HomeMy Public PortalAbout19-01RESOLUTION 19-01 A RESOLUTION BY THE CITY COUNCIL OF CRESTVIEW, FLORIDA ACCEPTING A PETITION FOR OUT -OF -CITY WATER SERVICE; ESTABLISHING WATER SERVICE FOR PROPERTY LOCATED AT 2997 APLIN DRIVE AKA 21-3N-23-2320-000A-005B, OKALOOSA COUNTY, FLORIDA; ALLOWING FOR WRITTEN OBJECTIONS BY CITIZENS; AND, IF NECESSARY A PUBLIC HEARING WITHIN 30 DAYS FROM ENACTMENT OF THIS RESOLUTION; PROVIDING FOR A MUNICIPAL SERVICES AGREEMENT BETWEEN THE PETITIONER AND CITY; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, Chapter 90 of the Crestview City Code and F. S. 180.01 et. seq., provides for methodology to provide out -of -city water and sewer service to petitioners of record; and WHEREAS, John L. Greely and wife, Arlene Greely, property owners, of the parcel described in the Warranty Deed recorded in Official Records Book 3370 page 2337, of the Public Records of Okaloosa County, Florida, and being identified by Parcel Tax I.D. 21-3N-23-2320-000A-005B, located at 2997 Aplin Road, Okaloosa County, Florida, uttered a petition for water service and said petition was received by the City on October 4, 2018. WHEREAS, petitioner has entered into a Municipal Services Agreement with the City at the appropriate time recited in the City Code, as the requested service is available. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF CRESTVIEW, FLORIDA IN REGULAR SESSION ASSEMBLED THAT: 1. The City of Crestview hereby concludes that the Subject Property is within the water service territory of the City. At this time, the property is not contiguous to the Limits of the City of Crestview, and therefore does not meet the qualifications for annexation. 2. The water concurrency and availability is sufficient on behalf of the City to meet the demands of the petitioner as provided for in the Crestview Comprehensive Plan. 3. A 30-day period from enactment of this resolution is provided for protest to ascertain whether or not a public hearing is required. 4. The petitioner has executed a Municipal Services Agreement and has paid all fees associated with the cost of providing water pursuant to this resolution.
