HomeMy Public PortalAbout11-24-1993 l OZ BOARD OF PUBLIC WORKS AND SAFETY OF THE CITY OF RICHMOND, INDIANA, NOVEMBER 24, 1993 1 The Board of Public Works and Safety of the City of Richmond, Indiana, met at 9 a.m. Wednesday, November 2 24, 1993, in the Municipal Building in said City. Chairperson Janet Hibner presided with Earnest Jarvis in 3 attendance.Dennis Grimes was absent.The following business was had to-wit: 4 5 6 APPROVAL OF MINUTES OF NOVEMBER 18.1993 7 • 8 The minutes of the previous meeting were approved on a motion by Jarvis, second by Chairperson Hibner and 9 carried on a unanimous voice vote. 10 11 12 CLAIMS FOR PAYMENT 13 14 Claims were submitted by the City Controller's office for$856,386.20 which Chairperson Hibner read. She noted 15 that included in the total was $25,138.72 to Contractors United Inc. for contractual services; $39,819.70 for 16 water for the public fire service; $69,011.70 to Richmond Power & Light for street lights; and the remaining 17 balance for payroll and payroll taxes. Chairperson Hibner moved to approve the claims, second by Jarvis and 18 the motion was carried on a unanimous voice vote. 19 20 REQUESTS 21 22 A.The first request for handicapped parking read by Jarvis was tabled because the space requested by 23 Leo Stanley on North 20th Street is on private property. The motion was made to table the request, 24 second by Chairperson Hibner and it was carried on a unanimous voice vote. Jarvis read the request 25 by Barbara Seiber who resides at 1213 North C Street, noting that it posed a problem in that her 26 residence is on the south side of North C Street which is one-way west and there is no off-street 27 parking at the rear of the residence. Jarvis moved to accept the recommendation of the Traffic Safety 28 Division that the handicapped parking space be placed across the street at 1212 North C Street, 29 second by Chairperson Hibner and the motion was carried on a unanimous voice vote. The third 30 request made by John Bricker was to ask for a space in the front of the residence of his sister-in-law 31 32 who he transports to and from occasionally and also delivers items to on South 9th Street. Referring to a map attached to the report from the Traffic Safety Division which noted there is a yellow curb beyond 33 the walkway to the house to the corner which Bricker could use for that type of short-term parking, 34 Jarvis moved to deny the request for a handicapped parking space but to authorize the use of space at 35 the yellow curb for short-term parking by Bricker, second by Chairperson Hibner and the motion was 36 carried on a unanimous voice vote. 37 38 B.A request for Children At Play signs in the 300-400 block of South 6th Street was read by Jarvis who 39 noted that in a report submitted by Captain.Danny McClure of the Traffic Safety Division it was pointed 40 out that there are adequate sidewalks, a park close by and a school yard.The report further stated that 41 if such signs would be posted it would possibly carry the message that children would be allowed to 42 play in the street.Jarvis moved to deny the request based on that information, second by Chairperson 43 Hibner and the motion was carried on a unanimous voice vote. 44 45 C. Chairperson Hibner noted that an extensive survey of the parking problem at the Community Church 46 of the Cross at 100 North 9th Street had been completed. She said the original request was to allow 47 clergy and staff parking on North 9th Street and she explained that it was not a policy of the City to 48 permit that sort of parking and this Board had no authorization by ordinance to allow it. She noted that 49 at the last meeting there was concern about whether or not parking should be allowed in the alley. She 50 said a letter dated November 18 had been received from Police Chief Dennis Rice in which he stated 51 no parking should be allowed there. She said all of the Board and others involved had either 52 individually or collectively visited the site and it was made very clear after a graphic demonstration that 53 there is no space in the alley to park. Russ Brockman of the Sanitary Division of the Department of 54 Public Works, told Board members that he was especially concerned about getting the trucks through 55 the alley in the winter when it is covered with snow and ice. Chairperson Hibner moved to deny the 56 request adding that more of the curb be painted yellow to allow room for turning west off of Ninth Street 57 into the alley,second by Jarvis and the motion was carried on a unanimous voice vote. 58 59 D. Jarvis read a request from Judy Michael, manager of the newly opened Leland Hotel, to make the 60 alley east of the building one way north. He read a letter from the Traffic Safety Division in which 61 Captain McClure said he had no objections to the request. Jarvis asked the two sanitation workers in 62 the audience if they felt that move would create any problems for the sanitary trucks and after some 63 comments it was decided to hold the request until the next meeting of the Board on December 2 when 64 a report could be given. 65 Board of Works Minutes Cont'd November 24, 1993 Page 2 1 CONTRACTS 2 3 None were presented. • 4 5 OTHER MATTERS 6 7 A. Chairperson Hibner noted that she had received a curb cut/driveway petition submitted by Richard 8 Robinson at 1303 South 3rd Street and it had been cleared through all the City departments. She 9 moved to approve the request, second by Jarvis and the motion was carried on a unanimous voice 10 vote. 11 12 B. Chairperson Hibner submitted the fire prevention report for October 1993 which she recommended 13 be filed for the record. 14 15 PUBLIC COMMENTS 16 17 Jarvis commented about a meeting earlier in the year which the Board had with TCI where the franchise fee was 18 questioned as to whether it was legal or an authorized type of fee. He said he had attended the Indiana 19 Association of Cities and Towns confernce in Evansville where he, the Mayor and the City Clerk, sat in on a 20 meeting specifically geared for cable TV discussion. He said they listened to two experts who were attorneys 21 who handle cable business for the city of Indianapolis discuss the issues. He said he asked the question about 22 the franchise fees and was told that the 5 percent cost is to be shown on the bill and can be passed on to the 23 users of the cable. He said, based upon that information, that the City is not in control of this issue since it is 24 federally mandated. Chairperson Hibner add that under the FCC regulations citizens who have complaints and 25 wish to file them with the FCC may do so on a 329 form which is available in the Department of Law in the City 26 Building.Jarvis said those complaints could also be taken care of through the Telecommunications Council. 27 28 ADJOURNMENT 29 30 There being no further business, on a motion duly made seconded and passed and carried on a unanimous 31 voice vote,the meeting was adjourned. 32 33 34 35 36 37 38 39 Janet Hibner, Chairperson 40 41 42 43 44 45 46 ATTEST: 47 Norma Carnes,City Clerk 48 49 50 51 52 53 54 55 56 57 58 59 60 61 62 63 64 65 "
