CALL TO ORDER Chairman Strain called the regular meeting of the Planning and Zoning Commission to order at 6:30 p.m. in the Council Chamber at City Hall, 3200 Diana Drive. Members present: Cleve Milner, Chairman Martha Strain, Curtis Whitfield, Doug Guinn, and Greg Klarich. Members absent: Marvin Barker and Ronny Region. Director of Community Development Howard Gregory was unable to attend. City Attorney Tim Sralla was absent as well. Linda Cowart served as recording secretary in Director Gregory's absence. 2. APPROVAL OF APRIL 7, 2008 REGULAR MEETING MINUTES Chairman Strain noted that Member Karich was counted absent from the February 4, 2008 regular meeting of the Planning and Zoning Commission, but was in fact present at the meeting, and therefore the minutes should be corrected as such. A motion was made by Member Guinn, and seconded by Member Milner, to approve the April 7, 2008 Regular Meeting Minute, as written. The motion carried by a vote of 5 - 0. 3. DISCUSSION AND CONSIDERATION CONCERNING AN APPLICATION FOR A SPECIAL USE PERMIT PURSUANT TO THE RICHLAND HILLS ZONING ORDINANCE, CHAPTER 90 OF THE CITY CODE, TO ALLOW A "RESTAURANT, REFRESHMENT STAND (TEMPORARY OR SEASONAL)" USE IN THE C-2 GENERAL COMMERCIAL ZONING DISTRICT, ON Printed on Recycled Paper . +ti City of Richland Hills Planning & Zoning Commission Regular Meeting Minutes May 5, 2008, Page 2 PROPERTY LOCATED AT 6980 BAKER BOULEVARD, THE LEGAL DESCRIPTION OF WHICH IS BLOCK LOT 2A, MATTHEWS SUBDIVISION, RICHLAND HILLS, TARRANT COUNTY, TEXAS A. Public hearing concerning an application for a Special Use Permit pursuant to the Richland Hills Zoning Ordinance, Chapter 90 of the City Code, to allow a "Restaurant, Refreshment Stand (Temporary or Seasonal)" use in the C-2 General Commercial zoning district, on property located at 6980 Baker Boulevard, the legal description of which is Block Lot 2A Matthews Subdivision, Richland Hills, Tarrant County, Texas. B. Consider action concerning an application for a Special Use Permit pursuant to the Richland Hills Zoning Ordinance, Chapter 90 of the City Code, to allow a "Restaurant, Refreshment Stand (Temporary or Seasonal)" use in the C-2 General Commercial zoning district, on property located at 6980 Baker Boulevard, the legal description of which is Block Lot 2A, Matthews Subdivision, Richland Hills, Tarrant County, Texas. Chairman Strain declared the public hearing to be open at this time. Applicant Lori Buswold, 7609 Richland Road, Richland Hills, stated that a Special Use Permit would allow the snow cone stand to be open again this season the same as it had been for the past three seasons, including an agreement with Birdville Independent School District to rent the property located at 6980 Baker Boulevard, an agreement with a local business to allow use of the restroom, the building would be positioned more than one hundred feet away from the back fence, and the snow cone stand would not be open during "school zone" hours. There was no one else to speak either for or against the Special Use Permit. At this time Chairman Strain closed the public hearing. A motion was made by Member Milner, and seconded by Member Klarich, to approve the Special Use Permit as stated. The motion carried by a vote of 5 - 0. 4. DISCUSSION ITEM: CHAPTER 90, ZONING City of Richland Hills Planning & Zoning Commission Regular Meeting Minutes May 5, 2008, Page 3 Due to the absence of City Attorney Sralla from the meeting, "Discussion Item: Chapter 90, Zoning" will be placed on the agenda for the next Planning and Zoning Commission meeting. 5. PERSONAL APPEARANCES (CITIZEN PARTICIPATION REGARDING NON-SCHEDULED ITEMS AFFECTING THE PLANNING AND ZONING AFFAIRS OF THE CITY) There were none. 6. COMMENTS AND REPORTS FROM THE COMMISSION Chairman Strain congratulated Ruth Milner and the Historical Society for the impressive April 26, 2008 Baker Days Celebration parade. Member Milner spoke briefly concerning the City's Code of Ordinances. 7. ADJOURNMENT There being no further business to come before the Commission, Chairman Strain declared the meeting to be adjourned at 6:50 p.m. ATTEST: M ha Strain, Chairman
