1 The Board of Public Works and Safety of the City of Richmond, Indiana, met at 5 p.m. Thursday, October 31,
11/ 2 1996, in the Municipal Building in said City. President Robert Goodwin presided with Robin Henry, Bruce
3 Metzger and Assistant City Attorney Steve Rabe in attendance. The following business was had to-wit:

5 APPROVAL OF MINUTES

7 Metzger moved to approve the minutes of October 17 and October 24, 1996, second by Henry and the motion
8 was carried on a unanimous voice vote.

10 CLAIMS FOR PAYMENT

12 Claims from the Controller's office were read by Henry who noted that they totaled $50,252.48 and moved to
13 approve,second by Metzger and the motion was carried on a unanimous voice vote.

17 A. Jo Cornelison read a letter written by Thom Soper, a local radio talk show host, requesting
18 permission.for Christian people to assemble and pray for both current and future leaders of our country
19 at 8th and Promenade at the Amphitheater from 6 to 7 p.m. Monday, November 4. Hearing no
20 comments against the request, Metzger moved to approve, second by Henry and the motion was
21 carried on a unanimous voice vote.

23 B. Assistant City Attorney Steve Rabe explained that the City has an ordinance that authorizes the
24 impoundment of an animal for alleged neglect and provides that the owner is entitled to a hearing to
25 contest it and get the animal back should the Board of Works find that the animal should be returned.
26 This agenda item, he said, deals with setting a hearing date for the alleged neglect of a dog removed
27 from the property at 406 South West 3rd Street. Rabe said there are no specified procedures other
28 than the Board will conduct the hearing and is to give five days notice to the owner prior to that hearing.
29 He said the owner and Counsel may come and present their case as well as the officers involved,the
30 veterinarian and representatives of the animal shelter. In other words, he said, both sides will have the
31 opportunity to present the facts to this Board and should the owner disagree with the Board's decision
32 they would have the right to appeal it through the local court. President Goodwin suggested the hearing
33 date be at this Board's next meeting Thursday, November 7. Henry so moved, second by Metzger and
34 the motion was carried on a unanimous voice vote. Rabe advised the Board also that the notice to the
35 owner needs to be in writing five days in advance.

37 C. Captain John Farmer of the Traffic Safety Division said the curb cut request at 1601 Hunter's Pointe
38 made by Joshua Gunter was reviewed by engineering, police and planning and there were no
39 objections. Metzger moved to approve, second by Henry and the motion was carried on a unanimous
40 voice vote.

44 A.Architect Ron Maze presented Change Order No. 1 for Townsend Community Center,stating that he
45 had given Board members copies of the change order totaling $21,341. He explained the areas
46 involved include the air conditioning, lighting, carpet, ceramic tile and floor joists. He said the entire
47 amount of the change order will come from Townsend Center and noted that will be the case in all
48 change orders on this project from this point on. Metzger moved to approve the request, second by
49 Henry and the motion was carried on a unanimous voice vote.

53 There being no further business, on a motion duly made seconded and passed and carried on a unanimous
54 voice vote,the meeting was adjourned.
