Attachment A) and Schedule of Compensation (Attachment B).
Section 2. That the citywide tree trimming cycle shall be on a three year
cycle.
Section 3. That the City Council by at least 4/5ths vote, hereby finds
that the acquisition of tree trimming maintenance services provided by TLC, may
be more economically and efficiently affected by dispensing with the formal
bidding requirements per Lynwood Municipal Code section 6.3.13.a.3. The
reduced pricing secured through negotiations with TLC, as described in the
recitals above, supports this determination.
Section 4. That. the Mayor is hereby authorized to execute the
agreement between the City of Lynwood and Trimming Land Company,. Inc. in a
form approved by the City Attorney.
Section 5. This Resolution shall take effect immediately: .upon its
adoption.
Section 6. The City Clerk shall certify as to the adoption.:ofP this
Resolution.
