BACKGROUND: 1. On December 3, 2013, the City Council adopted Ordinance No. 13-985 which amended Title 7 of the Temple City Municipal Code to adopt the Temple City 2014 Building and Safety Code. 2. On January 6, 2014, the City's codifier (i.e., Sterling Codifier) contacted the City Clerk with questions regarding some references within Ordinance No. 13-985. 3. On February 18, 2014 the City Council introduced Ordinance No. 14-990 and scheduled the public hearing for March 4, 2014 (Attachment "B"). ANALYSIS: The City Council reviewed this item on February 18, 2014 and introduced the proposed ordinance. There were no comments by the City Council or the members of the public, and no changes to the ordinance were made. Therefore, City Council is requested to adopt Ordinance No. 14-990 correcting reference errors in Ordinance 13-985. City Council March 4, 2014 Page 2 of 3 CONCLUSION: The City Council is requested that Ordinance No. 14-990 be approved to correct the incorrect references in the Building Code. It will also enable the Codifier to properly incorporate the newly adopted amendments into the Municipal Code document published online. FISCAL IMPACT: There are no fiscal impacts created by adoption and implementation of this Ordinance. ATTACHMENTS: A. Ordinance No. 14-990 B. February 18, 2014 City Council Staff Report CITY OF TEMPLE CITY ORDINANCE NO. 14-990 ATTACHMENT A AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF TEMPLE CITY CORRECTING REFERENCE ERRORS IN ORDINANCE NO. 13-985 REGARDING ADOPTION OF THE TEMPLE CITY 2014 BUILDING AND SAFETY CODE WHEREAS, on December 3, 2013, the City Council adopted Ordinance No. 13-985 amending Title 7 of the Temple City Municipal Code to adopt the Temple City 2014 Building and Safety Code; and WHEREAS, the City of Temple City Municipal Code codifier discovered reference errors and notified the City Clerk's Office on January 6, 2014. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF TEMPLE CITY HEREBY ORDAINS AS FOLLOWS: SECTION 1: Section 7102 Definitions (Page 1-2 of Exhibit A of Ordinance No 13-985) the definition of Fire Code shall be amended to read as follows: "FIRE CODE, LOS ANGELES COUNTY FIRE CODE, or INTERNATIONAL FIRE CODE shall mean the Title 3, Chapter 1 of the Temple City Municipal Code". SECTION 2: Section 116.3 (Page 1-19 of Exhibit A of Ordinance No 13-985) the reference to Section 1 06.1 in that section shall be replaced by a reference to Section 107.1. SECTION 3: In Section 80-12 (Page 3-5 of Exhibit C of Ordinance No. 13-985) the reference to Section 81-2(a) in that section shall be replaced by a reference to Section 81-2. SECTION 4: In Section 80-13 (Page 3-7 of Exhibit C of Ordinance No. 13-985) the reference to Section 81-12(c) in that section shall be replaced by a reference to Section 81-12. SECTION 5: In Section 81-4 (Page 3-16 of Exhibit C of Ordinance No. 13-985) the reference to Section 81-2(i) in that section shall be replaced by a reference to Section 81-2. SECTION 6: The Title of for the Appeals Board Section (Page 3-9 of Exhibit C of Ordinance No. 13-985) shall be amended from "Section 7304 APPEALS BOARDS" to Section 80- 15 APPEALS BOARDS". SECTION 7: Section 3203 of the Temple City Municipal Code is hereby deleted. SECTION 8: This Ordinance shall be effective on the 31 '1 day after adoption. SECTION 9: The City Clerk, or her duly appointed deputy, shall attest to the adoption of this Ordinance, and shall cause this Ordinance to be posted in the manner required by law. COMMUNITY DEVELOPMENT DEPARTMENT MEMORANDUM DATE: February 18, 2014 TO: The Honorable City Council r-, FROM: Tracey Hause, Acting City Manager I Administrati~ Services Directdl{J, By: Geoffrey Starns, AICP, Planning Manager (1 SUBJECT: FIRST READING AND INTRODUCTION OF ORDINANCE NO. 14-990 CORRECTING ORDINANCE REFERENCE ERRORS IN ORDINANCE NO. 13-985 PERTAINING TO 2014 BUILDING CODES RECOMMENDATION: The City Council is requested to: a) Introduce Ordinance No. 14-990, for first reading by title only, correcting reference errors in Ordinance 13-985; b) Waive further reading of Ordinance No. 14-990; and c) Schedule the second reading of Ordinance No. 14-990 for March 4, 2014. BACKGROUND: 1. On December 3, 2013, the City Council adopted Ordinance No. 13-985 which amended Title 7 of the Temple City Municipal Code to adopt the Temple City 2014 Building and Safety Code. 2. On January 6, 2014, the City's codifier (i.e., Sterling Codifier) contacted the City Clerk with questions regarding some references within Ordinance No. 13-985. ANALYSIS: The City Attorney's office determined that some of the questions raised were simple typographical errors that could be fixed by the codifier, while other errors needed to be resolved by ordinance. The City Attorney advised staff to bring a clean-up ordinance fixing the references. City Council February 18, 2014 Page 2 of2 The City Council is requested to adopt Ordinance No. 14-990 to correct the reference errors in Ordinances No. 13-985. No other changes are proposed through the adoption of this Ordinance. CONCLUSION: Adopting Ordinance No. 14-990 will correct the incorrect references in the Building Code. It will also enable the Codifier to properly incorporate the newly adopted amendments into the Municipal Code document published online. FISCAL IMPACT: There is no fiscal impact for this ordinance; it merely corrects reference errors in the previously adopted Ordinance No. 14-990. ATTACHMENT: A. Ordinance No. 14-990
