CITY OF RICHMOND,INDIANA,JANUARY 2, 1997

1 The Board of Public Works and Safety of the City of Richmond, Indiana, met at 5 p.m. Thursday, January 2,
42 1997, in the Municipal Building in said City. President Robert Goodwin presided with Robin Henry, Bruce
3 Metzger and Assistant City Attorney Steve Rabe in attendance.The following business was had to-wit:
5. APPROVAL OF MINUTES

7 The minutes of the November 21, 1996 meeting were approved on a motion by Henry, second by President
8 Goodwin and carried on a unanimous voice vote. The minutes of the December 12, 1996 meeting were
9 approved on a motion by Henry,second by Metzger and carried on a unanimous voice vote.

11 CLAIMS FOR PAYMENT

13 Claims for payment submitted by the City Controller's office were read by Henry who note! they totaled
14 . $193,923.13 and moved to approve,second by Metzger and carried on a unanimous voice vote.

18 A. Captain John Farmer of the Traffic Safety Division brought before the Board a request for a
19 handicapped parking space at 308 Richmond Avenue, noting that the property had been reviewed and
20 three off-street parking spaces were found which would prevent it from falling in with the guidelines as
21 set by the ordinance. He said there is also a concrete walkway from the rear of the property where
22 those spaces are located. He added that he was unable to contact anyone at the residence. John
23 McCreary, speaking as a concerned citizen, commented that he felt Captain Farmer should make
24 contact with the resident before the Board members cast their votes. Captain Farmer responded that
25 he would try to do that. President Goodwin said the request would be tabled until next week.

27 B. Captain Farmer read a request from Davis Vickers Construction Co. for the temporary closing of
28 Straightline Pike to install an eight-inch sanitary sewer line under the pike on Friday, January 3, 1997.
29 He said they did not anticipate taking a full day,but requested one just in case they ran into difficulties.
30 Metzger moved to approve the request on the condition that they start no earlier than 8 a.m.,second by
31 Henry and the motion was carried on a unanimous voice vote.

35 A.City Engineer Bob Wiwi stated that he brought before the Board an agreement between the City and
36 ' Cole &Associates for the continuation of the downtown renovation project. He said this is phase three
37 which outlines various items and scope of work this company is going to provide. He said the company
38 is composed of a team of qualified landscape architects, planners, engineers, surveyors and
39- environmental science and construction inspection.techniciation to complete the various tasks outlines
40 in the agreement which includes the following: (1) the reconstruction of Main Street from 5th to 10th
41 Street; (2)the construction of a street scape from 10th to 11th on Main Street; (3) reconstruction of two
42 existing and one new parking lot; (4) the reconstruction of'a total of three vehicle entries and one
43 vehicle exit to the two existing parking lots; and (5)•repair and alterations to the City'parking garage.
44 Wiwi said the total fee for the identified projects is$194,500.. .

46 Wiwi said David Hunter, department head at Cole & Associates, who will bei the project manager on
47 this project if the. Board agrees with signing this agreement. Wiwi said the City Attorney has also
48 reviewed the agreement and is available in response tawny legal questions. Metzger asked Wiwi if the
49 Board approves the agreement, will Cole & Associates prepare the actual contstruction drawings,
50 followed by the bidding for the actual construction taking place,then will come back before the Board of
51 Works. He noted that phase'4 will be the actual construction of the project and Cole & Associates will
52 handle all phases and will have a resident on site to supervise and monitor the construction. This
53 agreement,Wiwi said, is for the phase 3 aspect of the project.

55 John McCreary and Jim Kennedy, both identifying themselves as concerned citizens of Richmond,
56 appeared before the Board to express their dissatisfaction with the downtown renovation and bringing
57 the two-way traffic back.They both agreed that this Board should look over this agreement thoroughly
58 before signing it today and they also felt more time should be taken to check over all the documents
59 submitted by Cole&Associates.

61 President Goodwin said at this point the Board is simply trying to get information and not get into a
62 discussion abaout two-way traffic in the downtown because that decision has already been made. He
63 added that what the Board is dealing with here is the design piece and it is inappropriate to engage in
64 that kind of conversation. McCreary asked if there had been a market analysis or market feasibility
65 study done and President Goodwin said that had been done by Michael Schuster & Associates.
Kennedy said that was not so and President Goodwin said that may be a matter of definition.

1 Henry said as a result of that investigation by Michael Schuster & Associates, the Main Street
2 organization has formed a new business development committee as well as an existing business
3 committee to spur economic activity into the area and those committees are aggressively working in the
4 areas to attract business, not just retail but also service organization to that area.

6 Hunter responded to the comments made by McCreary, assuring him that his company will meet all the
7 necessary requirements.

9 City Attorney Bob Bever assured McCreary and Kennedy that he had reviewed three different drafts of
10 the agreement with Cole &Associates and said he is comfortable and happy with it. He added that he
11 believes no further delay to review it is necessary, noting that the Mayor is also happy with the
12 agreement, noting that the City will be taking an active part in this. President Goodwin, as well as Henry
13 and Metzger, agreed they were also comfortable with Cole & Associates. Henry moved to approve the
14 contract with Cole &Associates, second by Metzger and the motion was carried on a unanimous voice
15 vote.

17 B. City Engineer Bob Wiwi brought before the board Change Order No. 10 for South 37th Street, noting
18 it is between the Indiana Department of Transportation and the City. He said that although considerable
19 progress had been made, the work was not completed because of the weather. He said this change
20 order is for$9,064 to add a concrete curb using 176 square yards of concrete in the area near Kroger
21 and Walmart. He said the center median was proposed to help direct traffic in the proper manner and
22 the area had been reviewed by the Traffic Safety Dividion and no accidents had been reported, which
23 shows the median is successful to this date.

25 Wiwi said what he is asking the Board to approve is part of the original design plan. Metzger asked if
26 the two entrances to Walmart coming out onto 37th Street will remain and Wiwi said they will, adding
27 that early on in the discussion with Kroger and Walmart they tried to come to an agreement with one
28 location where both shopping centers would enter onto South 37th Street. However, he said, neither
29 party would agree to moving their driveways to line up with each other so the two entrances was the
30 result of a recommendation made by Walmart as to how they wanted their traffic pattern and it is not a
31 design of the City. Wiwi reminded the Board that this`project is only 20 percent of local money, with the
32 remaining 80 percent paid by INDOT. Metzger moved to approve the request for the change order,
33 second by Henry and the motion was carried on a unanimous voice vote.
