BOARD OF PUBLIC WORKS AND SAFETY OF THE
CITY OF RICHMOND. INDIANA.
JANUARY 20. 1994
1 The Board of Public Works and Safety of the City of Richmond, Indiana, met in regular session on Thursday,
2 January 20, 1994, in said City. Earnest Jarvis presided with Janet Hibner and Dennis Grimes in attendance.
3 The following business was had to-wit:

5 APPROVAL OF MINUTES OF JANUARY 13.1994

7 The minutes of the previous meeting were approved on a motion by Hibner, second by Grimes and carried on a
8 unanimous voice vote.

10 APPROVAL OF CLAIMS FOR PAYMENT

12 Claims submitted by the City Controller for payment totaled $731,063.51, most of which was for payroll and
13 payroll taxes. Grimes moved to approve the claims, second by Hibner and the motion was carried on a
14 unanimous voice vote.

18 A. Hibner introduced requests for handicapped parking by Second Presbyterian Church at 310 North
19 19th Street and Joyce McKenley for Edna Meyers on South 3rd Street. Noting that both had been
20 reviewed by the Traffic Safety Division she moved to approve the requests, second by Grimes and the
21 motion was carried on a unanimous voice vote.

23 B.Grimes read a request from Shannon Pennell at 1014 North 24th Street for a guard rail at the side of
24 the road near her home. Grimes said the house is close to the intersection of North 24th Street and
25 Hawkins Road. He read the review of the Traffic Safety Division noting the house is located 40 feet
26 north of Hawkins Road and 100 feet east of the curve and there is a concrete post and wooden
27 telephone pole along the road between the curve and the house that most vehicles would hit before
28 running into the house. Grimes moved to accept the recommendation of the Traffic Safety Division and
29 deny the request, second by Hibner and the motion was carried on a unanimous voice vote.

35 OTHER MATTERS

37 A. Jarvis announced that he had received a call from an employee of Kemper indicating a parking
38 problem in the area and had placed the matter on the agenda. However, he said the employee was
39 unable to appear today and he suggested the request be held until the January 27 meeting.

41 B. Hibner read the Board's finding on the grievance of Firefighter Scott Simmons, noting that the
42 grievance had been denied on the grounds that the complainant failed to show the denial of
43 reimbursement was based in any way upon activity on behalf of membership in the union nor did the
44 complainant show the chief's decision was based in any way upon the complainant's race, creed,
45 religion, national origin, sex or age. It was noted that Chief Sticco's refusal of out of pocket expenses
46 was done within the bounds of his managerial discretion and should not be overridden by the Board nor
47 interpreted by the Board so as to fall within the scope of the prevailing rights clause of the contract.

49 second by Grimes and the motion was carried on a unanimous voice vote.

51 PUBLIC COMMENTS

53 Jerry Purcell, president of Local 1408 Richmnd Professional Firefighters, expressed his disappointment in the
54 Board's findings. He said he felt this interpretation of the Firefighters education benefits is a step backwards for
55 both the City and the Firefighters. He said it will discourage fire-related education in the future and does not
56 benefit either party. Jarvis responded that the Board had nothing against furthering education within the
57 Firefighters group or any place else in the City.
