Critical InfrastructureMapping/Planning The use of a UAS can provide city personnel with vital and nearly instantaneous information on critical infrastructure.Aerial mapping,thermal images,3D renderings and high definition photos can help clarify and answer questions regarding the state of our critical infrastructure.These capabilities are especially important when examining the waste water treatment plant,the Portrero Interchange,traffic chokepoints,etc.These are only a few of the areas where a UAS can be used. O?ice ofEmergency Services A UAS can provide vitally important information such as video footage and photographs that can be used to document damage caused by natural disasters,fires, and man-made incidents. Event Planning &Monitoring Events such as the Cherry Festival draw thousands of residents and visitors every year.The planning of such an event can be aided by using the photographic and mapping equipment of a UAS.The same system can be used to monitor city events, giving officers real-time information as to the nature and location of any occurrence within an event's boundaries. Hazard Detection &Hazardous Material Response The I-10,SR60,SR79 and a major railway intersect in the City of Beaumont.These transportation corridors bring a significant amount of hazardous material traffic into the area.The I-10 freeway and the rail line are major transportation corridors as they extend from California to Florida.A UAS is an asset to first responders responding to any hazardous material incident that might take place along these routes.An UAS could be used to provide real-time detection and tracking of hazards without exposing first responders to risk. Suspect Tracking UAS can aid in the tracking of suspects who have ?ed from a fresh crime scene or have ?ed from a vehicle or location from officers.With the same rural and urban areas, officers are required to track suspects in dense brush or in our more populated areas; a swift apprehension benefits the public safety of our residents. Transit has successfully obtained approval for the fiscal years 2016-2017 and 2017-2018 Short Range Transit Plans through the Riverside County Transportation Commission ("RCTC").Additionally,RCTC‘s triennial performance audit of Transit for years 2012-2013 through 2014-2015 determined that six of eight applicable compliance requirements have been fully met,and the remaining two.had partial compliance.Both requirements with partial compliance are currently targeted for full compliance starting with fiscal year 2016- 2017. A tracking process was started in July 201 T and is monitored outside of the Finance Office,by the Transit Management Analyst. 2016-4 Controls Over Accrued The following continuation from the prior year: Condition: The Paychex payroH database tracks the vacation accruals for employees through automatic accruals for each pay period for each employee.The City has established,through Memorandums of Understanding (MOUs)with various employee unions,caps onthe number of hours that can be accrued by employees.However,there does not appear to be any monitoring of the vacation hours to ensure the payroll system does not continue to accrue vacation hours once the cap has been reached.Furthermore, our review of the vacation accrual schedule found the number of hours accrued by a couple of employees exceeded the maximum number of hours per the applicable MOU. All administrative citation files must be readily available to City staff upon request.The provider will provide consistent payment noticing to the responsible person issued administrative citation(s). There shall be a real time secure website for public and City staff inquiry.The public shall be able to make citation payments on a secure website at any time.City staff shall have access to reports at any time. On April 27,2007,the RCFC &WCD,in cooperation with the County of Riverside,(the "County")and the incorporated cities of Beaumont,Calimesa,Canyon Lake,Corona,Hemet, Lake Elsinore,Moreno Valley,Murrieta,Norco,Perris,Riverside,and San Iacinto,jointly submitted a permit renewal application,a Report of Waste Discharge (the "2 007 ROWD"), to renew the NPDES permit for discharges of Urban Runoff from the MS4 in the Permit Area.The permittees submitted a revised Drainage Area Management Plan ("2 007 DAMP") as contained in Appendix B of the 2007 ROWD.The proposed DAMP identifies programs and policies,including best management practices (BMPS),to achieve Water Quality Standards in the Receiving Waters. The Drainage Area Management Plan (DAMP)for the Santa Ana Region (SAR)was updated in ]uly 2011 to address the requirements of the 2010 SAR municipal separate storm sewer system (MS4)Permit (Order No.R8-2010-0033,NPDES No.CAS618033 issued to the Riverside County Permittees by the Santa Ana Regional Water Quality Control Board (Santa Ana Regional Board),and incorporates programs developed since 1993.The DAMP serves as a model to document the SAR MS4 Permit compliance programs and to provide guidance to the permittees in the development and implementation of their Local Implementation Plans (LIPS)which contain the enforceable elements of the permittee compliance programs. The co-permittees have established legal authority to control discharges into the MS4 facilities that they own and/or operate.As owners and/or operators of the MS4,the permittees are responsible for discharges into their MS4 facilities to the extent of their legal authority.The discharge of pollutants into the MS4 may cause or contribute to,or threaten to cause or contribute to,a condition of pollution in receiving waters.Federal regulations,40 CFR 122.26(d)(2)(i),require the permittees to control the discharge of pollutants into the MS4 to the maximum extent practicable (MEP). A.In General.It is a violation of this chapter to throw,deposit,leave,maintain, keep or permit to be thrown,deposited,placed,left or maintained,any pollutant in or upon any street,alley,sidewalk,storm drain,inlet,catch basin,conduit or other drainage structures,business place or upon any public or private plot of land in the city.The only exception is where such pollutant is temporarily placed in an appropriate container with a spill containment system for later collection and removal.It is a Violation of this chapter to cause or permit any dumpster,solid waste bin or similar container to leak such that any pollutant is discharged into any street,alley,sidewalk,storm drain,inlet,catch basin,conduit or other drainage structures,business place or upon any public or private plot of land in the city. B.Construction Sites.Any person performing construction work in the city shall comply with the provisions of the ordinance codi?ed in this chapter and other city ordinances for erosion and sediment control. Compliance with this chapter shall be a condition of every permit,license or approval granted or issued by the city.Failure to comply with the chapter shall be grounds for revocation of any such permit,license or approval. 13.24.100 City authority to sample,inspect and monitor. A.Regulatory Inspections.The city engineer may inspect the premises of any discharger at reasonable times and in a reasonable manner to carry out the purposes of this chapter.If a discharger refuses to allow entry for inspection,an inspection warrant shall be obtained prior to inspection. B.Scope of Inspections.Inspections may include all actions necessary to determine whether any illicit discharge/connection exist,whether the BMPS installed and implemented are adequate to comply with the chapter,whether those BMPs are being properly maintained and whether the discharger complies with other requirements of this chapter.This may include sampling,metering, monitoring,visual inspections and records review.Records,reports,analyses or other required information may be inspected and copied,and photographsmay be taken for purposes of enforcement of this chapter. 13.24.110 Establishment of a fee. A person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this chapter is committed,continued or permitted. 13.24.170 Violations deemed _apublic nuisance. The city council hereby declares that any violation of this chapter is a threat to the public health,safety and welfare,and is therefore a public nuisance which may be summarily abated.The cost of such abatement shall be borne by the owner of the premises and the cost thereof may be imposed as a lien upon the premises,and such lien shall continue in existence until it is paid. 13.24.180 Administrative enforcement powers. In addition to any other enforcement powers and remedies established by this chapter,an authorized enforcement of?cer has the authority to issue administrativ ecitationsand?nes for violations of this chapter pursuant to Chapter 1.17 of this code. 13.24.190 Civil actions. D."Discharges"means any release,spill,leak,disposal,flow,escape,leaching (including subsurface migration or deposition of groundwater)dumping or discarding of any liquid,semi-liquid,condensate,vapors or solid substances,or combination thereof. E.“|llegal Discharge”means any discharge to the storm drain system that is not composed entirely of Storm Water Runoff except Discharges made pursuant to a National Pollutant Discharge Elimination System (NPDES)Permit or as othen/vise authorized by the Santa Ana Regional Water Quality Control Board. F.“lllegal Connection"means any physical connection to a storm drain system which has not been permitted by the City,the Riverside County Flood Control and Water Conservation District,or other appropriate public agency. G.“National Pollutant Discharge Elimination System (NPDES)Permit”means a storm water discharge permit issued by the Santa Ana Regional Water Quality Control Board or the State Water Resources Control Board pursuant to the Clean Water Act,including an M84 Permit. H.“Municipal NPDES Permit”means the area-wide NPDES Permit issued to a governmental agency or agencies for the discharge of storm water to a storm water system. I.“Non-Storm Water Discharge"means any Discharge to storm water system that is not entirely composed of storm water. J.“Person"means any natural person,firm,association,club,organization, corporation,partnership,business trust,company or other entity which is recognized by law as the subject of rights and duties. Generally appraisal services shall include,but not be limitedto: i.Consultant shall mail a noti?cation letter and acquisition policies brochure to the property owner requesting permission to conduct an on-site inspection of the property,advising them of their right to accompany the appraiser at the time of the inspection and requesting information regarding the property appraised which could in?uence the appraised value. ii.Consultant shall obtain preliminary title reports and review title information pertaining to respective ownerships.Consultant shall review improvement drawings and other pertinent information relative to the parcel and the proposed improvements. iii.Consultant shall inspect each property personally with the owner (if possible)and document the inspection with photographs and narrative for the report.' iv.Consultant shall inventory all improvements affected by the proposed taking including notes on their manner of disposition (i.e.,pay-for and remove vs.move back). v.Consultant shall perform market research to support the selected appraisal methodologies and will document and con?rm comparable sales information. vi.Consultant shall prepare a narrative appraisal report that conforms to the Uniform Standards of Professional Appraisal Practice (USPAP).The appraisal study and report are intended to serve as an acquisition appraisal and will be prepared in a summary format consistent with the speci?cation for narrative appraisal reports. vii.Consultantshall receive and analyze the completed appraisal reports and shall reconcile the real estate and ?xtures and equipment conclusions as necessary. viii.Consultant may be required to attend at least two (2)City Council closed session meetings,if requested by the City. 2.Acquisition Services:Consultant shall complete the acquisition services within six (6) months or continue until all easements (roadway,temporary construction easements and right-of-entry)are fully executed by an escrow company and are recorded with the Riverside County Recorder’s of?ce,whichever is later. Consultant shall receive and analyze title information,approve appraisal reports and legal descriptions in suf?cient detail to negotiate with property owners and other parties. Consultant shall recommend appropriate courses of action with regard to the various acquisitions. Consultant shall prepare all offer letters,summary statements and lists of compensable items of ?xtures and equipment (if applicable),in accordance with state regulations and approval of the City. Consultant shall present written purchase offers to owners or their representatives in person,’when possible.Consultant shall secure receipt of delivery of offer as practical and present and secure tenant information statements,as applicable. Consultant shall notify relocation agent of initiation of negotiations within 2 business days and provide appraisal information,occupant contact information and tenant information as necessary. Consultant shall negotiate,and follow-up as necessary,with each property owner to prepare and submit settlement recommendations and justi?cations for the City’s review and approval.Review any independent appraisal secured by property owner and coordinate reimbursement of appraisal fees (up to $5,000)with the City. Ongoing negotiations and settlement discussions shall continue for 8 weeks,or as otherwise directed by the City,after the initial offer or until a settlement is reached (or impasse). Consultant shall prepare and assemble acquisition contracts,deeds (grant and easement)and related acquisition documents required for the acquisition of necessary property interests. Consultant shall maintain a diary report of all contacts made with property owners or representatives and a summary of the status of negotiations indicating attitude of owners,problem areas and other pertinent information.Copies of all applicable written correspondence shall be maintained in ?les. Consultant shall prepare an impasse letter for any parcel where,after diligent attempts to settle by negotiation,it appears eminent domain will be needed or prudent to acquire the needed interest. Consultant shall transmit executed acquisition documents to the City.Each transmittal package shall include a fully executed and properly notarized deed(s)or easement(s),fully executed acquisition contract with attachments and a brief settlement memorandum which summarizes the pertinent data relative to the transaction. Assist City staff in preparation of Resolution of Necessity and Staff Report for City Council,including attendance at City Council. Consultant shall provide monthly reports on the status of Various acquisitions. Consultant shall complete all required aspects of the CEQAreview process for the City of Beaumont as Lead Agency,and all required aspects of the NEPA review process for Caltrans as the Lead Agency.Aspects include the completion of all relevant studies,preparation and publication of all requiredpublic notices,draft environmental documents,participation in the public review process,preparation and publication of responses to comments,preparation and publication of ?nal documents,and ?ling of all required notices. COOPERATIVE AGREEMENT BETWEEN CITY OF BEAUMONT,LOMA LINDA UNIVERSITY AND SUN LAKES COUNTRY CLUB HOMEOWNERS ASSOCIATION FOR CONSTRUCTION OF THE HIGHLAND SPRINGS AVENUE STORM DRAIN PROJECT 1.PARTIES AND DATE.This Cooperative Agreement (“Agreement”)is made and entered into this _day of September,2017,by and between the City of Beaumont,a municipa lcorporationorganizedunderthelawsoftheStateofCalifornia(“BEAUMON ”),Loma Linda University (“LOMA LINDA”)and Sun Lakes Country Club Homeowners Association (“SLCCHA”).BEAUMONT,LOMA LINDA and SLCCHA are sometimes referred to individually as “party”and collectively as “parties”herein. 2.RECITALS. 2.1 Highland Springs Avenue is paralleledby an earthen channel and culverts from approximately 200 hundred feet north of the intersection with First Street to approximately 400 feet south of the aforementioned intersection,parts of the real property and storm drain improvements are owned by BEAUMONT and parts of the same are owned by LOMA LINDA. 2.2 BEAUMONT and LOMA LINDA have jointly determined that additional storm drain improvements are desired for the aforementioned segments of land. 2.3 The improvements to the storm drain system (see Exhibit A.1 —Project Location) shall consist of undergrounding the facility,construction of needed junction structures and other necessary improvements the "Project"and LOMA LINDA has entered into a contract with a licensed contractor to construct the Project. 'I'-I.I.I-'-I 3.4.2.Prior to the commencement of construction of the Project,LOMA LINDA shall ensure that BEAUMONT,SUN LAKES COUNTRY CLUB HOMEOWNERS ASSOCLATION and BANNING and their agents;of?cers and employees are named as additional insured persons for the liability insurance coverage for the Project. 3.4.3.Ownership and title to all materials,equipment,and appurtenances installed as part of the Project will automatically be vested with the property or jurisdiction on which the improvements reside and no further agreement will be necessary to transfer ownership.That means,among other things,that SLCCHA shall be entitled to lien free title to all improvements installed on SLCCHA property. 3.4.4.BEAUMONT,SUN LAKES COUNTRY CLUB and LOMA LINDA shall each defend,indemnify and hold the other party and its of?cials,of?cers,employees,consultants ,subcontractors,volunteers and agents free and harmless from any and all claims,demands ,causes of action,costs,expenses,liability,loss,damage or injury,in law or equity,to property or persons,including wrongful death,to the extent arising out of or incident to any negligent acts, omissions or willful misconduct of the indemnifying party or its of?cials,of?cers,employees, consultants,subcontractors,volunteers and agents arising out of or in connection with the construction of the Project including attorney’s fees and other related costs and expenses . 3.4.5.Notwithstanding anything to the contrary,this Agreement does not constitute an admission of liability by BEAUMONT,LOMA LINDA or SLCCA with regards to any ?ooding or other damage to the property of SLCCA or any homeowner within the Sun Lakes Country Club.Further,SLCCA,BEAUMONT and LOMA LINDA all agree to release and hold harmless one another from and against any costs,expenses,liability or damages to persons and property or liability related to or arising from the previous action of water or ?ooding from the channel and culverts on Highland Springs Avenue. 3.4.6.This Agreement may be executed in one or more counterparts.When a counterpart shall have been signed by each party hereto,each shall be deemed an original,but all of which constitute one and the same instrument. 3.4.7.This Agreement‘contains the entire Agreement of the parties with respect to the subject matter hereof and supersedes all prior negotiations,understandings or agreements.This Agreement may only be modi?ed by a writing signed by both parties. 3.4.8.The parties declare that each party has all requisite power and authority to conduct its business and to execute,deliver,and perform the Agreement.Each party warrants that the individuals who have signed this Agreement have the legal power,right,and authority to make this Agreement and bind each respective party. 3.4.9.If any portion of this Agreement is declared invalid,illegal,or otherwise unenforceable by a court of competent jurisdiction,the remaining provisions shall continue in full force and effect.
