AN ORDINANCE REPEALING AND RE-ENACTING SECTIONS 7-
3-1 THROUGH 7-3-3 OF THE CITY CODE OF IONA, IDAHO;
PROVIDING FOR THE ADOPTION OF THE INTERNATIONAL
SCHOOL BUILDING CODE; PRESERVING PRIOR ORDINANCE;
PROVIDING FOR SEVERABILITY; AND ESTABLISHING
EFFECTIVE DATE.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
IONA, IDAHO THAT:
Section 1. Repeal and Re-enactment of Sections 7-3-1 through 7-3-3, City
Code. Sections 7-3-1 through 7-3-3 of the City Code of Iona, Idaho, are hereby
repealed and re-enacted as follows:
7-3-1: ADOPTION OF CODES FOR SCHOOL BUILDINGS: There are hereby
adopted as official building codes of the City of Iona, Idaho all of the International
Building Codes referenced in Idaho Code Section 39-4109, provided such Codes shall
be applicable only to the extent set forth hereinbelow with respect to the construction of
any new school building or addition or alteration to any existing school building which is
estimated to cost in excess of $25,000. One copy of each of such Codes shall at all
times be maintained at the office of the City Clerk and one copy shall be maintained at
the office of the Planning and Building Department.
7-3-2: SCHOOL PLAN REVIEW: It shall be unlawful for any school district to
advertise for any bid for the construction of any new school building or addition or
alteration to an existing school building located or to be located within the City and
estimated to cost in excess of $25,000, unless the plans have been first reviewed by
the Building Official and approved in accordance with the provisions of the International
Codes adopted in Section 7-3-1 of this Chapter. Nothing herein shall require the
Building Official to inspect or otherwise enforce the provisions of such Codes once such
plan review has been completed and approval thereof given by the Building Official.
7-3-3: PLAN REVIEW FEES: Prior to and as a condition for the approval of
such plans, a school district seeking such plan review shall pay a plan review fee as set
forth in the International Building Code.
Section 2. Preservation of Prior Ordinance. All portions of the City Code
repealed by this Ordinance shall be preserved to permit the arrest, prosecution and
punishment of any person who violates such repealed section prior to the effective date
hereof.
Section 3. Severability. The provisions of this Ordinance are severable. In
the event any provisions shall be determined to be void or unenforceable for any
reason, such determination shall not affect the enforceability of the remaining
provisions.
Section 4. Effective Date. This Ordinance shall become effective on January
1, 2005, provided it has just been passed, executed and published in the manner
provided by law.
