For the infornnation of the citizens of the Town generalll/, the Assessors publish the following synopsis of their ditties in assessing the Taxes. 1ST. After having been duly elected and qualified by taking and sub- scribing the oath prescribed in Rev. Sts. c. 15, sec. 55, their first duty is to Organize by the choice of a Chairman. This duty, though nowhere specifically enjoined, w3uld seem to be inferred from the provisions of Rev. Sts. c. 7, see. 29. 2D. This notice is usually given by posting up notifications in one or more public places. It may, however, be given by advertisement in some news- paper or at any legal meeting of the inhabitants. Rev. Sts. c. 7. sec. 19. 3D. The notice thus given must require the inhabitants to bring in to the assessors, within a time therein specified, true lists of all their polls and estates both real and personal not exempted from taxation." Id. Id. Id. 55 4ru. Id. D. sec. 20. 5Tu. At the time appointed) in the notice the assemors are to make a valuation of all the estates, real and personal, subject to taxation therein, and for this purpose they are to receive as "the true valuation of the prop- erty of each individual the list if any, brought in by him," unless upon the requisition of the assessors he shall have refused to swear to it. That is a, the assessors cannot lawfully tax a. person for any more property than he inserts in his list, unless he refuses to swear that he has no more. Id. Id. ss. 21-22. 6Tu. The lists above named have commonly been supposed, to be conclusive upon the assessors as to the estimate of the value as well as the items of the property contained in the lists. But it is not so. The list is required to contain only the enumeration and description of all the taxa- ble property of the person giving it. If an estimate of the value be added by the owner, such estimate is to assist but not to control the judgment of the assessors, whose duty it would still be to appraise, estimate and value the property so given in according to their best skill and judgment. This has been decided by the Supreme Court in a case involving the exact point. In Inhabts. (f Newburyport, vs. County Commissioners of Essex, 13 Chap. 211. 7TII. I£ any person shall have failed to bring in his list at the time appointed, or if having brought it in, he shall refuse to make oath to its correctness on being thereto required, the assessors shall ascertain as nearly as possible the particulars of his personal estate, and of the real estate in his possession or occupation, and make an estimate thereof at its just value, according to their best information and belief. Id. Id. sec. 23. 8Tn. Every keeper of any tavern or boarding house, and every mas- ter or mistress of any dwelling house, is required, upon the applicatio❑ Of any assessor of the town, to give the names of all persons residing in such house, and liable to be assessed for taxes, under penalty of twenty dollars for each offence in refusing to give such information : or knowingly giving information which is false. Stat. 1837, e. 176. 56 9Tn. Any taxable person being in any town on the first day of May, who, when called upon by the assessors shall deny his legal residence , therein, and refuse to state where lie considem his legal residence to be, shall be deemed an inhabitant of and asv-,sablc in such town. If such poison shall designate another town as his legal residence, the assessors shall notify the assessors of the town designated accordingly. Stat. 1350., c. 276. 10TU. The " estimate " of the taxable property of each individual, made by the assessors, shall be entered in the valuation, and is conclusive upon all persons who shall not seasonably have brought in lists of their estates, unless they can show a reasonable excuse for their omission. R.:V- Ctats., c 7, Sec'. 21. 1.1TII. " A reasonable exruse ,for the onassion," has probably the a imo meaning as ..good cause for not hazing so done; the phraso employed in section 40. What is " good cause," is a " question of law upon facts proved or agreed," and in the first instances must be decided by the assessors. It has been determined by the Supreme Court, that the followinn are not good causes for omitting to carry in lists to the assessors, viz : 1st. That the party taxed is a Corporation. 2d. Or non resident. 3d. Or that the assessors waived a list. 4th, Or that it " did not appear that the , ssessors had given notice to the inhabitants to bring in their lists," whether tl.e omission to give the notice would be a good cause, was not decided ; but only that if it were a good cause, it must be shown by the party relying on it. Winnisimmet Co. vs. the Assessors of the Town of Chelsea. 6 Cushing, 477. 12TQ. "The assessors may include in the same assessmentt heir State, County, and Town taxes, or any two of them whenever they shall think it convenient." Rev. Stats., c 7. sec. 25. 13TH. For the convenience of calculation, the assessors have the right to assess more than the sum authorized to be raised, not to exceed fire per cent thereof. This excess is usually called " orerlay," and is the diff-crence between the sum actually assessed upon estates, and that required to be assessed upon estates. Id. Id. 28. 67 14Tg. The assessment having been completed, the assessors are required to make a list of the valuation and the assessment thereon ; and before committing the taxes for collection are to deposit the list or an attested copy of it in their office ; or if there be no office, with their Chairman, for public inspection. Id. c. 7, sec. 29. 4t the close of this list, they are to subscribe and take an oath that it is a full and true list of the names of all persons known to them as liable to taxation in their town, and that the assessment is a full and accurate assessment upon the property of each individual according to its fair cash value. Stat. 1853, c. 319, sec. 2. 15Te. Within a reasonable time after having prepared the list of the valuation and assessment, the assessors are required to commit the tag list with their warrant under their hands to the collector for collection. Rev. Stats., c. 7, sec. 32. 16TH. The warrant specifies the duties of the collector in the collec- tion of taxes, and the times when, and the persons to whom the same shall be paid by the collector. Except that it is not required to be under seal, it is the same in form as that used since 1785. Id. Id. c. ,, 33. The warrant, amongit other things, requires the collector, if any person shall refuse or neglect ,:o pay the sum he is assessed in the list, to distrain, i. e. to seize for the purpose of selling, the goods or chattels of such person to the value of the tax. Stat. 1185, c. 50, sec. 6. 17TH. Should no collector have been appointed by the town, the ssors are to commit the tax list with their warrant to the sheriff or his teputy, whose duty it shall be to collect the taxes. Id. Id. sec. 35. 18Ts. Any town is authorized to allow such discount to parsons Who shall make voluntary payment of their taxes within prescribed periods; and the collectors are required to make such discounts accord- ingly. Id. Id. sec. 35. 19Ta. There is no provision of law authorizing a town to exact the payment of interest on taxes not paid within prescribed times. 58 20TI1. When a discount has been allowed by a town, the asseasors are required, when they commit their warrant to the collector, to post up in one or more public places within the town, notice of the rates of discount. Id. Id. sec. 36. '21 ST. Assessors are authorized to make an abatement of taxes to any person aggrieved by the amount of taxes assessed upon him, ,but only under the following circumstances. 1st. When he shall have applied to the assessors for an abatement within six months after the date of his tax bill. Rev. Sts., c. 7 sec. 41. 2d. After he shall have filed with the assessors a list, subscribed by him, of his estate liable to taxation and made oath that is a full and accurate list of the same, according to his best knowledge and belief. Stat. 1853, c. 319, sec. 3. 3d. After he has made it appear to the assessors that he is taxed for more than his just proportion : and for this purpose the assessors may examine upon oath the person applying, and any witnesses he or they may see fit. Rev. Sts., c. 7, sec. 37. It is a prerequisite to any abatement of taxes that a list of the appli- cant's estate shall have been first filed and sworn to ; but it is not neces- sary that this list should have been filed within the time limited in the notice of the assessors. Under the Revised Statutes, c. 7, sec. 37, it was not required that a list should have been filed at any time, to authorize the assessors to make an abatement, 1 ut only to authorize the County Commissioners to do so on appeal from the assessors. Winnisimmet Co. vs. County Comrs. of Essex, 6 Cush. 477. The Act of 1853 renders the filing of the list necessary in all cases ; but as it provides that no abatement shall be made until the list shall be filed, the applicant has the whole six months after the date of his tax bill in which to file it. The assessors have no power to make an abatement under any other circumstances ; nor have they any authority to waive or dispense with the film; of the list. Winnisimmet Co., vs. County Comrs. of Essex 6, Cush. 477. Assessors while acting within their appropriate sphere, have the same protection and immunities which judicial officers have, and therefore are not liable in any form of action for accidentally assessing a person not an inhabitant of the town and not liable to be taxed. Baker vs. Allen, 21, Pick, 382. 59 02D. The person applying for an abatement must pay all the legal costa which may have accrued before such abatement is made. Rev. Sts., c. 7, sec. 38. 23D. Upon the refusal of the assessors to make an abatement, the person applying for it may complain to the County Commissioners, who if they are satisfied that the complainant is overrated shall make such abatement, as they may deem reasonable. But the complaint must be filed with the Clerk of the Commisioners within one month after the refusal of the assessors ; and the list as required in Stat. 1853, must have been filed with the assessors. Rev. Stats., c. 7, secs. 39--40 24TH. If before the abatement is made, the person to whom it is made shall have paid his tag, he shall be re-imbursed, out of the treasury of the town to the amount of the abatement, and all charges, except legal costa. Id. Id. sec. 42. 25TH. Every person whose tag shall be abated, shall be entitled to a certificate thereof from the assessors, or the clerk of the commissioners or other proper officers, Id. Id. see. 44. 26m. Assessors are not responsible for the assessment of any tag messed by them in p usuance of any vote for that purpose certified to them by the clerk of the town, but are responsible only for want of integrity or fidelity on their own part. Id. Id. sec. 44. " Where a party is rightfully taxed for any personal or any real estate, his remedy, and his only remedy for any excess of taxation, is by appli- cation for abatement ; " whether the excess arises from including in the valuation property of which the person taxed is not the owner, and for which he is not liable to be assessed ; or from pleading an undue and disproportionate value on that of which be is the owner. In all such cases the assessment is valid, and the party aggrieved cannot maintain an action at law to recover back a portion of the tax so assessed, although paid by compulsion. But on the other hand, if a person not legally liable to be taxed in a city or town, is nevertheless assessed there, then the assessment is regarded as wholly invalid, and on payment by compul- sion, the amount illegally assessed, that is, the entire tag, can be recov- ered in this form of action." Howe vs. City of Boston, 7 Cush. 273. 60 27m. "A tax is no debt until it is assessed and demanded ; and if not legally t cssed, it is the same as if never assessed at all." But the whole tau need not be lost when the assessors go beyond their authority. It uiay be re-assessed, or the town may renew its vote to raise the money. Libby vs. Burnham, 15 Ch. R. 144 28Te. The assessors are authorized to assess any person for his poll and estate upon application in writing made seven days before any election, Provided the person applying shall prove himself to have been an inhab- itant, and liable to pay a poll tax at the time of Vie last annual assess- ment, and shall furnish, under oath, true lists of his poll and personal and real estate. Stat. 1852, c. 169.
