INDIANA.JULY 15. 1993 1 The Board of Public Works and Safety of the City of Richmond, Indiana, met at 9 a.m.Thursday, July 15, 1993, 2 in the Municipal Building in said City. Chairperson Janet Hibner presided with Dennis Grimes and Earnest Jarvis 3 in attendance.The following business was had to-wit: 4 5 6 APPROVAL OF MINUTES OF JULY 1 AND JULY 8.1993 7 8- The minutes of the meetings of July 1 and July 8, 1993, were approved on a motion by Jarvis, second by 9 Grimes and carried on a unanimous voice vote. 10 11 12 CLAIMS FOR PAYMENT 13 14 Claims were submitted by the City Controller's office for$657,660.93 primarily for payroll and payroll taxes, and 15 $257,859.19 which included $177,779.22 for police and fire pensions, and $75,181.11 which included $75,000 16 for health insurance claims. Grimes moved to approve the claims, second by Jarvis and the motion was carried 17 by a unanimous voice vote. 18 - 19 REQUESTS 20 21 A.Jarvis read a request from United Way of Whitewater Valley requesting a permit to distribute United 22 Way awareness stickers and solicit donations from 9:30 a.m. to 5 p.m. Saturday, October 9, 1993, at 23 several intersections. In its review of the request the Traffic Safety Division suggested suitable 24 locations be found on private property for this solicitation.Jarvis noted that it has been the policy of the 25 Board in these kind of matters in the past to deny any request interrupting traffic flow on the City streets 26 but it has no problem with it being held on private property. Jarvis recommended the request be held 27 until either Elaine Saylor or another United Way representative could appear before the Board. 28 Chairperson Hibner instructed City Clerk Norma Carnes to notify Ms. Saylor to request her presence at 29 the Board's next meeting. 30 31 B. A request from Gene Spicer, director of Townsend Community Center, for the closure of the 1100 32 Block of North I Street from 3 to 8 p.m. Saturday,August 21, 1993,was read by Grimes who noted the 33 request included a note to be reviewed by the Fire Department. Grimes noted the request would be 34 given to the Fire Department for review and brought back before the Board's next meeting. 35 36 C. Requests for handicapped parking spaces were read by Jarvis and included those from R. Bailey 37 Baker at 225 South West 3rd Street, Maxine Brumley at 205 North 5th Street, Kristi Dillon at 123 38 Richmond Avenue, Howard Farley Sr. at 316 South 13th Street, Thomas D. Mong at 404 North 17th 39 Street and Letha Saylor at 200 South 12th Street, all renewals, and Van Bentley at 224 North 17th 40 Street and Dennis Hatfield at 226 North 17th Street, both new.Jarvis moved to approve the requests, 41 second by Grimes and the motion was carried by a unanimous voice vote. 42 43 D. Chairperson Hibner brought to the Board's attention a petition signed by 54 residents in the Kinsey 44 Street area noting their concern about the speeding traffic and trucks on Kinsey Street.They requested 45 stop signs be placed on Kinsey, noting that Pearl, Lincoln and Randolph already have such signs, and 46 signs reading"No Heavy Trucks", and signs limiting the speed to 20 m.p.h.The petition was presented 47 to the Traffic Safety Division for further evaluation and the issue will be addressed at the Board's next 48 meeting. 49 50 CONTRACTS 51 52 A.A public hearing was held for determination of the highest and best use for the sale of four tracts of 53 real estate to an abutting landowner. Chairperson Hibner noted the requirement in the Indiana Code 54 which requires if the city is going to sell land to abutting landowners it has to be properly advertised in 55 the newspaper 10 days in advance. She noted the advertisement appeared in the Palladium-Item July 56 5.The parcel of land is around 810 Indiana Avenue and the adjoining property owners.are Horace G. 57 and Nica Jean Kellam, Harold and Constance Williamson, Charles Butler and Robert and Pauline 58 Lichtenfels.She read Resolution No.6-1993: j 59 60 61 "Be it hereby resolved by the Board of Public Works and Safety that since parcels numbered 029-06519-00 and 029-06539-00 on the Wayne County Auditors Transfer Book for Richmond 62 Corporation, containing a total of 9.94 acres, had an assessed valuation of zero in the most recent 63 assessment, and since said acreage was transferred to the City by Johns-Manville Products 64 Corporation for the nominal consideration of one dollar by Deed Record 374,page 547,Wayne County, 65 Indiana, on September 16, 1974, and since it has been the scene of illegal dumping'of refuse and debris for nearly twenty years, and since said acreage is of no public use and is in fact a considerable problem because of its present condition, Board of Works Minutes Cont'd July 15, 1993 Page 2 1 "Now,therefore, having published notice identifying said acreage and signifying its intent to sell said • 2 acreage in four tracts to four abutting landowners, it is hereby determined pursuant to Indiana Code 3 36-1-11-5 (b)that the highest and best use of said four tracts is the sale thereof to abutting landowners 4 for the nominal consideration of one dollar per tract and that the Mayor of the City of Richmond execute 5 the four Quit-Claim Deeds attached hereto accomplish the transfer of title to the respective grantees for 6 one dollar each." 7 8 After reading the resolution aloud, Chairperson Hibner asked for comments either for or against the 9 resolution. Hearing none, she asked for comments by Board members.Jarvis said he made a personal 10 visit to the site which has been used as a dumping ground for concrete debris and cinder residue left 11 over from the boilers at Johns-Manville. He-noted that it is going to be a beautiful site when the future 12 owners get through with their plans. Chairperson Hibner moved to sign the resolution, second by 13 Grimes and the motion was carried by a unanimous voice vote. 14 15 CONTRACTS 16 17 A. Grimes said two out of the six different contractors asked to present bids for Phase II of the street 18 paving responded. He said the legal advertisement appeared July 2 and July 9 in the Palladium-Item. 19 The bid from Barrett Paving was 70 cents per gallon for tackcote, No. 12 surface at$19.06 per ton and 20 No. 11 binder at$21.42 per ton.The bid from Contractors United was 70 cents per gallon for tackcote, 21 No. 12 surface at $18.68 per ton and No. 11 binder at $21.65 per ton. Jarvis moved that the bids be 22 taken under advisement, and that the street division manager and engineering department review them 23 with the purchasing manager and make a recommendation to the Board, second by Grimes and the 24 motion was carried by a unanimous voice vote. 25 26 B. Grimes said bid packets for three mid-size transit buses were submitted to 10 prospective bidders 27 and four were returned. The bid packet from Kerlin Sales & Bus Leasing contained a bid for a 1994 28 turtletop transit tara mid-sized bus for&unit price of$45,902.A second bid, also from Kerlin,was for a 29 1993 Challenger for a unit price of $47,775, bringing the total amount for three to $143,325. Both bids 30 had delivery dates of 90 days after the receipt of the purchase order. The bid from Merchanthouse 31 Transportation Sales was for a Diamond VIP 2500 bus with a unit price of$46,031 which amounted to 32 $138,093 for three. And, the bid from Midwest Transit Equipment of Kankakee, Ill. was for a 1993 Ford 33 E350 Senator BS-25 at a unit price of $44,521 for a total of$133,563 for.three. Jarvis moved that the 34 bids be. taken under advisement, and that the transportation manager, Roseview manager and 35 purchasing manager, review them and make a recommendation to the Board, second by Grimes and 36 the motion carried by a unanimous voice vote. 37 38 CURB CUT PETITIONS 39 40 A.Jarvis read a request by Jean Krupa at 529 S.W. 16th St.which had a stipulation made by the City's 41 engineering department stating that the gutter must remain and more backfull is required in the road 42 and the side of the proposed drive and all water from the improvements must flow into the inlet.Jarvis 43 moved to approve with those stipulations as stated, second by Grives and the motion was carried by a 44 unanimous voice vote. 45 46 B.A request by Keith Hodgkin at 3041 East Main Street was read by Jarvis who noted that it contained 47 comments from the City departments.:The Engineering Department stated that there is a steep slope 48 and drainage of:the lot will be critical.,A drainage plan must be submitted to the engineering division.A 49 curb must be placed between the parking drive and the next drive south at 3112 Southeast Parkway. 50 The Planning Department noted that the proposed use requires special use approval by the Planning 51 Commission and.Common Council adding that the drainage site and landscaping plans follow special 52 use district ordinance requirements: And; inspectors in the Department of Law said conditions must 53 provide extensive site grading to allow handicap access to the building.Jarvis recommended approval 54 with the,above stipulations,second by Grimes and the motion was carried by a unanimous voice vote. 55 56 OTHER MATTERS 57 58 Fire prevention reports for May and June were accepted into the record through a motion by Grimes, second by 59 Chairperson Hibner and carried by a unanimous voice vote. 60 61 ADJOURNMENT 62 63 There being no further business, on a motion duly made seconded and passed and carried on a unanimous 64 voice vote,the meeting was adjourned. 65 Janet Hibner, Chairperson ATTEST: Norma Carnes, City Clerk
