Included in this review, which is discussed below, are recommendations regarding changes that the Board and Commission may want to consider to better protect Brewster's ponds. Board of Health Re ulations Under Massachusetts General Laws, Boards of Health are responsible for disease prevention and control and health and environmental protection. Boards of Health administer state regulations for the departments of Public Health and Environmental Protection. State laws (MGL Chapter 111, Section 31) also provide Boards of Health with the ability to adopt more stringent local regulations to better address local conditions provided that proper public discussion procedures are followed. Brewster currently has six iocal Board of Health regulations: Water Quality Report, Septic System Inspection/Maintenance Program., Real Estate Transfer, animal prohibition on public beaches, Animal Regulations, and leaching facility set back to a water course. The most pertinent of the local regulations for pond protection are discussed below: a. Water Quality Report (effective 1115188) This regulation requires development projects with Title 5 flows of greater than 2,000 per day or with residential densities greater than one unit per acre to prepare a Water Quality Report. The key requirement of the regulation is that the report must, in part, "demonstrate that no significant impact to water resources will occur as a result of the project, and that the nutrient contribution of the proposed project, when added to the existing and potential nutrient level of other developments and acreage within the specific File: BREregulatoryreviewPonds 1 of 5 recharge area will not result in nutrient levels that exceed the receiving water's critical eutrophic level." Specific requirements for lakes and ponds are detailed including phosphorus loading factors and a critical eutrophic level of 0.02 mg/l (20 µg11} total phosphorus. b. Leaching facility set back to a water course (amended 7121187) This regulation requires septic system leachfields to be located beyond 100 feet from ponds and lakes. c. Animal Regulations (last revision effective date 11127192). This regulation includes requirements about drainage and waste disposal for farm animals and poultry. Among the requirements are provisions to place barns, coops, and manure piles at,least 100 feet from wetlands. I Real Estate Transfer (last revision effective date 8111195) This regulation details inspection steps to be taken to bring older septic systems up to current regulations when a property changes ownership. Discussions and Recommendations The regulation requiring the Water Quality Report provides good framework for protection of pond ecosystems. The Town may want to consider revisions to this regulation and the others discussed above to better incorporate pond -specific information that has been developed in the last few years, to provide a more cohesive set of regulations, and to address single family residences, which are the primary source of the water quality impacts observed in Brewster's ponds. The requirement to develop a Water Quality Report begins by understanding whether a proposed project is within a pond watershed. From discussions with town staff, only a handful of ponds have watersheds delineated. As a result of groundwater models newly developed by the US Geological Survey, watersheds or contributing areas to Brewster's ponds could be developed to facilitate the review of projects. By providing these watersheds rather that requiring their delineation by applicants, the town could create greater regulatory certainty for the development community. Using the water quality data that has been developed for many of Brewster's ponds in the last few years could also provide additional certainty. This information could be used by the town to determine which ponds have exceeded the "critical nutrient level" described in the regulation. Through the efforts of volunteer monitors and free laboratory services from Cape Cod National Seashore and. the School of Marine Science and Technology at the University of Massachusetts -Dartmouth, water quality data has been collected from more than 25 ponds in town. This water quality data also presents the town with the opportunity to identify pond specific critical levels rather than using the generalized limit currently specified in the regulation. This effort would require combining this data together with physical data about the ponds and determining which ponds already have water quality problems, those that might have problems in the future based on buildout potential, and those that are unlikely to have water quality problems given existing zoning and land use patterns. Getting a better understanding of the pond -specific critical levels would also allow the town to begin to understand options that may be available to improve the water quality in the ponds that are above their critical levels. The Water Quality Report regulation only applies to larger developments. If the town developed management options and an understanding of water quality concerns for each of the individual ponds that have been monitored, the town could use an amended version of the real File; BREregulatoryreviewl'onds 2 of 5 estate transfer regulation to specify management activities for all types of development within specific pond watersheds. Better understanding of each pond's condition would also allow the town to consider modifying the 100 ft leachfield setback for select ponds or specifying appropriate shoreline uses based on slope and condition of the pond. Finally, the town should consider revising the waste disposal requirements in the animal regulation. Allowing uncovered manure piles 100 ft from wetlands, including ponds or estuaries, represents a significant potential nutrient source that could mostly be addressed if these piles were required to be covered by a simple roof. This requirement could also be revisited following the review of individual ponds. Conservation Commission By -Law and Regulations The Conservation Commission administers the local provisions of the state Wetlands Protection Act (MGL Chapter 131, Section 40). In order to complete its responsibilities, the town has approved a by-law and subsequent regulations to help implement the by-law. Any activities on or within 100 ft of various resource areas, including ponds and lakes, must file with the Conservation Commission. In addition, any activities. beyond 100 ft judged to impact any of resource areas considered under the by-law can also be reviewed by the Conservation Commission. The regulation lists specific requirements for each of the resource areas considered under the by-law. The town regulation generally focuses on the land within the jurisdictional area rather than on the water. So, for example, the sections concerning ponds and lakes (Sections 2.09, 3.01, and 3.03) discuss conditions of the bank of the pond or the land under the pond. Most pertinent of these provisions for ponds is the variance provisions in Section 3.03, which requires any activity under review "shall not impair..ground and surface quality; and the capacity of said land to provide breeding habitat, escape cover and food for fisheries." In large part, this provisions means that the Conservation Commission must decide what constitutes an "impairment" of water quality. Maintenance of existing structures is specifically allowed. Discussions and Recommendations Given the proceeding discussion of using the available water quality data to develop management strategies for specific ponds, this type of effort could also be used to better define "impairment" within the context of the Conservation Commission regulations. If a pond is already impaired, activities within its watershed have the potential to further impair it. The Conservation Commission may want to consider water quality offsets for any activities within watersheds to such ponds; for example, activities that add nutrients would have to be offset by activities that remove equivalent or greater quantities. The Conservation Commission may also want to consider using existing bylaw provisions to assert jurisdiction over all activities within these watersheds, not just those within the 140 ft area. Another factor that the Commission may want to review is the role of water level fluctuations in determining the jurisdictional area. In the definitions of an inland bank (Section 3.01(2)(c)), bordering land subject to flooding (Section 3.04(2)(a)(3)), and isolated land subject to flooding (Sections 3.04(2)(b)(1) and 3.04(2)(b)(3)) there are a number of parameters that aright be better determined through the use of the Cape's High Groundwater Methodology (Cape Cod Commission's Technical Bulletin 92-001). Because of the sandy soils on the Cape, water in depressions is usually a reflection of the water table; depressions are filled higher when water levels are high and they become dry or only minimally filled when water levels drop. Application of the High Groundwater Method to shallow depressions within reasonable File; BREregolatoiyreviewPonds 3 of 5 groundwater fluctuation zones would allow the Conservation Commission to, identify areas that might be a concern. Application of the method would also allow the Conservation Commission to rely on a proven tool rather than relying on infrequent observations or year-to-year recharge fluctuations. Finally, Section 1.03(b) of the town's regulation prohibits leaching facilities within the 104 ft jurisdictional area "unless the applicant can demonstrate that there will be no alteration of the ground or surface water, .. and no adverse impact upon any of the interests specified in the By-law..." This provision is consistent with the Board of the Health setback requirement and would require consultation between the two boards to provide the alternative -setbacks discussed above. Subdivision Rules and Re lationslZonin The Planning Board administers local subdivision rules and regulations under provisions in the state Subdivision Control Law (MGL Chapter 41, Section 81K through 816G). In these local regulations there are provisions for design of road buffer ships, sewage assessments, stormwater designs, and general environmental assessments. These regulations generally apply to any -subdivision of land provided that appropriate subdivisions did not occur previously. Of particular pertinence to protection of ponds are the provisions in the regulations requiring the submittal of an "Environmental and Community Impact Analysis" for developments with the potential of creating 10 or more lots (Chapter 294-10(A)(8)) or 8 or more commercial lots. This Analysis, the details of which are described in the regulation, is similar to the Board of Health's Water Quality Report, but more comprehensive. The Analysis is required to detail "all primary and secondary environmental and community impacts, both beneficial and adverse, anticipated as a result of the proposed development." Use of lots is determined by town Zoning Bylaws (Chapter 179 of Brewster Town Code). Included among the zoning provisions is a section designating a Wetlands Conservancy District. This district mirrors the resource areas addressed under the Conservation Commission by-law and regulations and allows development within these areas subject to a special permit procedure. The special permit is issued in consultation with the Conservation Commission. Another special permit process in the Zoning Bylaws is the provision for Planned Residential Developments. Compact residential developments are encouraged by this section and it includes submittal of information that essentially mirrors the Environmental and Community Impact Analysis required in the Subdivision Rules. Discussions and Recommendations The Zoning Bylaws appear to replicate many of the provisions of the Subdivision Bylaw and regulations and Conservation Commission regulations, and a more limited portion of the local Board of Health regulations. The Environmental and Community Impact Analysis is targeted at larger developments, likely with the thought that impacts associated with smaller developments have already been evaluated. Given the water quality of some of the ponds and the extent of development in the town, it would appear that smaller developments and existing developments should be addressed to improve water quality. SUMMARY Brewster already has a number of existing regulations and by-laws in place that could be modified to better protect the water quality in the town's ponds. However, it is recommended that a first step in considering any modifications should be an evaluation of the water quality data Pile. BREregulatoryreviewPonds 4 of 5 available from the citizen monitoring combined with delineations of watersheds and other physical features of the ponds. Last April, I presented a review of 2001 and 2002 water quality data to the town's pond monitoring volunteers. Data at that time showed that 8 of the 26 ponds monitored had significant impairinents and 18 of the 26 exceeded impacted thresholds. These findings suggest that whatever changes contemplated for the town's regulations and by-laws should include some components to address impacts from existing development. This also reinforces the need to review management options within both the watersheds and the ponds to discern whether regulatory changes are the most cost-effective option for improving and protecting pond water quality and how extensively existing development will need to be addressed. Related to this evaluation is the opportunity to review the phosphorus limit (20 ggll total phosphorus) used in the Board of Health's Water Quality Report regulation. Data from all the ponds sampled during the 2001 PALS snapshot suggests that the appropriate Cape Cod phosphorus limit is between 7.5 and 10 µg/l. Preliminary review of the 2002 and 2003 PALS Snapshot data again suggests that the limit is lower than used by the Board of Health, but further suggests that there may be differences between limits for shallow and deep ponds. Reviewing Brewster"s water quality data may provide an opportunity to detail pond-specific phosphorus limits or a set of depth-dependent limits for Brewster's ponds. Although a town-wide water quality evaluation is recommended to address the impacts of existing development, future development will potentially worsen conditions in the already impaired and impacted ponds. Many of the protective measures conventionally recommended for ponds have become standard management practices; these include providing adequate natural shoreline buffers and appropriate setbacks for septic system leachf elds. Shoreline buffers are a function of the slope; the steeper the slope, the greater the opportunity for runoff and nutrients to enter ponds. Conservation Commission regulations provide the opportunity to require any permitted activities along the banks of ponds to offset impacts; with an identification of impacted ponds, the Conservation Commission could consider formal no-net nutrient additions and/or requirements to improve water quality. Septic system leachfield setbacks are somewhat more problematic. The County's Regional Policy Plan recommends a 300 ft setback for leachfields, but many properties, especially existing properties, are not long or deep enough to fully accommodate this setback. The 300 ft setback recommendation carne from the federal Clean Lakes Program based on the capacity of sandy soils to bind phosphorus. Evaluation of phosphorus movement in sandy soil has shown, however, that it is generally a question of time before phosphorus throughout a watershed will reach a pond; the leading edge of phosphorus from a septic system moves approximately 1 meter per year (Robertson, et al., 1998). Based on this movement, it would take approximately 91 years for septic system phosphorus to move 300 ft. The current 100 ft setback required by the town's Board of Health, Conservation Commission, and Zoning by-laws and regulations would be traversed in about 30 years. It is reconunended that the town consider altering the regulations to require the 300 ft setback, but allow a variance procedure to provide theemaxiffi& rTeasible setYack with a minimum setback of 100 ft. This recommendation could be modiE far: specific ponds once the eva uatron o pon water quality is completed. The above recommendations will require development of modified wording for the existing regulations. The CCC issued its report in Januaxy of 2004 and, as part of its recommendations, urged the Town to consider adopting regulations which would require a 340 foot setback from all ponds -within the town, but to allow a variance procedure providing for a maximum feasible minimum setback of 100 feet. Several weeks ago, we were provided with some draft language for some proposed changes to existing Board of. Health regulations in order to address this issue and were asked to review the same. This letter is written. in response to your inquiry. The first proposed change is to the existing Leaching Facility Set Back to a Water Course regulation, originally adopted on December 18, 1970 and amended on July 21, 1957. This regulation presently reads, as follows: "In accordance with Massachusetts General Laws, Chapter 111, Section 31, the Board of Health adopts the following regulation: "All leaching facilities of a sewage disposal system shall not be located or installed less than 100 feet from a watercourse including streams, open and subsurface drains, fresh or saltwater marsh land, and inland and coastal banks, as defined by the Town of Brewster Wetland Protection Bylaw." ZISSON AND VEARA Ms. Ice December 14, 2004 Page 2 The new language is proposed to be added to the end of this regulation, as follows: "All leaching facilities of a sewage disposal system associated with newly developed property shall be located or installed more than 300 feet from ponds' as defined by the Brewster Wetland Protection Bylaws. Leaching facilities of an existing sewage disposal system within 300 feet shall be considered substandard at the time of a real estate transfer and replacement leaching facilities shall be located 300 feet from the pond or lake, unless lot configuration or other factors prevent this setback from being attained; in these cases, the maximum feasible distance from the pond or lake shall be determined by the Board of lIealth or its director." In my opinion, this proposed language generally achieves the purpose of providing for a 300 foot setback to ponds or lakes (i.e., ponds or lakes as distinct from streams, open and subsurface drains, fresh and saltwater marsh land, and inland and coastal banks which are governed by the existing paragraph of this regulation), as outlined by the CCC report of January of 2004. The Board may want to consider re -naming the regulation, as it now governs not only watercourses, but additional water bodies, as well. Inaddition, there are several,which concern me and which should be further addressed before this regulation is adopted, First, the proposed language may conflict with the first paragraph in situations where the top of an inland bank is very close to the water's edge of the pond or lake itself. In some situations, an inland bank can rise for several feet (sometimes hundreds of feet) before it reaches its top. In those cases, the top of the inland bank (governed by the first paragraph of your regulation), sits in a different physical location than the pond or lake. In other situations, the inland bank is short and lies directly adjacent to the water of the pond or lake. In the latter situations, the first paragraph of this regulation would conflict with the proposed language. The first paragraph would dictate that the leaching component be 100' from the inland bank, whereas the next paragraph requires a separation of 300'. If the inland bank and edge of pond or lake are in the same location, there will be a conflict between these two provisions. This inconsistency needs to be remedied. I would suggest consulting with the Conservation Commission before we attempt to resolve this problem. Second, the phrase "a sewage system associated with newly developed property" is a bit vague. It is not clear to me whether the Board of Health intends this language is to include only neve development on previously vacant land or whether it is intended to include new development on previously developed land (i.e., an addition on a house that increases the design flow to the existing system). This analysis is somewhat along the lines of "new construction" under the Title 5 provisions. The term "new construction" under Title 5 does not simply refer to ' The words "or lake" should be added here to provide consistency for the rest of- this fthis regulation and for the Real Estate Transfer Regulation. Z[SSON AND VLARA Ms. Ice December 14, 2004 Page 3 new buildings, but also to any increase in the design flow above the "approved capacity." Thus, under Title 5, even though you are not adding any new development, if you are increasing the use of an existing structure such that the design flow rises to above the approved capacity, that is considered "new construction" for purposes of Title 5. I notice there is a definition for "developed property" in the Read Estate Transfer Regulations, that regulation would not carry over to this one without a direct reference. The Board of Health should determine whether it wants this new regulation to apply ons to development on previously undeveloped property, or whether it want this new language to apply more broadly, and then revise the above -quoted phrase more precisely to reflect that intent. Depending upon what the intent is, I will be happy to suggest language for this purpose. The third issue that concerns me relative to the above -quoted language is the fact that it imposes a 300' setback for "newly developed property" with no variance mechanism. While a variance mechanism is provided for "leaching facilities for of an existing sewage disposal system," no parallel provision is provided for "newly developed property." This is of concern because it may result in rendering a currently vacant, otherwise buildable lot, unbuildable by virtue of the new regulation. In other words, there may be a lot of sufficient square footage that it is buildable for zoning purposes, but it may be very narrow and, therefore, there may be no location on the property that is 300' from the pond. Under these circumstances, a regulatory taking might result. Therefore, I recommend that this -proposed language be revised to provide for a variance for all situations, and not simply those related to "existing sewage disposal systems." This 'issue maybe addressed by placing aperiod after the words "pond or lake" in the fifth line of the proposed language and then replacing the remaining language with the following . sentence: "If the setbacks required by this regulation cannot be attained due to lot configuration or other factors, the leaching component shall be located at a maximum feasible distance from the pond or lake as determined by the Board of Health or its director." The proposed additional changes to the Real Estate Transfer Regulation also appear to generally achieve the objective of requiring a 300 foot setback to ponds or lakes. The first of the proposed changes is contained in Section 1.4 of the regulations, a section defining "marginal systems." The neve language identifies a "system located within 300 feet of a pond or lake" as being a "marginal system." There are three problems with this language. First, the Leaching Facility Set Back to a Water Course Regulation identifies such systems as being deemed "substandard," not "marginal." Moreover, under the Real Estate Transfer Regulations, marginal systems are subject to further review before they are considered a public health threat. The definition for "substandard" states that a system is substandard if it does not conform with Title 5 or local board of health regulations and, as such, must be upgraded automatically. As the Board is changing the local Leaching Facility Set .back to Water Course ZISSON AND VLARA Ms. Ice December 14, 2004 Page 4 Regulation to contain the 340' setback requirement, if a leaching component is within 300'. of a pond, it would be in violation of this local regulation and, as such, under the Real Estate Transfer Regulation, automatically deemed "substandard." Therefore, I do not believe it is necessary to include the language proposed under Section. 1.4. Even if it were necessary to add the language, I do not believe it is appropriate under the definition section for "marginal system." In addition, the proposed language for Section 1.4 states that "systems" within 300' are considered marginal. The Board's objective, as I understand it, is to have the "leaching component" set back 300 feet, not the entire "system." In any event, if I understand the intent of the Board correctly, I -do not believe the proposed language for Section 1.4 is necessary and my recommendation is that the ezitire provision -should be deleted. The second proposed revision to the Real Estate Transfer Regulation appears in "Section V, Instructions, Subsection 5.8." It states, as follows: "5.8. If the inspection reveals that the sewage disposal system leaching facility or facilities are located within 300 feet of a pond or lake, then the leaching facility or facilities shall be deemed substandard and must be upgraded to comply with [Title 5 and local Board of Health regulations]." Generally, this regulation is fine as written, however, I have an overriding concern with the entire Real Estate Transfer Regulation in that I do not see a general variance mechanism included for situations where compliance is not feasible. While there are specific exceptions to exact compliance listed in Section IV of this regulation, there is no general variance. As such, there is no variance mechanism provided for the new setback provision. This should be included in order to avoid a situation wherein a regulatory taking claim could be made. Therefore, I recommend that the following sentence be added to this new Section 5.8, similar to the language suggested above for the other regulation: "If the setbacks required by this regulation cannot be attained due to lot configuration or other factors, the leaching component shall be located at a maximum feasible distance from the pond or lake as determined by the Board of Health or its director." Having suggested the variance language for both provisions, I must note that the words "other factors" concern me as the phrase is very broad. This phrasing was taken from the original proposed language in the Leaching Facility Set Back to Water Course Regulation. If possible, the Board of Health should be more precise as to what it means by "other factors." This language opens the door for arguments that cost and financial constraints should be considered as "other factors" and I do not believe this is what the Board of Health intended. This concludes my specific comments relative to the proposed changes to the Leaching Facility Set Back to Water Course Regulation and the Real Estate Transfer Regulation. There are many other comments that could be made relative to these regulations as a whole, as well as, the other four (4) regulations which together comprise the Brewster Board of Health Regulations. All new and replacement leaching facilities of sewage disposal systems in Brewster shall be located or installed more than 300 feet from all ponds and lakes, as defined by the Town of Brewster Wetland Protection Bylaws and Regulations. S. Substandard Existing Systems. All leaching facilities of existing sewage disposal systems within 100 feet of any Surface Water or 300 feet of a Pond or Lake shall be considered substandard at the time of Real Estate Transfer and upgrades In accordance with the Real Estate Transfer Regulation shall be required. If the setbacks required by this regulation cannot be attained due to lot configuration or other factors, the leaching component shall be located at a maximum feasible distance from the surface water, pond or lake, as determined by the Board of Health. 6. New Subdivisions. New subdivisions shall be designed to accommodate the setback distances required under this regulation and no new lots shall be created unless and until it is. demonstrated to the satisfaction of the Board of Health that development on each lot can accommodate the required setback distances. Laws of Massachusetts, to better protect the Public Health of the inhabitants of the Town of Brewster, Barnstable County, Massachusetts. The effective date of this Regulation will be January 1, 1988. All deeds recorded on or after January 1, 1988 will be subject to this regulation, RFY.'TMATTOX Prior to selling, conveying or transferring the title to real property situated in the Town of Brewster and containing an existing Residential, Commercial or Industrial sewage disposal system, the Owner thereof shall have an open inspection of said system(s). The inspection shall be performed by a Massachusetts Registered Professional Engineer, Massachusetts Registered Sanitarian or DEP approved System Inspector person who: (a.) in the opinion of the approving authority is qualified to perform such inspections; (b.) has one year documented experience in satisfactorily performing such inspections; and (c.) has used or gained skills that demonstrate sufficient competence to perform such inspections. if it is determined by the Board of Health that the system constitutes a danger to the Public Health, the Board shall order the owner to make repairs or replace the system. PURPOSE To determine and to protect the Public Health from potential and present sources of pollution to ground water or,salt water from existing sewage disposal systems, the Board of Health requires that the owner(s) of a developed property in Brewster obtain an open inspection of the existing septic system prior to the time of the transfer of that property. SECTION I - DEFINITIONS Preamble - All other definitions not in this Regulation will be defined by Title 5, 314 CMR 15.01. 1.1 COMPONENT: Any septic tanks, distribution boxes and leaching facilities. W W W.BREWSTER-MA.GOV RETR Page 2 1.2 DEVELOPED PROPERTY: A parcel of laxed with a man --made structure erected upon it which has affixed to it an in-gr'o-and sewage system(s). 1.3 FAILED SYSTEM: A failed system is defined as one in which there is evidence of sewage flow to the surface; evidence of overload of the system; the system is in such a state of disrepair that it cannot function as originally intended; Lack of a four (4) foot protective zone between the bottom of the system and ground water; or any other problem as defined by the Board of Health or its Director. 1.4 MARGINAL SYSTEM: A marginal system is defined as having one or several of the following problems: The system could not be judged because of an extended period of non-use; there are problems with the individual components of the system or with the system location; records show excessive pumping three or more times within any eighteen (18) month period for residential or commercial property, except for required grease trap maintenance for commercial property; presence of visible ferric sulfide stains, the system is inadequate for intended use; system is located within 100 feet of a domestic water supply well, wetland or watercourse or any other problem defined by the Board of Health or its Director. 1.5 OPEN INSPECTION: All components of the septic system(s) attached to the existing structure(s) will be uncovered and a visual inspection conducted. 1.6 SUBSTANDARD SYSTEM: A system which does not conform to 310 CMR 15.00, the State Environmental Code, Title 5, Minimum Requirements for the Subsurface Disposal of Sewage and the Brewster Board of Health Regulations. 1.7 TRANSFER OF PROPERTY: An act by which the title of a property is conveyed from one person to another except as noted in Section 4.1, SECTION 11 -, STANDARDS 2.1 For the purpose of this Regulation, reference is made to the standards and provisions of Title 5 of the Statue Sanitary Code, and to the existing regulations of the Brewster Board of Health Regulations for Subsurface Sewage Disposal. SECTION ITT - ENFORCEMENT AUTHORITY 3,1 The Board of Health Director is authorized to issue Notices of Violation, Cease and Desist Orders, or other Administrative enforcement orders to compel compliance with the terms of these RETR Page 3 Regulations for Subsurface Sewage Disposal. 3.2 In addition to any other remedy, the Board of Health and/or its Director may take any enforcement action deemed appropriate, including but not limited to Criminal Prosecution, to seek a fine in accordance with Chapter 111, Section 31, or Civil Action in the Courts of the Commonwealth for injunctive relief or money damages or both, or Civil and Criminal enforcement. SECTION TV - EXCEPTIONS 4.1 This Regulation shall not apply to a sale under power of sale contained in a bona fide mortgage affecting the property. 4.2 This Regulation shall not apply to a sale of property having a sewage system that has been installed, repaired or replaced and which has received a satisfactory inspection report from the Health Director within twenty-four (24) months of,the Closing, provided additional living space has not been added and/or there has been no change in intended use. The date of issuance of the Certificate of Compliance will begin the twenty-four (24) months time period. A copy of the Disposal Works Construction Permit and/or other evidence, approved by the Board of Health or its Director, must be submitted in lieu of the Certificate of Inspection thirty (30) days prior to each Real Estate Transfer. 4.3 In the case of a Title 5 system, the Board of Health may waive the requirements for an inspection in appropriate cases. All requests for waivers shall be in writing. 4.4 Real Estate Transfers otherwise subject to this Regulation which take place within two (2) years of an inspection under this Regulation and found to be in good working order, may be exempt from this Regulation upon review and approval by the Board of Health or its Director. A copy of the original Certificate of Inspection Form must be submitted to the Board of Health or its Director for review thirty (30) days prior to Real Estate Transfer. 4.5 Sellers and buyers who transfer an existing structure with the intent to demolish and replace the existing system with a Title 5 system may apply to the board of Health or its Director for exemption from this Regulation. The seller and the buyer must comply together in writing showing that both parties have agreed to the arrangements and accept joint responsibility for seeing that the new system is installed. An Engineer hired by the party(s) must RETR Page 4 provide in writing that he/she has been contracted to do the plan and that a preliminary survey of the lot in question shows that a septic system in compliance with Title 5 and Town of Brewster Regulations can be installed on the lot. A proposed time frame for the demolition and installation must be submitted at the time of application. SECTION V - INSTRUCTIONS 5.1 .The Inspection by the Engineer or Sanitarian should Cake place not more than 180 days nor less than thirty (30) days prior to the transfer of property. The Board of Health must receive the Inspection Form and Certificate of Compliance within seven (7) days of the Inspection. In addition, the Engineer or Sanitarian should give copies to the Owner and to any Buyer or Broker identified with the transfer. In the event there is no buyer at the time of Inspection, copies must be given by the.Owner to the Buyer preferably before the property is put under agreement. 5.2 Establishing ground water levels; Unless exempted from this requirement by the Board of Health or its Director, septic systems or components of systems that are located below elevations of fifteen (15) feet (using USGS mean sea level datum) and/or within 100 feet of a wetland are required to have a test boring or deep observation hole dug in order to establish the ground water level. When depth to ground water has been measured it should be adjusted to reflect the adjusted depth using the procedures outlined in Estimating Highest Groundwater Levels for Construction and Land Use Plannin - A Cape Cod, Massachusetts Exa�Ie, Michael H. Frimptex and Martha N. Fisher, USGS Water Resources Investigations 83-412. 5.3 If the Inspection finds evidence of a failed system, such as sewage on the surface or sewage draining into any waterways or wetlands, the Board of Health or its Director shall determine within fourteen (14) days after receiving the Inspection Form whether or not the system constitutes a danger to the Public Health and whether and to what extent the system should be repaired or replaced. The Board of Health or the Health Director shall notify the owner by Certified Mail within seven (7) days of its determination, accompanied by any order requiring the system to be repaired or replaced. 5.4 if the Inspection finds evidence of sewage on the surface or draining into any waterways or wetlands, the Board of Health or its Director is to be notified by the Engineer or Sanitarian within RETR Page 5 twenty-four (24) hours. 5.5 If the Inspection finds the system to be "Marginal", the Board of Health or its Director shall decide within fourteen (14) days after receiving the Inspection Form whether or not the system constitutes a danger to the Public Health and whether and to what extent the system should be repaired, replaced, or be subject to further inspection as the Board or its Director deems appropriate under the circumstances. The Board of Health or the Health Director shall notify the owner by Certified Mail within seven (7) days of its determination, accompanied by any order requiring the system to be repaired, replaced or subject to further inspection. 5.6 If the Inspection reveals that the covers to the septic tank or cesspool are more than twelve (12) inches below the finished grade, the covers shall be brought up to within twelve (12) inches of the finished grade. 5.7 If the Inspection reveals that the sewage disposal system consists of a single cesspool, or cesspools, then the system shall be deemed substandard and must be upgraded to comply with 310 CMR 15.00, the State Environmental Code, Title 5, Minimum Requirements for the Subsurface Disposal of Sewage. 5.8 If the inspection reveals that the sewage disposal system leaching facility or facilities are located within 300 feet of a pond or lake, then the leaching facility or facilities shall be deemed substandard and must be upgraded to comply with 310 CMR 1.5.000, the State Environmental Code, Title 5 and Brewster Board of Health Regulations. RULE MAKING: PROCEDURES FOR MAKING LOCAL REGULATIONS Historically, legislation and regulation have been tools for translating knowledge of causes of disease and ill -health into programs for the protection of public health. Boards of health may determine that regulations are necessary to control the causes or to outline methods of dealing with a public health problem. Local regulations may not be inconsistent with state or federal regulations, but may be more stringent. Most state regulations are called "minimum standards" and local beards are authorized to make stricter standards. The process of drafting regulations usually requires collaboration between the board of health and the town counsel or city solicitor who provides or coordinates the legal expertise necessary for the proper drafting of the regulations. If the town or city employs a health officer, he/she may be asked to assume responsibility for defining and documenting the problem and drafting a proposed regulation (with the assistance of the city or town's attorney) for presentation to the board. The board then considers the issues, holds hearings as necessary, and makes the final decision. Regulations may be prospective in nature. That is, boards of health may require precautions to avoid potential dangers as well as to restrict conditions proven to be harmful. (Benes et. al.1995). M.G.L. c. 111 §31 is an unusually broad grant of authority which empowers boards of health to adopt "reasonable health regulations." The power of boards of health to adopt regulations under section 31 is extensive and "provides a comprehensive, separate, additional source of authority for health regulations" (Benes et. al. 1995). The following section is intended to assist the board in drafting regulations. Creation and General Authorizing Statutes The general structure, powers, and duties of local boards of health are found at M.G.L. c. 111 s.26-33. Boards have authority to adopt and enforce reasonable health regulations under M.G.L. c.111, s.31. Case law upholds boards' authority to adopt regulations that are more restrictive than state standards so long as the local regulations do not conflict with state law and are not specifically preempted. B. Regionalization Boards of health and municipal health departments may form regional health districts for the purpose of enhancing health services, providing efficient use of resources, and receiving certain grants. M.G.L. c. 111 s. 27A-2 Regionalization agreements are technical legal documents that need to be carefully and specifically drafted with input from counsel for each of the participating cities/towns. For example, agreements need to be specific and detailed about whether, and under what circumstances, individual cities/towns retain direction and control over their public employees even when the employees are performing duties in another town. Many other legal issues need to be addressed by city/town attorneys in regionalization agreements. Participation in a regional district requires approval from the city or town governing body as well as the participating boards of health. Page 4 Potential Brewster Board of Health Initiatives These initiatives are to be developed by the Hoard of Health in partnership with the Brewster Health Department. 1) Create Brewster Board of Health (BOH) Mission and Vision statements. Mission explains the BOH purpose for being; Vision describes what is to be achieved in long-term (i. e. 10 years). 2) Create and sustain BOH institutional knowledge as individual members with varying backgrounds and formal education continually rotate on and off the BOH. The aim is to improve the quality and consistency of service the BOH provides to both the Brewster Department of Health and Brewster residents. a. Develop and maintain a standard on -boarding process for new BOH members. b. Develop a set of in-house training modules for BOH members that address: i. routine BOH procedures, ii. foundational knowledge' about local Massachusetts BOH roles, responsibilities, and protections, and iii. technical knowledge needed to consistently and appropriately address routine issues that appear on the BOH meeting agendas. c. Create and maintain a simple training documentation and tracking system for BOH in-house training. d. Encourage professional development of BOH members so they stay informed about new or current public health developments, and identify ways to support BOH member training provided by County, State, and Massachusetts professional associations. (This training is provided with no or minimum associated costs.) 3) Incorporate team -building exercises into working meetings to provide the BOH members with a common language and tools to help BOH members better understand (and more effectively work with) each other and the Health Department. 4) Establish proactive goals and objectives that have measurable outcomes, and trach metrics, so information and performance can be easily shared with other Town of Brewster officials and Brewster residents. Suggestions include: a. Conduct a systematic review of The Legal Handbook for Massachusetts Boards of Health, 316 Edition, 2021 to compare the Brewster BOH's performance with current expectations. Identify opportunities for improvement. b. Conduct a systematic review of the 2020 Census information regarding Brewster residents, and identify specific target areas to improve the public health of Brewster residents. c. Review select Brewster BOH regulations, and conduct an assessment as to how well any particular regulation is being implemented. Identify opportunities for improvement based on findings. d. Begin to implement routine documented comparisons of regulatory templates and Brewster BOH regulations to provide historical documentation regarding decisions made, and the basis for these decisions. This will aid future Brewster BOH members and help them to understand what is in the Brewster BOH regulations and why, so future decisions can be made in a more knowledgeable and efficient manner. e. Add a place for a description of changes to the document history section of Brewster BOH regulations, so future readers can better understand what changes were made to the regulation and why. Add documented reviews of regulations even if no changes in the text were made. f.
