CALL TO ORDER Chairman Strain called the regular meeting of the Planning and Zoning Commission to order at 6:30 p.m. in the Council Chambers at City Hall, 3200 Diana Drive, Richland HiIIs,Texas. Members present: Cleve Milner, Chairman Martha Strain, Curtis Whitfield, Ronny Region, and Kellie Starnes. Members absent: Greg Klarich and Doug Guinn. Staff in attendance: Director of Community Development Howard Gregory and City Attorney Tim Sralla. 2. APPROVAL OF JULY 7, 2008 REGULAR MEETING MINUTES A motion was made by Member Region, and seconded by Member Whitfield, to approve the July 7, 2008 Regular Meeting Minutes, as presented. The motion carried by a vote of 5 - 0. 3. DISCUSSION AND CONSIDERATION CONCERNING AN APPLICATION FOR A PROPOSED AMENDMENT TO THE RICHLAND HILLS ZONING ORDINANCE, CHAPTER 90 OF THE CITY CODE, TO DO THE FOLLOWING: (1) CHANGE THE CLASSIFICATION OF CERTAIN PROPERTY LOCATED AT 7410 BOULEVARD 26, 4151 WILLMAN AVENUE, AND 4159 WILLMAN AVENUE, RICHLAND HILLS, THE LEGAL DESCRIPTION OF WHICH IS BLOCK 2, LOTS 7, 8, 9, AND 10, WILLMAN ADDITION OF THE CITY OF RICHLAND HILLS, IN Printed on Recycled Paper City of Richland Hills Planning & Zoning Commission Regular Meeting Minutes August 4, 2008, Page 2 TARRANT COUNTY, WHICH PROPERTY IS CURRENTLY ZONED AS A PLANNED UNIT DEVELOPMENT, BY AMENDING THE BOUNDARIES, REGULATIONS AND USES PERMITTED IN SUCH PLANNED UNIT DEVELOPMENT, AND (2) TO CHANGE THE CLASSIFICATION OF CERTAIN PROPERTY LOCATED AT 7265 VIVIAN LANE, RICHLAND HILLS, THE LEGAL DESCRIPTION OF WHICH IS BLOCK 2, LOT 11, WILLMAN ADDITION OF THE CITY OF RICHLAND HILLS, IN TARRANT COUNTY, WHICH PROPERTY IS CURRENTLY ZONED AS THE C-2 GENERAL COMMERCIAL ZONING DISTRICT, TO ADD IT TO THE PLANNED UNIT DEVELOPMENT REFERENCED ABOVE. A. Chairman Strain opened the public hearing. Roger Duck, owner of Boulevard 26 Storage and Business Center, stated he requested some changes to the City's Zoning Ordinance to expand allowed uses in order to facilitate a variety of businesses that would hopefully be attracted to the Boulevard 26 Storage and Business Center, and also the addition of 7265 Vivian Lane into the Planned Unit Development. There was no one to speak either for or against the application. Chairman Strain noted that Richard Hatch, 7235 Vivian Lane, expressed opposition to the rezoning by email to the City. At this time Chairman Strain closed the public hearing. A motion was made by Member Whitfield, and seconded by Member Region, to amend the City of Richland Hills Zoning Ordinance, Chapter 90 of the City Code, to do the following: 1. Change the classification of certain property located at 7410 Boulevard 26, which is 4151 Willman Avenue, and 4159 Willman Avenue, Richland Hills, the legal description of which is Block 2, Lots 7,8, and 9 to allow any business that is now allowed under the existing Richland Hills Land Use Table, under the headings, any use in the existing C-2 zoning, under "Commercial, Retail, and Service" uses, and any use existing under "Professional" uses, as permitted in C-2. Further, that Lot 10, Willman Addition of the City of Richland Hills, in Tarrant County, which property is currently zoned as a Planned Unit Development, by amending the boundaries, regulations and uses permitted in such Planned Unit Development. • a City of Richland Hills Planning & Zoning Commission Regular Meeting Minutes August 4, 2008, Page 4 2. Change the classification of certain property located at 7265 Vivian Lane, Richland Hills, the legal description of which is Block 2, Lot 11, Willman Addition of the City of Richland Hills, in Tarrant County, which property is currently zoned as the C-2 Commercial Zoning District, to add it to the Planned Unit Development referenced above, to allow for "RV and Boat Storage and Truck Rental" use. Member Whitfield then amended the motion to exclude the portion of Lot 10 that now has an existing building on it, so the existing Planned Unit Development would still be enforced and adopt the site plan which would incorporate the six foot high masonry engineered panel fence, wrought iron gates, a sixteen foot high stucco parapet wall on the east elevation, along with the other items shown on the site plan, and prohibit truck parking on the front of the building along Boulevard 26, and designating or restricting truck parking to the six southernmost parking spaces on the east side of the building outside of the gate and inside the gated area. The motion carried by a vote of 5 - 0. 4. DISCUSSION ITEM: CHAPTER 90 "ZONING" City Attorney Sralla indicated that his staff had finished the review of Chapter 90 and were ready to schedule a workshop with the Planning and Zoning Commission. 5. SCHEDULE CHAPTER 90 "ZONING" WORKSHOP A workshop was scheduled for Monday, August 25, 2008 to discuss Chapter 90 "Zoning" and the findings of the City Attorney's office. 6. PERSONAL APPEARANCES (CITIZEN PARTICIPATION REGARDING NON-SCHEDULED ITEMS AFFECTING THE PLANNING AND ZONING AFFAIRS OF THE CITY) There were none. 7.
