HomeMy Public PortalAboutNauset Schools -- 2021-01-28 Minutes r In It Nauset Regional School Committee - January 28 , 2021 Virtual meeting, live streamed at Eastham Town Hall Present for the Committee : Judith Schumacher, Chris Easley, Richard Stewart, Josh Stewart, Tom Fitzgibbons, Steven Leibowitz, Griffin Ryder, John O ' Reilly Present for the Administration : Thomas Conrad, Giovanna Venditti, Chris Ellsasser, James Nowack, Elaine Pender, Carol Forgione Others Present : Richard Manley, Locke & Lord LLP, Members of the Community Call to Order : Chair Easley called the meeting to order at 6 : 05 p . m . , and read the meeting notice aloud . A discussion was held on Citizen ' s Speak and the rules of the Committee . Rules can be adjusted as the Committee sees fit . The current NPS Policy on Citizen ' s Speak is 3 minutes . It was noted that the Policy states that any comment over 3 minutes can be submitted in writing to the Committee . After discussion it was decided that the Committee will move forward with the 3 minute limit on Citizen ' s Speak. Any individual alterations will be at the discretion of the Chair . Agenda Changes : None Citizens Speak: Martin Culik from Orleans read a statement to the Committee regarding the High School Building Project, the most recent Interagency Agreement with Truro and Provincetown, and the School Choice Program . Chair Easley informed the Committee that there will be Zoom forums on the Nauset High School Building Project which will include a question and answer period . Priority Business . Discussions and Vote of the Nauset Regional School District to authorize borrowing for the Proposed Addition/Renovation of Nauset Regional High School for the MSBA Project. The District is authorized to borrow said amount, under and pursuant to G.L . c. 71 Section 16 (n) and the District Agreement, as amended , or pursuant to any other enabling authority. Judy Schumacher read the Motion aloud . MOTION : That the Nauset Regional School District (the "District") hereby appropriates the amount of One Hundred Thirty-One Million Eight Hundred Twenty-Five Thousand Six Hundred Sixty-Five Dollars ($ 131 , 825 , 665 ) for the purpose of paying costs of renovating and adding to Nauset Regional High School, located at 100 Cable Road, North Eastham , Massachusetts, including the payment of all costs incidental or related thereto (the "Project") , which school facility shall have an anticipated useful life as an educational facility for the . instruction of school children for at least 50 years , and for which the District may be eligible for a school construction grant from the Massachusetts School Building Authority ("MSBA") , said amount to be expended at the direction of the School Building Committee . To meet this appropriation the District is authorized to borrow said amount, under and pursuant to G . L . c . 71 , § 16 (n) and the District Agreement, as amended, or pursuant to any other enabling authority . The District acknowledges that the MSBA ' s grant program is a non- entitlement, discretionary program based on need as determined by the MSBA, and any Project costs the District incurs in excess of any grant approved by and received from the MSBA shall be the sole responsibility of the District ; provided Nauset Regional School Committee, January 28, 2021 1 ( P a g e further that any grant that the District may receive from the MSBA shall not exceed the lesser of ( 1 ) forty-three and thirty-nine hundredths percent (43 . 39 %) of eligible, approved Project costs , as determined by the MSBA , and (2) the total maximum grant amount determined by the MSBA , and that the amount of borrowing authorized pursuant to this vote shall be reduced by any grant amount set forth in the Project Funding Agreement that may be executed between the District and the MSBA . Any premium received upon the sale of any bonds or notes approved by this vote, less any such premium applied to the payment of the costs of issuance of such bonds or notes , may be applied to the payment of costs approved by this vote in accordance with G . L . c . 44 , § 20 , thereby reducing the amount authorized to be borrowed to pay such costs by a like amount . If the District were to receive an MSBA grant in the amount of 43 . 39 % of eligible , approved Project costs , it is anticipated that the net principal amount of this debt allocable to each member town of the District, exclusive of interest, would be approximately as follows . Member Approximate Member Approximate Town Amount Town Amount Brewster $453830 , 225 Orleans $ 185157 , 605 Eastham $ 18 , 871 ,224 Wellfleet $ 12 ,290 , 135 The debt authorized by this vote of the Committee shall be submitted to the registered voters of the District' s member towns for approval at a District-wide election to be held on March 30 , 2021 in accordance with the provisions of G.L . c . 71 , § 16 (n) . The warrant calling the District-wide election to be held on March 30 , 2021 , in the form presented to this meeting, is hereby approved, with such changes as bond counsel to the District shall approve prior to its posting . " Josh Stewart made a motion to amend lanune in the above, and withdrew the motion . Steve Leibowitz made a motion to amend the sixth line of the Motion to read : life as an educational facility for the instruction of school children for at least 50 years ; John O ' Reilly seconded the motion to amend The amended motion passed unanimously via Roll Call Vote 7 -0 to approve the amended lanaual4e. Judy Schumacher made a motion to approve the amended motion as written , Tom Fitzgibbons seconded the motion, and it was voted unanimously via Roll Call Vote 7 -0 to approve the motion as amended . Adiournment: It was moved by Judy Schumacher , seconded by Josh Stewart and voted unanimously via roll call vote 7- 0 to ad ' ourn at 6 : 45 PM.
