ROLL CALL PRESENT: Councilmember - Sternquist, Vizcarra, Yu, Chavez and Blum ABSENT: Councilmember - None ALSO PRESENT: Interim City Manager Penman, City Attorney Vail, City Clerk Kuo, Administrative Services Director Hause, Parks and Recreation Director Burroughs, Public Safety and Services Manager Sahagun and Planning Manager Starns 3. INVOCATION Pastor Frank Wang from Bethlehem Lutheran Church, 5319 N. Halifax, provided the Invocation. ' 4. PLEDGE OF ALLEGIANCE Cub Scout Pack 160 led those present in the Pledge of Allegiance to the Flag. 5. CEREMONIAL MATTERS - PRESENTATIONS A. PRESENTATION - PET OF THE MONTH Lynne Collmann, new secretary for the San Gabriel Valley Humane Society Board of Directors, introduced the featured pet for the month "Rufus". Rufus is a male American Staffordshire Terrier approximately six months old and weighs 40 pounds. Those interested in adopting him can call the San Gabriel Valley Humane Society at (626) 286-1159. B. PRESENTATION - CITRUS PEST AND DISEASE PREVENTION PROGRAM Mark Olson with Citrus Pest & Disease Prevention Program gave a brief presentation regarding the prevention of citrus pest and diseases. 6. PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA Dan Deborz, thanked the City Council and staff for finding a solution to a traffic concern he spoke about during a City Council meeting in January. Costance Hilton, had complained regarding the concrete divider between the travel lanes and the bicycle lane on Rosemead Boulevard. ' Ken Knollenbera, Temple City resident, thanked City for advertising the Doug Sears Learning Center Food Truck fundraising event on the City's message sign and thanked Councilmember Sternquist for attending Longden Elementary School's Relay for Life event. City Council Minutes June 3, 2014 Page 2 of 9 Donna Georaino, Temple City resident/ Parks and Recreation Commissioner, spoke regarding the City's Parks and Open Space Master Plan,and applying for park grants that will benefit the residents of Temple City. 7. CONSENT CALENDAR Councilmember Vizcarra moved to approve the Consent Calendar, seconded by Councilmember Stemquist and unanimously carried. A. APPROVAL OF MINUTES The City Council is requested to review and approve: 1) Minutes of the City Council Regular Meeting of May 20, 2014; and 2) Minutes of the City Council Special Meeting of May 21, 2014. Action: Approved. B. TRANSPORTATION AND PUBLIC SAFETY COMMISSION ACTIONS — MEETING OF MAY 7, 2014 The City Council is requested to review the Transportation and Public Safety Commission actions of their meeting of May 7, 2014. Action: Received and filed. C. PLANNING COMMISSION ACTIONS — MEETING OF MAY 13, 2014 The City Council is requested to review the Planning Commission actions of their meeting of May 13, 2014. Action: Received and filed. D. PARKS AND RECREATION COMMISSION ACTIONS — MEETING OF MAY 21, 2014 The City Council is requested to review the Parks and Recreation Commission actions of their meeting of May 21, 2014. Action: Received and filed. E. RELEASE OF SECURITY FOR TRACT NO. 071721 FOR SANITARY SEWER IMPROVEMENTS AT 5551-5553 SULTANA AVENUE The Los Angeles County Department of Public Works notified the City that the sanitary sewer improvements for Tract No. 071721 were completed, inspected and found to be in compliance with the approved plans. Hence, the City can now release the Certificate of Deposit. Action: Approved the work that has been completed and accepted the sanitary sewer improvements for public use and authorize release of security in the amount of $97,500. F. RELEASE OF SECURITY FOR TRACT NO 069956 FOR ROAD IMPROVEMENTS AT 5400- 5408 MCCULLOCH AVENUE The Los Angeles County Department of Public Works notified the City that the road City Council Minutes June 3, 2014 Page 3 of 9 improvements for Tract No. 069956 were completed, inspected and found to be in compliance with the approved plans. Hence, the City can now approve work as completed, accept the road improvements for public use, and release the security deposit. Action: Approved the work that has been completed and accepted the road improvements for public use and authorize release of security in the amount of $25,300. G. UPDATE ON THE UNIFORM PUBLIC CONSTRUCTION COST ACCOUNTING ACT PROCESS AND PROCEDURES To provide the City with additional flexibility for public works contracting, the City Council elected to become subject to the Uniform Public Construction Cost Accounting Act through adoption of Resolution No. 13-4931 and Ordinance No. 13-977. The City Council requested an update on the process by June 30, 2014 and a list of qualified bidders for 2014. Action: Received and filed the update on the Uniform Public Construction Cost Account Act process and procedures. H. ADOPTION OF RESOLUTION NO. 14-4999 APPROVAL OF PAYMENT OF BILLS The City Council is requested to adopt Resolution No. 14-4999 authorizing the payment of bills. Action: Adopted Resolution No. 14-4999. PETTY CASH REPORT The City Council is requested to review, receive and file the Petty Cash Report. Action: 8. PUBLIC HEARING Received and filed. A. ADOPTION OF RESOLUTION NO. 14-4996, ORDERING THE LEVY OF CITYWIDE LIGHTING AND MAINTENANCE DISTRICT ASSESSMENTS FOR FISCAL YEAR (FY) 2014- 15 City Council approval of the FY 2014-15 levy of the District assessments will allow the City to continue with its annual Lighting and Maintenance District program. Administrative Services Director Hause gave a brief summary of the staff report. Mayor Blum opened public hearing. Hearing no request from the public to speak, Mayor Blum public hearing was closed. Councilmember Sternquist made a motion to adopt Resolution No. 14-4996 ordering the levy and collection of assessments for FY 2014-15. Seconded by Councilmember Vizcarra and unanimously carried. B. ADOPTION OF RESOLUTION NO. 144997 CONFIRMING THE FACTORS USED FOR CALCULATING THE ANNUAL APPROPRIATIONS LIMIT FOR FISCAL YEAR 2014-15 I Article XIII -B provides limits to the amount of tax proceeds state and local governments can spend each year. The limit for any fiscal year is equal to the previous year's limit, adjusted for City Council Minutes June 3, 2014 Page 4 of 9 I population changes and the change in the U.S. Consumer Price Index or California Per Capital Personal Income, whichever is less. Staff has complied with all the provisions of Article XIIIB in determining the Limit for FY 14-15, and the City Council is required to confirm all factors used for calculating the Limit by adoption of a resolution. The City Council is requested to adopt Resolution 14-4997, a Resolution confirming the factors used for calculating the annual Appropriations Limit for FY 2014-15. Administrative Services Director Hause gave a brief summary of the staff report Mayor Blum opened public hearing. Hearing no request from the public to speak, Mayor Blum closed the public hearing. Councilmember Yu made a motion to adopt Resolution No. 14-4997 confirming the factors used for calculating the annual appropriations limit for FY 2014-15. Seconded by Councilmember Vizcarra and unanimously carried. C. ADOPTION OF THE PROPOSED FISCAL YEAR (FY) 2014-15 CITY BUDGET AND FIND THAT THE CITY IS IN COMPLIANCE WITH GOVERNMENT CODE SECTION 66000 Pursuant to Section 901 of the City Charter, the City Council shall conduct a public hearing prior to the adoption of the proposed FY 2014-15 Budget. The public hearing will allow the City Council to hear testimony presented by any interested person about the City proposed budget. The City Council is being requested to review and consider adoption of the proposed revenues and ' expenditures for FY 2014-15. Interim City Manager Penman and Administrative Services Director Hause gave a summary of the staff report and overview of the proposed City Budget. Interim City Manager Penman recommended the elimination of one part time Code Enforcement Officer and one part time Management Analyst in the Community Development Department. He will continue to assess the staffing needs of the City and make recommendations to the City Council. He also mentioned that the Temple Sheriff Station is unable to provide the City with a motor unit as one is not available at this time. Therefore, the services provided by the Sheriff will remain the same until a motor unit is available. Administrative Services Director Hause made a correction to the Proposed City Budget resolution attachment A. The total operating budget should be $16,301,875 instead of $16,277,465. Councilmember Vizcarra made a motion to adopt Resolution 1411998, a Resolution adopting the Proposed FY 2014-15 City Budget with correction and making the finding that the City is in compliance with Government Code Section 66000. Seconded by Councilmember Yu and unanimously carried. City Council meeting recessed at 8:32 p.m. and reconvened at 8:40 p.m. with all City Council present. 9. UNFINISHED BUSINESS — None 10. NEW BUSINESS ' City Council Minutes June 3, 2014 Page 5 of 9 ' A. REQUEST FOR LETTER OF SUPPORT FROM THE 710 COALITION REGARDING THE COMPLETION OF THE SR -710 TUNNEL The 710 Coalition is made up of San Gabriel Valley and Los Angeles County cities (i.e., Alhambra, Monterey Park, Rosemead, San Gabriel, San Marino, Cudahy and Downey), residents, organizations (i.e., Alhambra Chamber of Commerce, Alhambra Unified School District, San Gabriel Valley Council of Governments, San Gabriel Valley Economic Partnership, Southern California Association of Governments, San Gabriel Unified School District; and Garvey School District) and businesses. The 710 Coalition is requesting a support letter from City Council regarding the completion of the 710 Freeway and tunnel. Interim City Manager Penman gave a summary of the staff report. Mayor Blum opened public comment. Jim Cliff, Temple City resident, commented regarding the 710 Freeway and Tunnel Project. Hearing no further request for public comment, Mayor Blum closed public comment. Councilmember Yu made a motion to submit a support letter to the 710 Coalition regarding the completion of the 710 Freeway only and remain silent regarding the tunnel Project. Seconded by Councilmember Vizcarra and unanimously carried. B. FIRST READING AND INTRODUCTION OF ORDINANCE NO. 14-993 AMENDING TITLE 6 ("PUBLIC HIGHWAYS, SEWER, AND UTILITIES"), CHAPTER 2 ("SEWERS AND WASTE"), ARTICLE C ("GARBAGE AND RUBBISH DISPOSAL"), SPECIFICALLY, SECTION 6.2C(2) OF THE TEMPLE CITY MUNICIPAL CODE RELATING TO THE LOCATION, PLACEMENT TIME -FRAMES, AND CONSTRUCTION OF TRASH CONTAINERS Ordinance No. 14-993 amends the existing code by establishing acceptable trash container placement areas and new time -frames for collection days. The proposed ordinance will improve the City's quality of life by addressing aesthetics, public safety concerns, and increasing the effectiveness of the City's street sweeping program and NPDES best practices. Public Safety and Services Manager Sahagun gave a brief summary of the staff report. Mayor Blum opened public comment. Jerry Jambazian, Temple City business owner, commented about the trash truck driving in the middle of the street when collecting trash. Mary Kokavko, Temple City resident, spoke in favor of placing trash cans on the curb instead of the grass and being able to take her trash cans out to the curb the night before. Mayor Blum stated that he received a letter in opposition of the adoption of Ordinance 14-993 from Judith Romine, Temple City resident. Hearing no further request for public comment, Mayor Blum closed public comment. Mayor Pro Tem Chavez made a motion to: ' 1) Introduce Ordinance No. 14-993 for first reading by title only, amending Title 6 ("Public Highways, Sewer, and Utilities'), Chapter 6 ("Sewer and Waste"), Article C ("Garbage City Council Minutes June 3, 2014 Page 6 of 9 I and Rubbish Disposal"), specifically, Section 6.2C(2) of the Temple City Municipal Code; 2) Waive further reading of Ordinance No. 14-993; and 3) Schedule the second reading of Ordinance No. 14-993 for June 17, 2014. Seconded by Councilmember Vizcarra and unanimously carried. C. RECOMMENDATION FROM THE PARKS AND RECREATION COMMISSION REGARDING PRIORITIZATION OF PARKS AND OPEN SPACE MASTER PLAN ACTION PLAN MATRIX With adoption of the Parks and Open Space Master Plan by the City Council, the Parks and Recreation Commission was requested to review and prioritize the Action Plan Matrix to assist staff in budgeting for, and implementation of the various components of the Plan. The Commission has prioritized the Facility/Amenity Matrix. Parks and Recreation Director Burroughs gave a brief summary of the staff report. Mayor Pro Tem Chavez commented that he and Mayor Blum are meeting with local clergy and recommended that a Parks and Recreation staff attend one of the meetings to discuss possible joint use facilities agreement with local Churches. Mayor Blum opened public comment., Hearing no request for public comment, Mayor closed public comment Councilmember Yu made a motion to approve the priorities established by the Parks and ' Recreation Commission for the Action Plan Matrix from the Parks and Open Space Master Plan. Seconded by Mayor Pro Tem Chavez and unanimously carried. 11. COMMUNICATIONS — None 12. UPDATE FROM CITY MANAGER Interim City Manager Penman announced upcoming City events: The latest issue of Temple City Connect will be mailed to residents this weekend. The magazine will also be available at City facilities and online at www.temDlecitv.us; Registration for Summer STARS Club, Teen Zone, Sports Camp, and Camp-A-Palooza is currently being accepted at Live Oak Park. Registration for summer fee and charge classes begins Thursday, June 12. Register online or in person at the Live Oak Park Community Center. Call (626) 579-0461 for additional information; Neighborhood Watch meeting on Thursday, June 12, the meeting begins at 5:30 p.m. at Live Oak Park for Area bounded by Baldwin Ave., Live Oak Ave., EI Monte Ave. and Olive Street. The ad hoc committee will bring recommendation to full City Council at a meeting in July regarding the formation of an Audit Standing Committee. Those interested in volunteering for the standing committee should contact the City Clerk's Office. I. FY 2014-15 BUDGET AD HOC COMMITTEE (Mayor Pro Tem Chavez and Mayor Blum) — Formed 4/15/2014 Mayor Blum disbanded the ad hoc committee. J. COMMISSION APPLICATION REVIEW AD HOC COMMITTEE (Councilmembers Sternquist and Vizcarra) — Formed 4/15/2014 Councilmember Sternquist reported on the interviews that the ad hoc committee conducted on May 23. The ad hoc committee recommended reappointment of the current commissioners that have reapplied. City Council concurred with the recommendation and will appoint the commissioners at the next Regular City Council meeting of June 17. Mayor Blum disbanded the ad hoc committee. K. COUNCIL ITEMS SEPARATE FROM THE CITY MANAGER'S REGULAR AGENDA A. COUNCILMEMBER STERNQUIST Thanked Ms. Olson for presenting information regarding the Citrus Pest & Disease. Shared with the public that the Foothill Transit provides a link for riders to check on arrival time of buses. She was selected to serve as an Alternate to the Delegate of the Foothill Transit Goveming Board. B. COUNCILMEMBER VIZCARRA Thanked Interim City Manager Penman for directing the Administrative Services Director to update City Council on a police incident that occurred on June 2, 2014. C. COUNCILMEMBER YU Reported that City Council has received inquiries from City of Santa Monica regarding the City's protected bike lanes on Rosemead Boulevard. D. MAYOR PRO TEM CHAVEZ Commented that the City Council used to receive updates from the Sheriffs regarding incidences I in the City but it was discontinued. Would like to add this item to the monthly Sheriffs meeting agenda for discussion. E. MAYOR BLUM Reported on the ground breaking for the Olson Project on Lower Azusa last week. Announced that the City Council will begin to review the applications for City Manager's position in June and interview in July. 15.
