SUBJECT: AUTHORIZE THE ACTING CITY MANAGER TO ENTER INTO AN
EMPLOYMENT AGREEMENT FOR INTERIM COMMUNITY
DEVELOPMENT DIRECTOR
RECOMMENDATION:
It is recommended that the City Council authorize the Acting City Manager enter into a
employment agreement with Donald Penman to serve the City as Interim Community
Development Director.
BACKGROUND:
1. On January 10, 2014, the Community Development Director's position became
vacant.
2. On January 17, 2014, the City p laced advertisements on various professional local
government websites soliciting for letters of interest and resumes for Interim City
Manager for the City of Temple City. Letters of interest and resumes were
accepted until January 30, 2014 .
3. On January 31, 2014, the City Council met in closed session to consider the
applicants for the position of Interi m City Manager. There was no reportabale
action.
4. On February 7 and February 8, 2014, the City Council met in closed session to
further consider applicants for the position of Interim City Manager and Interim
Community Development Director. At the conclusion of the meeting on February
8, 2014, the Mayor reported that the City Council will direct City Attorney Vail
begin negotiations for an Interim Community Development Director.
ANALYSIS:
An appointment of an Interim Community Development Director is necessary to oversee
the daily operations of the Planning, Building & Safety, Housing, Business License,
City Council

Emergency Services, Parking Administration, Animal Control, Maintenance, Public
Safety Volunteers, and Code Enforcement. Mr. Penman was identified as an excellent
candidate for this position as part of the interview process conducted for an Interim City
Manager.
CONCLUSION:
Administrative oversight of the Community Development Department is essential to ensure
operations and services to the community continue smoothly. In addition, there are critical
projects underway, including the General Plan update, LasTunas Specific Plan and
various capital projects that require additional management support.
FISCAL IMPACT:
There will not be a fiscal impact to the Fiscal Year (FY) 2013-14 City Budget with this
action. Sufficient funds have been budgeted for the Community Development staff's
compensation in the FY 2013-14 City Budget and Mr. Penman is being compensated at
$70.00 per hour which is significantlylower than what is budgeted for salary and benefits of
a permanment Community Development Director. Further, Mr. Penman's available
working hours are limited due to limitation under CaiPERS rules and it is not expected that
his entire compensation will exceed $22,400.
