1 The Board of Public Works and Safety of the City of Richmond, Indiana, met at 9 a.m. Thursday, August 5,
2 1993, in the Municipal Building in said City. Chairperson Janet Hibner presided with Earnest Jarvis and Dennis
3 Grimes in attendance.The following business was had to-wit:

7 The minutes of the July 29, 1993 meeting were not available for approval.

9 CLAIMS FOR PAYMENT

11 Claims submitted by the City Controller's office were for$263,490.52 which included $18,023.50 as a progress
12 payment for the South 6th Street sidewalk, $19,167 for an automatic sprinkler system as part of the street
13 division garage renovation, $25,338 for police radio equipment, $100,000 for health insurance claims and
14 $20,899.11 to WCTV as a capital improvement commitment through the TCI franchise agreement. Grimes
15 moved to approve the claims for payment, second by Jarvis and the motion was carried by a unanimous voice
16 vote.

18 REQUESTS

20 A. Two new requests for handicapped parking spaces for Steve Cochran at 1112 Butler Street and
21 Marcella Glunt at 327 Richmond Ave. were approved through a motion by Jarvis, second by Grimes
22 and carried by a unanimous voice vote.

24 B. Grimes read a request from Stuart and Susan Jay of Webster on behalf of the Hoosier Corners
25 Square Dance Club to post a 2' by 11/2' foot sign on the traffic island at South West 1st and Hub
26 Etchison Parkway to direct the more than 175 couples coming into the City from areas such as
27 Cincinnati and Dayton,Ohio, Fort Wayne and South Bend for a special square dance at the Richmond
28 High School cafeteria from 2 to 5 p.m. August 29, 1993. After reviewing the request the Traffic Safety
29 Division recommended the sign be placed on a separate post rather than on an existing one. Susan
30 Jay, who is publicity officer along with her husband, Stuart, told the Board they would be happy to
31 comply with the Traffic Safety Division's recommendation.Grimes moved to approve the request for the
32 temporary sign,second by Jarvis and the motion was carried by a unanimous voice vote:.

34 C. On a motion made by Jarvis, second by Grimes and carried by a unanimous voice vote the Board
35 approved the request for the removal of the sidewalk immediately west of the First Christian Church
36 and to replace it with asphalt to make it a part of the South 10th Street parking lot.Jarvis reported that
37 the project had been inspected by the City's engineering department which recommended approval.

39 D. Chairperson Hibner read a request for a parade permit for the Richmond High School Homecoming
40 Parade at 6:30 p.m. Thursday, September 30, which will start at the Municipal Pool at North West 13th
41 Street and end on Hub Etchison Parkway. The request made by Lara Shank, chairperson, also asked
42 for police escort. Captain Danny McClure said theTraffic Safety Division had no objections, noting that
43 this an annual event and the escorts will be provided. Chairperson Hibner moved to approve, second
44 by Jarvis and the motion was carried by a unanimous voice vote.

46 CONTRACTS

48 A. In his request for the Board's approval of the City's contract with the Richmond Police Department,
49 Otto Meuser, Director of the Department of Administration, noted that the City's police officers have
50 something in common with those in New York City commonly referred to as "New York's finest. " He
51 said he had learned,after 45 years of experience in negotiating contracts,that labor negotiations do not
52 have to be either controversial or adversarial,which, he added,speaks well for the police as well as the
53 firefighters and bus drivers. Steve Brown, chairman of the Fraternal Order of Police bargaining
54 committee, said that his group felt the 5 percent salary increase was an acceptable offer for 1994 and
55 approved it after a majority vote July 30. The contract runs through 1995 with wages negotiable.
56 Chairperson Hibner moved to approve the signing of the agreement,second by Grimes and the motion
57 was carried by a unanimous voice vote. She commended those sitting in on the negotiations for coming
58 to a quick resolution.

60 B. In his second appearance before the Board, Meuser reported that negotiations had resulted in a
61 contract with the bus drivers, noting the procedure had been one of a professional nature. Chairperson
62 Hibner moved to enter into the agreement which represented an increase in salary and wages for
63 another year,second by Jarvis and the motion was carried by a unanimous voice vote.

1 C.Grimes opened bids for base widening and resurfacing of North West 5th Street submitted by Barrett
2 Paving and Contractors United Inc. Both bids contained 16 different items with separate dollar amounts
3 for each.The total bid by Barrett Paving was for$35,258.55 and CUI's bid was for$37,947.80.Grimes
4 moved to take the bids under'advisement, second by Jarvis and the motion was carried by a
5 unanimous voice vote.

7 D. Reporting on the awarding of the bid for new buses for the City's transit system, Grimes said bid
8 packets were sent out six to eight weeks ago. Returning bids were Midwest Transportation Sales,
9 Merchanthouse Transportation and Kerlin Bus Sales which included bids for both 1993 and 1994
10 chassis. The bids were reviewed by Grimes, Purchasing Manager Vicki Stevens, Transportation
11 Division Manager Kent Haisley and Roseview Transit Operating Manager Terri Quinter. Grimes said
12 that timing'on the bids was such that it was at the end of the model year of 1993 and bidders indicated
13 that they were either unable to acquire 1993 chassis or were uncertain if they could. He explained that
14 the bid from Kerlin Bus Sales for 1993 chassis at $47,775 was nonresponsive due to lack of track
15 seating, and moved to reject the bid, second by Chairperson Hibner and the motion was carried by a
16 unanimous voice vote. Midwest Transportation Sales, with a bid of $44,521, noted they would have a
17 problem with acquiring the 1993 chassis and would have to pass on an additional cost for 1994 chassis.
18 Grimes said the City could not accept such an open ended bid and would have to have a more
19 definitive cost. He moved to reject the bid, second by Jarvis and the motion was carried by a
20 unanimous voice vote. That action left the Kerlin bid of $45,902 for the 1994 chassis and the
21 Merchanthouse bid of $46,031. Grimes said that through communication with Merchanthouse it was
22 learned that there would be difficulty in obtaining the 1993 chassis and there would be an additional
23 cost for the 1994 chassis.Therefore, he moved to accept the Kerlin bid for the three turtletop taratransit
24 1994 buses as the lowest and most responsive, and responsible, second by Jarvis and the motion was
25 carried by a unanimous voice vote.

27 MOVING PERMIT FOR EARLHAM COLLEGE

29 Jarvis read a request from Earlham College to move a house from 620 National Road West to 310 College
30 Avenue to make room for a new building in conjunction with another school on the campus. He reported that the
31 request had gone through the proper channels and that Anderson Movers from Alexandria had acquired the
32 required insurance certificate and would be doing the moving, scheduled for sometime between August 9 and
33 August 13.Jarvis moved to approve,second by Grimes and the motion was carried by a unanimous voice vote.

35 CONTINUATION OF THE ALARM SYSTEM HEARING FOR K MART WEST

37 Noting that she had received a letter Friday, July 30, from Tom Cole, manager of K mart West, Chairperson
38 Hibner explained the.background of the hearing to date.. She said that K mart West had an alarm violation
39 hearing with this Board April 15 after several alarm violations, resulting in the decision not,to revoke their alarm
40 permit. However,since the new alarm permit period which began March 9,there had been seven violations and
41 representatives had failed to appear at the hearing scheduled for the July 29 meeting. A spokesperson for K
42 mart West, who did not wish to identify herself, said she wished she had known;about this situation earlier, to
43 which Chairperson Hibner responded that the notification letter,for which she had proof that it had been mailed,
44 was delivered July 15, 1993, and had been signed by B. Thompson. Therefore, she said, K mart had been
45 propertly notified. The K mart representative•explained that Cole had been called out 'of town due to his
46 daughter's emergency surgery.

48 She said the alarm system is'a fairly new one and other stores who have the same ADT system are also having
49 problems. She;added that when the alarms went off in February it was found that the magnets were loose,
50 causing the shorts to occur. Chairperson Hibner summariezed the letter from Cole in which he noted the
51 citations on April 13 and April 16 were due to electrical storms in the area. And, on April 24, a door was not
52 properly locked in the garden shop. He mentioned that the letter of notification,was not found until considerably
53 later. Chairperson Hibner commented on the fact that a week's worth of alarms occurred in April then none
54 occurred until several.in July, which caused her to suspect the alarms may have been turned off. The'K mart
55 spokesperson said that was not true. Chairperson Hibner explained that the ordinance does require'a response
56 within 10 days as to the cause of the alarm going off, and said K mart West had not responded to any of them
57 nor to the prior ones in the last hearing. Brian Kissick,operations manager at K mart West;said the system there
58 is monitored by Silent Watchman and transferred to ADT, but the new system will go direct to ADT.Jarvis asked
59 if K mart East had the same system to which Kissick responded in the negative.

61 Prior to making a motion to revoke the alarm permit held'by K mart West, Chairperson Hibner explained the
62 Board's responsibility in these matters, adding that she understood the company is trying to find the problem.
63 Before making his second to the motion, Jarvis asked Chairperson Hibner if, when K mart West thinks the
64 system is repaired, can they reapply? She answered that to do so, they will need to show what conditions have
65 been met and what remedies have been put in motion. She said that the Richmond Police Department will

1 continue to respond if an alarm sounds but it will mean that K mart West will be operating without a permit and

that carried a$100 fine for each false alarm. The motion and second were carried by a unanimous voice vote.
Chairperson Hibner added that K mart West will receive the official notice of the action taken by the Board by
4 certified mail.

6 OTHER MATTERS

8 Sgt.Janice Passmore of the Police Traffic Safety Division said she wanted to remind drivers to drive safely and
9 abide by the traffic laws, noting that the department is intensifying its efforts against speeders. She said 60
10 citations have been issued for speed and seat belt violations in the past few weeks. She added that she and her
11 fellow officers are out there for the citizens'protection.

13 Chairperson Hibner said continual complaints and letters are being received about dogs running loose. Quoting
14 the ordinance on this matter, she said "the owner shall keep his dog under restraint at all times."She reminded
15 everyone that there is a fine for not complying with the ordinance and added that the cooperation of all pet
16 owners would be appreciated. She said there is a continual increase in the number of dogs running loose and
17 creating problems for others. In answer to a question by Jarvis,Chairperson Hibner said dogs without tags which
18 are picked up by the animal control officer are taken to the HELP the Animals Shelter. These dogs are not
19 released until the owner shows proof of proper immunizations and registration.
