Joint P&Z and Council -Mayor Agan Called to Order -Time 6:03 p.m.
1. Conduct Joint Public Hearing for a Specific Use Permit (SUP) for Lot 1 B,
Block 64 of Richland Hills Addition to allow for a licensed child care facility.
The property is zoned Professional Office (P), and is located at 3921 Oxley
Drive.
Daniel Harrison, representative with Freese and Nichols, presented a Specific
Use Permit (SUP) for Lot 1 B, Block 64 of Richland Hills Addition to allow for a
licensed child care facility. The property is zoned Professional Office (P), and is
located at 3921 Oxley Drive. The use requires a parking ratio of 1 space per 8
pupils plus 1 space per employee. The applicant has not provided a number of
pupils or employees at this time; however the only parking appears to be in the
driveway. An alternative to the parking issue is for the applicant to use off-site
parking or have a shared parking agreement with the neighboring properties.
Freese and Nichols recommend denial at this time due to the site not meeting the
parking requirements. Daniel noted that for SUP's, Planning & Zoning and City
Council are authorized to impose conditions beyond what is required by the
zoning district. If approved, the recommendation would be to address the parking
issue and additional conditions for masonry fencing and landscaping be imposed.
Mayor Bill Agan opened the public hearing: Time 6:10 p.m.
Amelia Lynch, 3921 Oxley Dr. Richland Hills, addressed P&Z and Council
regarding the fence and parking. The fence will be completed on Friday, the
agreement with the church will be done this week and an agreement with the
property owner to the north will be ready tomorrow. Amelia stated that she is
licensed for 47 children, but will only have 32.
Keith Edmonds, one of the property owners, said the property was previously
used as a daycare center by the church and that the driveway is now larger. He
has a verbal from the church, since they are not there during the day, that they
are welcome to use the churches parking lot.
Mayor Bill Agan closed the public hearing: Time 6:20 p.m.
Daniel Harrison, representative with Freese and Nichols, reviewed the case for a
second time for clarification.
2. Planning and Zoning consideration of recommendation to the City Council
for a request for a Specific Use Permit (SUP) for Lot 1 B, Block 64 of
Richland Hills Addition to allow for a licensed child care facility.
Motion: Motion was made by Member Skier, and seconded by Chairman Campbell
to approve, if the parking agreement, masonry screening and the
landscape zoning is according to the ordinance and approved by staff.
Motion carried by a vote of 2-1. Member Baker against. Members
LaPointe and Knowlton absent.
3. City Council consideration of a request for a Specific Use Permit (SUP) for
Lot 1B, Block 64 of Richland Hills Addition to allow for a licensed child care
facility.
Keith Edmonds stated, if the parking agreement is not agreed upon at renewal, a
circle drive or parking in the back could be added.
Motion: Motion was made by Councilmember Lopez, to deny. The motion died for
a lack of a second to the motion.
Motion: Motion was made by Councilmember Goveas, and seconded by
Councilmember Desoto to approve the SUP contingent upon the fact that
a Certificate of Occupancy will not be issued until staff has seen a parking
agreement that meets the parking requirements, the masonry wall is
constructed, the landscaping meets the zoning ordinance, a new site plan
is filled with staff, and if the parking agreement goes away, they are
required to provide on-site parking to meet the zoning ordinance.
Motion carried by a vote of 3-1. Councilmember Lopez against.
Councilmember Williams absent.
Mayor Agan adjourned the joint meeting at 6:45 p.m.
