INDIANA, MAY 23. 1996 • 1 The Board of Public Works and Safety of the City of Richmond, Indiana, met at 5 p.m.Thursday, May 23, 1996, 2 in the Municipal Building in said City. President Robert Goodwin presided with Robin Henry, Bruce Metzger and 3 City Attorney Bob Bever in attendance.The following business was had to-wit: 4 5 APPROVAL OF MINUTES OF MAY 16.1996 6 7 Henry moved to approve the minutes of May 16, 1996, second by Metzger and the motion was carried on a 8 unanimous voice vote. 9 10 CLAIMS FOR PAYMENT 11 12 Claims for payment submitted by the City Controller's office totaled $433,398.39. Henry moved to approve the 13 claims,second by Metzger and the motion was carried on a unanimous voice vote. 14 15 REQUESTS 16 17 A. Fire Chief Mike Allen informed the Board of the retirement of Robert E.Guthrie, noting that he joined 18 the Fire Department February 1, 1972 and the effective date for his retirement was May 19, 1996. 19 Metzger moved to approve the retirement of Guthrie,second by Henry and the motion was carried on a 20 unanimous voice vote. 21 22 2. Chief Allen stated that the Smoke House was introduced at the Wayne County Fairgrounds last 23 weekend at the county-wide D.A.R.E. day festival picnic. The Chief explained that it is a youth mobile 24 training facility and invited Board members to tour the Smoke House at their convenience. He noted 25 that he would be happy to accompany any of them to Station 4 for that purpose. Metzger asked if it is 26 open to other small groups and Chief Allen answered that it is. Bever noted that other groups will be 27 allowed to take it out,also. 28 29 3. Captain Farmer brought before the Board a request by the Richmond Roosters to change the curb 30 area that runs along North West 13th.Street to handicapped parking. He noted that the area is currently 31 restricted to bus parking only. Captain Farmer said he considered the request a reasonable one, 32 adding that those using the handicapped spaces will now be able to enter the stadium at ground level 33 instead of traveling up hill from the parking lot. Metzger moved to approve the request, second by 34 Henry and the motion was carried on a unanimous voice vote. 35 - 36 4. Captain Farmer also noted a request from Christ United Church for a block party from 11 a.m. to 1 37 p.m.June 8 in the 2500 block of Locust Lane. He said Lt. Kris Wolski had spoken to the residents in the 38 area and they had no objections. He also noted that the Traffic Safety Division had checked over the 39 area and saw no traffic problems or any major inconveniences. Metzger moved to approve the request, 40 second by Henry and the motion was carried on a unanimous voice vote. 41 42 5.Another request received by Captain Farmer was from Roberta Hayre asking to close South P Street 43 from Oakland Avenue west to the alley from 5 to 9 p.m.July 20, 1996 for a wedding reception.Captain 44 Farmer said he had checked both of the houses in the area and they belong to members of the Hayre 45 family who, of course, had no objections to closing the street. However, Captain Farmer said, since 46 they are going to have a live band he suggested that Hayre check with residents to see if there is a 47 need for a noise abatement. He said Hayre produced a list of 29 residents who had no objections, 48 adding that most of them will be attending the wedding. Metzger moved to approve the request to close 49 the street as well as the noise permit, second by Henry and the motion was carried on a unanimous 50 voice vote. 51 52 CONTRACTS . 53 54 A. City Attorney Bob Bever stated that he had reviewed the contract between the Institute for Public 55 Safety Personnel Inc. and the Richmond Police Department, noting that the I.P.S.P. assists the 56 department in the testing of individuals for professional service for under $25,000. He questioned 57 setting a set amount of $11,970 for the various work they have agreed to do. He pointed out the 58 paragraph which read that at the end of the year upon the termination to review the compensation paid 59 to see if the Richmond Police Department was entitled to any reimbursement or if I.P.S.P. is entitled to 60 additional compensation. He added that there are no perimeters to go by and there needs to be some 61 time frame to be put in with the amount, otherwise R.P.D. is at their mercy. Major Greg Pipes said the 62 fees are based upon the number of applicants and the study materials they have to buy. He added that 63 representatives of I.P.S.P. are coming in tomorrow to meet with the committee to help select the study 64 materials. He said the fee is determined by the number of applicants, adding that the positions to be 65 tested for are sergeant, lieutenant, captain and investigator: President Goodwin commented that I.P.S.P. is also utilized by the Indiana State Police. Board of Works Minutes Cont'd May 23, 1996 • Page 2 1 Major Pipes said they used this group in 1993 for this same process,adding that they also help conduct 2 the police applicant testing and are now in the process of developing an agility test which will be used in 3 the hiring process. The group also does the evaluations, Major Pipes said. Bever said the Board could 4 approve this contract subject to a clarification to when the additional funds would be necessary or a 5. rebate of funds would be. necessary. Henry moved to approve the contract contingent upon Bever 6 working out the arrangements working with the I.P.S.P.,second by Metzger and the motion was carried 7 on a unanimous voice vote. 8 9 B. President Goodwin said the traffic signal on Chester Boulevard would be discussed at the next 10 meeting because Bever had not had sufficient time to look at the information. 11 12 OTHER MATTERS 13 14 Bever addressed the issue of the ICI rate increase,commenting that he had talked with the chief attorney Jane 15 •Siegal at IACT and she indicated that with the new 1996 Cable Act it has become almost cost prohibitive to 16 make any change on this rate increase, noting that all cities are going through a preliminary review with national 17 specialists. He said it was her recommendation to use the legal group which the City had used during the 18 franchise agreement. Thus, Bever said, he contacted Brian Grogan with the firm of Moss & Barnett in 19 Minneapolis and was told to send everything the City has received from TCI. However, Bever said Grogan told 20 him that it was almost impossible before June 1 to review and quote a price at that time,but Grogan assured him 21 that it would be possible to continue the review after June 1. 22 23 Bever said when going through the Telecommunications Council file he found that in 1994 the same situation 24 occurred, where this Board filed a resolution that allowed additional time to review the rate increase while still 25 putting TCI on notice to hold any of that increase money in the form of a trust so that if it was challenged, the 26 rate increase would be rebated back to the customers. Bever said he asked Grogan for four things: The exact 27 perimeters of what the city franchisee holder can do regarding the rate increase, their best chances of success 28 and possible outcomes of such a challenge, their projected cost reviewing this filing if it is deemed advisable, 29 and for their anticipated cost on a complete challenge if that is termed to be in the best interest of the City. Bever 30 said the information had been sent to the law firm and Grogan said he hoped to get back with him by tomorrow 31 or the first of next week, noting that would be time to put TCI on notice prior to June 1 and continue after that. 32 . 33 Since Mary Ellen Donat, president of the Telecommunications Council, was in the audience, Bever asked her 34 opinion on the status of the meeting scheduled for this evening. Donat said she had talked with members of the 35 Telecommunications Council this afternoon and they were comfortable with waiting for the information before 36 meeting.
