Ia AN ORDINANCE OF THE CITY OF IONA, IDAHO, REPEALING AND RE-ENACTING SECTIONS 7-6-1 AND 7-6- 2 OF THE CITY CODE OF IONA, IDAHO; PROVIDING FOR THE ADOPTION OF THE INTERNATIONAL RESIDENTIAL CODE, 2003 EDITION, FOR ONE- AND TWO- FAMILY DWELLINGS; PRESERVING PRIOR ORDINANCE; PROVIDING FOR SEVERABILITY; AND ESTABLISHING EFFECTIVE DATE. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF IONA, IDAHO THAT: Section 1. Repeal and Re-enactment of Sections 7-6-1 and 7-6-2, City Code. Sections 7-6-1 and 7-6-2 of the City Code of Iona are hereby repealed and re-enacted as follows: 7-6-1 INTERNATIONAL RESIDENTIAL CODE ADOPTED: (A) International Residential Code Adopted: The International Residential Code for One- and Two- Family Dwellings, 2003 Edition, published by the International Code Council, Inc. is hereby adopted as an official code of the City, except the portions deleted, modified and amended by the provisions of this Chapter. (B) Code on File: One (1) copy of the International Residential Code for One -and Two - Family Dwellings, 2003 Edition, shall be retained by the City Clerk for use and examination by the public. 7-6-2: AMENDMENTS TO THE INTERNATIONAL RESIDENTIAL CODE: (A) Section R105.2, paragraph (1) of the "Building" section, of the International Residential Code, 2003 Edition, is hereby amended as follows: Building: 1. One-story detached accessory structures, provided the floor area does not exceed 120 square feet. (B) Section R112.2 of the International Residential Code, 2003 Edition, shall be amended to read as follows: R112.2 Limitations on authority. An application for appeal shall be based on a claim that the true intent of this code or the rules legally adopted thereunder have been incorrectly interpreted. The board shall have no authority to waive requirements of this code. (C) Table 301.2(1) of the International Residential Code, 2003 Edition, shall be amended to read as follows: TABLE R301.2(1) CLIMATIC AND GEOGRAPHIC DESIGN CRITERIA GROUND SNOW LOAD WIND SEISMIC DESIGN CATEGORY SUBJECT TO DAMAGE FROM WINTER DESIGN TEMP FLOOD HAZARDS SPEED (mph) Weathering Frost line depth Termite Decay 47 90 D1 SEVERE 30 INCH SLIGHT TO MODERATE NONE -6° 1955, Oct. 15, 1986 (D) Section R315.1 of the International Residential Code, 2003 Edition, is hereby amended to read as follows: R315.1 Handrails. Handrails having minimum and maximum heights of 34 inches and 38 inches (864 mm and 965 mm), respectively, measured vertically form the nosing of the treads, shall be provided on at least one side of stairways. All required handrails shall be continuous the full length of the stairs with four or more risers from a point directly above the top riser of a flight to a point directly above the lowest riser of the flight. Ends shall be returned or shall terminate in newel posts or safe terminals. Handrails adjacent to a wall shall have a space of not less than 1.5 inches (38mm) between the wall and the handrail. Exceptions: 1. Handrails shall be permitted to be interrupted by a newel post at a turn. 2. The use of a volute, turnout or starting easing shall be allowed over the lowest tread. (E) The Exception to Section R405.1 of the International Residential Code, 2003 Edition, is hereby amended to read as follows: Exception: A drainage system is not required when the foundation is installed on well -drained ground or sand -gravel mixture soils according to the Unified Soil Classification System, Group I and Group II Soils, as detailed in Table R405.1. (F) A new section, Section N1105 of the International Residential Code for One- and Two- Family Dwellings, 2003 Edition, shall be added to read as follows: N1105 Ventilation. N1105.1 Mechanical Ventilation: A mechanical ventilation system shall be installed in all homes to provide the minimum ventilation rates specified in Table 303.1 a. These specifications establish minimum criteria for designing and installing ventilation systems. 'Integrated spot and whole house ventilation may be supplied by one or more spot ventilation fans or may be provided by a ducted whole house system. 'Recirculating range hoods may be used if the required flow rates are provided through separate mechanical ventilation to the outside. 4Shall be approved for continuous operation. N1105.2 Whole House Ventilation Air Delivery: Supply air shall be delivered to each bedroom and the main living area by through -the -wall or window inlets, separate duct systems, the heating/air conditioning duct system, via undercut doors (if air is exhausted from that room), or similar means. Ventilation air moved through the heating/air conditioning duct system shall meet the following criteria: (1) the duct system must comply with Section 503.8.2; (2) the fresh air supply must be equipped with a motorized damper that automatically opens when the whole house exhaust fan turns on and closes when it turns off; (3) the furnace blower shall not be linked to the whole house fan operation; and (4) the fresh air supply must be controlled with a fixed damper or other means to limit the flow to the amount exhausted by the whole house fan. N1105.3 Exhausted Air: All exhausted air shall be ducted to the building exterior with a hard connection to a termination fitting. N1105.4 Whole House Fan Noise: Whole house fans mounted at the pick- up grill shall have a sone rating of 1.5 or less for intermittent operation and 1.0 or less for continuous operation. Remotely mounted fans are exempt from the sone rating requirement. N1105.5 Whole House Ventilation Control: Intermittently operated whole house systems shall have both automatic and manual controls to start and stop the system. Automatic controls shall include continuously operated timers, in a readily accessible location, capable of 30 minute increments daily, or as approved. Continuously operated systems shall be directly wired to a dedicated circuit in the electrical panel. (G) A new section, Section N1106 of the International Residential Code for One- and Two- Family Dwellings, 2003 Edition, shall be added to read as follows: N1106 Solid Fuel Burning Stoves and Fireplaces. Solid fuel burning stoves and appliances located within conditioned space shall meet the following requirements: The appliance shall be fitted with tight fitting, closeable, metal or glass doors covering the entire opening of the firebox. Site -built appliances shall have a combustion air intake from outside the conditioned space directly into the firebox of at least six (6) square inches in area, and equipped with a readily accessible, operable and tight fitting damper. Factory -built appliances shall have combustion air inlets as specified by the manufacturer. (H) Chapters 12-42 of the International Residential Code for One- and Two- Family Dwellings, 2003 Edition, are hereby deleted. Section 2. Preservation of Prior Ordinance. All portions of the City Code repealed by this Ordinance shall be preserved to permit the arrest, prosecution and punishment of any person who violates such repealed section prior to the effective date hereof. Section 3. Severability. The provisions of the Ordinance are severable. In the event that any provisions shall be determined to be void or unenforceable for any reason, such determination shall not effect the enforceability of the remaining provisions. Section 4. Effective Date This Ordinance shall be effective on January 1, 2005, provided it has first been passed, executed and published in the manner provided by law.
