AN ORDINANCE OF THE CITY OF IONA, IDAHO,
REPEALING AND RE-ENACTING SECTIONS 7-1-1 AND 7-1-
2 OF THE CITY OF CODE OF IONA, IDAHO; PROVIDING
FOR THE ADOPTION OF THE 2003 INTERNATIONAL
BUILDING CODE; PROVIDING FOR AMENDMENTS
THERETO; PRESERVING PRIOR ORDINANCE; PROVIDING
FOR SEVERABILITY; AND ESTABLISHING EFFECTIVE
DATE.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF IONA,
IDAHO THAT:
Section 1. Repeal and Re-enactment of Sections 7-1-1 and 7-1-2, City Code.
Sections 7-1-1 and 7-1-2 of the City Code of Iona are hereby repealed and re-enacted as
follows:
7-1-1: INTERNATIONAL BUILDING CODE ADOPTED:
(A) International Building Code Adopted: The International Building Code, 2003 Edition,
published by the International Code Council, Inc., is hereby adopted as an official
code of the City, except the portions deleted, modified or amended by the
provisions of this chapter.
(B) Code on File: One (1) copy of the International Building Code, 2003 Edition, shall
be retained by the City Clerk for use and examination by the public.
7-1-2: AMENDMENTS TO THE INTERNATIONAL BUILDING CODE:
(A) A new Section, Section 101.2.2 shall be added to the International Building Code,
2003 Edition, as follow:
101.2.2 Scope. The provisions of this code shall serve as the administrative,
organizational and enforcement rules and regulations for the technical codes which
regulate site preparation and construction, alteration, moving, demolition, repair, use
and occupancy of buildings, structures and building service equipment within this
jurisdiction. If there is any conflict between the International Building Code, 2003
Edition, and any other technical code, the International Building Code shall control.
(B) Section 101.4.4 of the International Building Code, 2003 Edition, shall be amended
to read as follows:
101.4.4 Plumbing. The provisions of the Uniform Plumbing Code shall apply to the
installation, alterations, repairs and replacement of plumbing systems, including
equipment, appliances, fixtures, fittings and appurtenances, and where connected
to a water or sewage system and all aspects of a medical gas system.
(C) Section 112.2 of the International Building Code, 2003 Edition, shall be amended
to read as follows:
112.2 Limitations on authority. An application for appeal shall be based on a
claim that the true intent of this code or the rules legally adopted thereunder have
been incorrectly interpreted, the provisions of this code do not fully apply, or an
equally good or better form of construction is proposed pursuant to the criteria set
forth in section 104.11 of the International Building Code, 2003 Edition. The board
shall have no authority to waive requirements of this code.
(D) Section 903.2.7 Group R, of the International Building Code, 2003 Edition, shall be
amended to add an eception as follows:
EXCEPTION: Automatic sprinkler systems are not required in 3 or 4 unit Group R
Buildings.
(E) Tables No. 108.2A, 108.2B, 108.2C, 108.2D, 108.2E shall be added to Section
108.2 of the International Building Code, 2003 Edition, as follows:

For total valuation between $50,001 and $100,000, $445 shall be charged for the first
$50,000, plus $4.70 for each additional $1,000 or fraction thereof.
•
For total valuation between $100,001 and $400,000, $690 shall be charged for the first
$100,000, plus $3.60 for each additional $1,000 or fraction thereof.
•
For total valuation between $500,001 and $1,000,000, $2,190 shall be charged for the first
$500,000, plus $3.10 for each additional $1,000 or fraction thereof.
•
For total valuation of $1,000,001 and up, $3,800 shall be charged for the first $1,000,000,
plus $2.05 for each additional $1,000 or fraction thereof.
TABLE NO. 108.2B:
New Residential Buildings and Additions to Residential Buildings.
The following fees shall include all wiring and electrical equipment in or on
each building, or other electrical equipment on the same premises
constructed at the same time. The permit fee shall be based upon the total
valuation using the following values:
Dwelling unit $3.10 per sq. ft.
Garages $1.03 per sq. ft.
Finished Basements $1.03 per sq. ft.

Signs, Outline Lighting and Marquees
For signs, outline lighting systems or marquees
supplied from one branch circuit, each $ 5.25
For additional branch circuits within the same
sign, outline lighting system or marquee, each $ 3.15
Commercial and Industrial
Permit fee shall be one and one-half percent (1.5%) of the first Twenty
Thousand Dollars ($20,000.00) of wiring costs plus three -fourths
percent (.75%) of the wiring costs in excess of Twenty Thousand
Dollars ($20, 000.00). Wiring costs shall include the total costs of any
and all equipment, materials and labor for installations governed by the
National Electric Code.
OTHER INSPECTIONS AND FEES:
Inspections outside of normal business hours $31 per hour*
(minimum charge —two hours)
Reinspection fees assessed under provisions
of Section 305.8 $31 per hour*
Inspection for which no fee is specifically indicated $31 per hour*
(minimum charge —one-half hour)
Additional plan review required by changes, additions
or revisions to plans $31 per hour*
(minimum charge —one-half hour)
*Or the total hourly cost to the jurisdiction, whichever is the greatest.
This cost shall include supervision, overhead, equipment, hourly
wages and fringe benefits of the employees involved.

Commercial Buildings
One and one-half percent (1.5%) of the first Twenty Thousand Dollars

(F) Chapter 11, of the 2001 Supplement to the International Codes, is hereby
adopted.
(G) All Appendices of the International Building Code, 2003 Edition, are hereby
deleted.
Section 2. Preservation of Prior Ordinance. All portions of the City Code
repealed by this Ordinance shall be preserved to permit the arrest, prosecution and
punishment of any person who violates such repealed section prior to the effective
date hereof.
Section 3. Severability. The provisions of the Ordinance are severable.
In the event that any provisions shall be determined to be void or unenforceable for
any reason, such determination shall not effect the enforceability of the remaining
provisions.
Section 4. Effective Date This Ordinance shall be effective on January 1,
2005, provided that it has been properly passed, executed and published in the
manner provided by law. qr
