I (pg AN ORDINANCE OF THE CITY OF IONA, IDAHO, REPEALING AND RE-ENACTING SECTIONS 7-2-1 AND 7-2- 2 OF THE CITY OF CODE OF IONA, IDAHO; PROVIDING FOR THE ADOPTION OF THE 2003 INTERNATIONAL PROPERTY MAINTENANCE CODE; PROVIDING CERTAIN AMENDMENTS THERETO; PRESERVING PRIOR ORDINANCE; PROVIDING FOR SEVERABILITY; AND ESTABLISHING EFFECTIVE DATE. BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF IONA, IDAHO THAT: Section 1. Repeal and Re-enactment of Sections 7-2-1 and 7-2-2, City Code. Sections 7-2-1 and 7-2-2 of the City Code of Iona are hereby repealed and re-enacted as follows: 7-2-1: INTERNATIONAL PROPERTY MAINTENANCE CODE ADOPTED: (A) International Property Maintenance Code Adopted: The International Property Maintenance Code, 2003 Edition, published by the International Code Council, Inc., is hereby adopted as an official code of the City, except the portions deleted, modified or amended by the provisions of this chapter. (B) Code on File: One (1) copy of the International Property Maintenance Code, 2003 Edition, duly certified by the Clerk, shall be retained by the City Clerk for use and examination by the public. 7-2-2: AMENDMENTS TO THE INTERNATIONAL PROPERTY MAINTENANCE CODE: (A) Section 103.2 of the International Property Maintenance Code, 2003 Edition, shall be amended to read as follows: 103.2 Appointment. The code official shall be appointed by the chief appointing authority of the jurisdiction. (B) Section 111.1 of the International Property Maintenance Code, 2003 Edition, shall be amended to read as follows: 111.1 Application for appeal. Any person directly affected by a decision of the code official or a notice or order issued under this code shall have the right to appeal to the board of appeals, provided that written application for appeal is filed within 20 days after the day the decision, notice or order was served. An application for appeal shall be based on a claim that the true intent of this code or the rules legally adopted thereunder have been incorrectly interpreted. Section 2. Preservation of Prior Ordinance. The sections of the City Code amended or repealed by this Ordinance shall be preserved to the extent necessary to allow the arrest, prosecution and punishment of any person who violates such provisions prior to the effective date hereof. Section 3. Severability. The provisions of the Ordinance are severable. In the event that any provisions shall be determined to be void or unenforceable for any reason, such determination shall not effect the enforceability of the remaining provisions. Section 4. Effective Date This Ordinance shall be effective on January 1, 2003, provided it has just been passed, executed and published in the manner provided by law.
