INDIANA.APRIL 15.1993 1 The Board of Public Works and Safety of the City of Richmond, Indiana, met at 9 a.m.Thursday,April 15, 1993, 2 in the Municipal Building in said City.Chairperson Janet Hibner presided with Earnest Jarvis and Dennis Grimes- 3 in attendance.The following business was had to-wit: 4 5 APPROVAL OF MINUTES OF APRIL 8.1993 6 7 The minutes of the April 8, 1993, meeting were approved on a motion by Jarvis, second by Grimes and carried 8 by a unanimous voice vote. 9 10 CLAIMS FOR PAYMENT 11 12 Claims were submitted by the City Controller's office for $423,192.24 which included $200,428.96 for medical 13 insurance claims and $39,819.70 for water for the fire hydrants. Grimes moved to accept the claims,second by 14 Jarvis and carried by a unanimous voice vote. 15 16 REQUESTS 17 18 A. Mary Farris appeared before the Board representing the Townsend-Norwood Neighborhood Center 19 which is going to have its opening day ceremonies Saturday,April 17, 1993. She withdrew the request 20 made at the April 8 Board of Works meeting for the closing of North 12th Street between North H and 21 North I streets for a block party.She said Mayor Cornett will participate in the ribbon cutting ceremonies 22 beginning at 2 p.m. Grimes moved to take no action on the street closure request, second by Jarvis 23 and carried by a unanimous voice vote. 24 25 B. Chairperson Hibner read a request by Mary Walker of the Wayne County Convention Bureau for the 26 placement of banners on light poles located on North A, South A, North and South 10th Streets and 27 North and South 5th Streets in conjunction with the Richmond Area Rose Festival's theme, "Richmond 28 Celebration 93 and the Grand Marshal theme of "A Century of Progress." The request also indicated 29 that the banners would remain on the poles from mid May to the end of October and asked the Board's 30 approval to display them not only in 1993 but also in 1994 and 1995.Written information from Walker 31 32 that RP & L had been contacted about the use of the facility's poles was accompanied by a letter of agreement signed by General Manager Irving Huffman. Chairperson Hibner made a motion to approve 33 the request for only the year 1993, noting that if a charge is made by RP & L the Wayne County 34 Convention Bureau would be responsible for payment and added a further recommendation that the 35 Bureau consult the Traffic Safety Division so as not to obstruct the traffic lights with the signs, second 36 by Jarvis and carried by a unanimous voice vote. 37 38 C. A request by Susan Lane and Wilda L. Jones, respresenting the Earlham Environmental Action 39 _Committee at Earlham College, for a noise permit from 12:30 to 6 p.m. Saturday, April 17, 1993, was 40 read by Jarvis. The event, as stated in the letter, will take place on the patio on the east side of the 41 cafeteria where student bands, artists and musical performers will be appearing and is in conjunction 42 with Earlham's Earth Week.Jarvis moved to approve the request, second by Grimes and carried by a 43 unanimous voice vote. 44 45 D.Jarvis read a request by Lowell Nesbitt of 245 South West 3rd Street for the renewal of a permit for 46 a handicapped parking space in the front of his residence. Nesbitt appeared before the Board 47 explaining that although he has a garage at the rear of his home it is not adequate for the parking of a 48 large vehicle. Jarvis moved to approve the request, second by Grimes and carried by a unanimous 49 voice vote. Before leaving the lecturn Nesbitt suggested to the Board that directories be placed at the 50 entrance of each block on the Promenade stating what businesses are located there.Jarvis noted that 51 the suggested was an excellent one and encouraged Nesbitt to contact Tom Bivens, interim director of 52 Main Street, noting that the group which is located at the Design Center is currently involved in plans 53 for the renovating of the Promenade. 54 55 E.Grimes read a request by the committee in charge of the Richmond High School Junior/Senior Prom 56 for the placement of luminaries from 9 to midnight on Saturday,April 24, 1993,from St. Paul's Lutheran 57 Church east along South A and on South 22nd and South 23rd streets. Board members voiced their 58 concerns over placement of the luminaries, monitoring and the removal after the event. Chairperson 59 Hibner stated that the Board had granted an earlier request by the committee for the closing of South 60 23rd Street during the Prom. Grimes suggested that the luminaries be placed around Test Field and 61 Test Middle School, noting that the request did not indicate that the committee had asked for the 62 approval of the school for the placement of the luminaries. Chairperson Hibner agreed with Grimes, 63 adding that she felt that luminaries should not be placed in front of the properties of homeowners. 64 Agreeing with both Chairperson Hibner and Grimes, Jarvis said he felt the luminaries should be on 65 private property, not on city streets. Hibner suggested that the luminaries be placed around Test Field and the school adding that the committee should seek school approval and will be responsible for the placement and removal as well as the monitoring of the luminaries throughout the three-hour period. Grimes so moved, second by Jarvis and the motion was carried by a unanimous voice vote. • Board of Works Minutes Cont'd April 15, 1993 Page 2 • • • 1 ALARM VIOLATION HEARING 2 3 In explaining the reason for the alarm violation hearing concerning K mart West, Chairperson Hibner 4 gave background information on the burglary and robbery alarm stystems which are regulated by the 5 City and for which permits are required. She noted that Richmond Code 120.01 F defines fa se alarms 6 as any event in which a police response was the result of an external alarm and no intrusion or 7 evidence of attempted entry existed. She added that the Code states specifically that there are no 8 exceptions. She explained that an alarm system is any system that summons the police department. 9 Answering a question by Jarvis, she said the fire alarm portion of the Code is a more recent 10 amendment and had some slightly different provisions. 11 12 As a further explanation, Chairperson Hibner said the Code also requires that any time there is a false 13 alarm in which police have been called and find no apparent reason for the alarm, they leave a notice 14 for the permit holder who is supposed to respond to the City Attorney's office within 10 days as to why 15 the alarm occurred.A further provision is that upon a fourth alarm violation within a six-month period,a 16 notice of intent to revoke the alarm system permit be issued to the permit holder and at the ame time 17 the Board of Works holds an administrative hearing to see if the permit should be revoked. 18 19 Chairperson Hibner said the alarm permits are administered through the Department of Law here her 20 responsibilities lie.She informed the Board that K mart West had six false alarms from January through 21 March and had failed to respond in writing to any of the numerous notices sent by her deparcnent. She 22 added that after receiving notification of the hearing she did receive a response from K mart West on 23 April 2,acknowledging the false alarms as well as giving the dates and reasons for them which included 24 the recent remodeling and a thunderstorm.The letter contained an apology for the false alar s,stating 25 that it was felt that"all the bugs"had been worked out of the new alarm system. 26 27 The issue at hand,Chairperson Hibner explained,was whether or not the alarm system at K mart West 28 should be revoked. She said there had been no false alarms since March 9, 1993, and K mart West 29 had renewed its permit which was not due until April 30. 30 31 Chairperson Hibner moved against revoking the alarm permit, with the stipulation that; the new 32 six-month period begin from the date of the last false alarm on March 9, 1993, second by Jarvis and 33 carried by a unanimous voice vote. 34 35 CONTRACTS 36 37 A.Grimes opened the five sealed bids received for the contract for the 1993 aggregate and bituminous 38 materials, passed them along to Chairperson Hibner who announced that all the papers werie in order 39 and handed them to Jarvis who read the amounts.Those submitting bids were Stonehenge ravel Co. 40 Inc. and Stonehenge Concrete Co., Barrett Paving Materials, Contractors United Inc., American 41 Aggregates and Ernst Enterprises. Grimes moved to take the bids under advisement, secon by Jarvis 42 and carried by a unanimous voice vote. 43 44 OTHER MATTERS 45 46 A. Jarvis moved to accept a report for March 1993 submitted by the Richmond Police Dep ment for 47 filing in the City Clerk's office, second by Grimes and carried by a unanimous voice vote. 48 49 PUBLIC COMMENTS 50 51 Geneva Allen, member of Common Council, appeared before the Board to inquire about the contents of a letter 52 she had received from Paul Miller, chairperson of the Telecommunications Council. She said she felt that the 53 subject needed to be pursued. Chairperson Hibner advised Allen that the subject will be a matter of discussion 54 by the Board at a future date. Jarvis assured Allen that the Board has every intent of supporting the 55 Telecommunications Council and when the matter is brought to the Board's attention, members will take a good, 56 hard look at it and attempt to get some proper answers. 57 58 ADJOURNMENT 59 60 There being no further business, on a motion duly made seconded and passed and carried on a unanimous 61 voice vote,the meeting was adjourned. 62 63 64 65 Janet Hibner, Chairperson ATTEST: Norma Carnes, Clerk
