There will be a maximum 20-minute period for comments on any subject with a 3-minute time limit on each speaker, unless waived by Council. APPROVAL OF MINUTES The City Council is requested to review and approve: 1) Minutes of the City Council Special Meeting of February 18, 2014; 2) Minutes of the City Council Regular Meeting of February 18, 2014; 3) Minutes of the City Council Special Meeting of February 26, 2014; and 4) Minutes of the City Council Special Meeting of February 26, 2014. Recommendation: Approve. B. PARKS AND RECREATION COMMISSION ACTIONS – MEETING OF February 19, 2014 The City Council is requested to review the Parks and Recreation Commission actions of their meeting of February 19, 2014. Recommendation: Receive and file. C. TRANSPORTATION AND PUBLIC SAFETY COMMISSION ACTIONS – MEETING OF FEBRUARY 12, 2014 The City Council is requested to review the Transportation and Public Safety Commission actions of their meeting of February 12, 2014. Recommendation: Receive and file. D. CONSIDERATION OF A REQUEST FROM THE AMERICAN CANCER SOCIETY FOR TEMPLE CITY TO CO-SPONSOR THE RELAY FOR LIFE OF TEMPLE CITY AT TEMPLE CITY HIGH SCHOOL ON JULY 26-27, 2014 AND PROCLAIM JUNE 28TH PAINT THE TOWN PURPLE DAY The American Cancer Society is a nationwide, community-based, voluntary health organization dedicated to eliminating cancer as a major health problem through research, education, advocacy, and service. Relay for Life is an overnight event designed to celebrate survivorship and raise money for research and programs for the American Cancer Society. City Council Agenda March 4, 2014 Page 3 of 8 The American Cancer Society is once again requesting the City to co-sponsor the Relay for Life of Temple City. Recommendation: 1) Approve the request from the American Cancer Society to co-sponsor the Relay for Life of Temple City at Temple City High School on July 26-27, 2014; 2) Proclaim June 28, 2014, Paint the Town Purple Day; and 3) Waive all fees and deposits for the use of Temple City Park Gazebo (i.e., Pavilion), Community Room, and installment of a street banner on Las Tunas Drive. E. SECOND AMENDMENT TO THE CONSULTANT SERVICES AGREEMENT BETWEEN THE CITY OF TEMPLE CITY AND ADVANCED AVANT-GARDE CORPORATION FOR THE ROSEMEAD BOULEVARD SAFETY ENHANCEMENT & BEAUTIFICATION PROJECT The Rosemead Boulevard Safety Enhancement and Beautification Project currently has $4.3 million of federal funds allocated to it. The federal funds are required to be managed in accordance with the Caltrans Local Assistance Procedures Manual and on-going compliance with the Davis Bacon Act, a federal law which requires laborers and mechanics working on federally- funded or assisted public works projects to be paid the local prevailing wage. This includes a review of weekly submitted certified payrolls for the prime contractor and all sub-contractors to ensure compliance. In addition, field interviews must be conducted to confirm worker classification trades. The City has retained Avant Garde for the completion of these important tasks. On December 23, 2013, Avant Garde reported that they have exceeded the 350 hours allocated for labor compliance services and have exhausted most of their budget of $30,724, as included in their original contract. This budget was based on a rough estimate of the project duration and anticipated construction trades. Avant Garde has stated that they had not originally anticipated that Caltrans would require them to review all of the 11 sub-contractors payroll certificates. In order to ensure that there are enough funds available to cover the compliance work required for the project, Avant Garde is requesting an additional 190 work hours until completion of the project. Recommendation: Approve a Second Amendment to the Consultant Services Agreement Between the City of Temple City and Advanced Avant-Garde Corporation (Avant Garde) (Attachment “A”) in the amount of $14,950 to provide labor City Council Agenda March 4, 2014 Page 4 of 8 compliance services for the Rosemead Boulevard Safety Enhancement and Beautification Project. F. PETTY CASH REPORT The City Council is requested to review, receive and file the Petty Cash and Visa Card Report. Recommendation: Receive and file. G. ADOPTION OF RESOLUTION NO. 14-4977 APPROVAL OF PAYMENT OF BILLS The City Council is requested to adopt Resolution No. 14-4977 authorizing the payment of bills. Recommendation: Adopt Resolution No. 14-4977. 8. UNFINISHED BUSINESS A. SECOND READING AND ADOPTION OF ORDINANCE NO. 14-990 CORRECTING ORDINANCE REFERENCE ERRORS IN ORDINANCE NO. 13-985 PERTAINING TO 2014 BUILDING CODES The City Council reviewed this item on February 18, 2014 and introduced the proposed ordinance. There were no comments by the City Council or the members of the public, and no changes to the ordinance were made. Therefore, City Council is requested to adopt Ordinance No. 14-990 correcting reference errors in Ordinance 13-985. Presentation: Planning Manager Recommendation: Waive further reading and adopt Ordinance No. 14-990 correcting reference errors in Ordinance 13-985. B. SECOND READING AND ADOPTION OF ORDINANCE NO. 14-987 REPEALING AND ADOPTING A NEW CHAPTER OF THE TEMPLE CITY MUNICIPAL CODE (TCMC) TITLE 3 (PUBLIC SAFETY) CHAPTER 1 (FIRE CODE) ADOPTING BY REFERENCE THE 2014 LOS ANGELES COUNTY FIRE CODE (TITLE 32) AS THE CITY OF TEMPLE CITY FIRE CODE The City Council is requested to continue this item to the City Council meeting of April 1, 2014. The County of Los Angeles Board of Supervisors was scheduled to adopt the County Fire Code on February 25, 2014. The City City Council Agenda March 4, 2014 Page 5 of 8 was informed by the County on February 24, 2014 that the item will not go before the Board of Supervisor until March 25, 2014. The City cannot adopt the Los Angeles County Fire Code (code) by reference until the code is adopted by the County. Presenter: Planning Manager Recommendation: Continue the public hearing and adoption of Ordinance No. 14-987 to the City Council meeting of April 1, 2014. C. APPROVAL OF EMPLOYMENT AGREEMENT TERMS FOR POSITION OF INTERIM CITY MANAGER An appointment for an Interim City Manager is necessary to fill a critical position with the City. The City Manager is the chief executive officer of the City and serves as department head for the Management Services Department. He/she is responsible for the efficient direction of all departments and the administrative affairs of the City, including direct support to the City Council. Since the City has limited staff and has also recently lost its Community Development Director, the existing management staff are required to service their existing departments to avoid reduction of City services. Presentation: City Attorney Recommendation: 1) Approve the terms of an employment agreement with Donald E. Penman to serve as Interim City Manager; 2) Authorize the Mayor and City Attorney to execute an employment agreement with Mr. Penman. 9. NEW BUSINESS – None 10. COMMUNICATIONS – None 11.
