Minutes ~j 5 February 28, 2005 Mon1hIy Wor1<shop Page 1 of4 Minutes Approved: March 14, 2005 Town & of HiY~ gh - MINUTES Board of Commissioners Monthly Workshop Monday, February 28, 2005 -7:30 p.m. Town Barn The Hillsborough Town Board held a monthly Workshop on February 28,2005 at 7:30 PM in the Hillsborough Town Barn. Present for the Workshop were Mayor Joe Phelps, and Commissioners Eric Hallman, Brian Lowen, Frances Dancy, and Evelyn Lloyd. Absent from the meeting was Commissioner Michael Gering. Staff present were Town Manager Eric Peterson, Assistant Town Manager/Public Works Director Demetric Potts, Town Clerk Donna Armbrister, and Planning Director Margaret Hauth. 1. Open the Workshop . 7:34:19 PM Mayor Joe Phelps opened the workshop . 2. Agenda Changes & Agenda Approval 7:34:30 PM Mayor Phelps stated that Item 6 has been removed from the Agenda at the request of the Hampton Pointe Developers and will be heard at a later meeting. 7:34:50 PM The Mayor added to the Agenda a discussion of the proposed meeting with Economic Development Commission, the Chamber of Commerce, and the Tourism Board as Item 9.A. 7:35:28 PM By consensus, the Board approved the printed Agenda to include the aforementioned changes. 3. Updates from Mayor & Board on Key Committees/Issues 7:35:47 PM Commissioner Hallman reported that Robin Barnhill, Director of OCIM, has requested he pass on to the Town Board Members and the Mayor an invitation to participate in the upcoming Crop Walk on April3rd. Ms. Barnhill stated that 5% of the monies raised goes to Meals on Wheels. . . . Minutes February 28, 2005 Monthly WorlIshop Page2of4 Minutes Approved: March 14, 2005 56 7:36:34 PM Commissioner Dancy reported that she had attended the TJCOG Planning Retreat last Wednesday. One of the issues she is proposing to the COG is for them to make everyone aware of the rising cost of water, not only in our area, but all over. 7:37:55 PM Commissioner Lowen reported on the 250th Anniversary Celebration Committee activities stating that they are making the final arrangements for the April 10th Parade at 3 :00 PM. He also stated that the entire Board is invited to be in the Parade. 7:40:12 PM Commissioner Hallman reported that there is currently nothing going on with the Transportation Advisory Committee that affects Hillsborough. 4. Update from Parties Involved Regarding the Waterstone Drive Right-of-way/Road Access Matter 7:46:23 PM Cyrus Hogue addressed the Board and stated that both parties attorney's are working at this time to come to an agreement. 7:48:16 PM Peter Henn agreed with Mr. Hogue's statement and thanked the Town Board for their efforts to get the parties involved communicating. 5. Consider Approving Motion of Intent to Use Eminent Domain to Acquire Land Necessary to Construct Waterstone Drive Near N.C. Highway 86 7:50:29 PM Mayor Phelps presented information that the Town Attorney had prepared on the Motion of Intent to Use Eminent Domain. 7:52:15 PM Town Manager Eric Peterson stated that since the negotiations seem to be moving forward, approving this Motion will just be an insurance policy. If the motion is approved, and deemed later not to be necessary, the Board would just withdraw the motion. 7:53:39 PM The Manager stated that the Board does need to identify an amount of compensation to be put into the Motion. 8:01 :45 PM Upon a motion by Commissioner Lowen, seconded by Commissioner Hallman, the Board moved to table this Item to a Special Meeting on Monday, March 7, 2005 at 7:30 PM by a vote of 4-0. The motion was declared passed. 8:08:57 PM Peter Henn addressed the Board and stated that the Trump Group proposes to modify the Waterstone Master Plan to permit a different mixture of residential dwellings while maintaining the total approved number of residential units and the total approved amount of non- residential development within the Waterstone Project There will be no increase in the number of approved dwellings, nor decrease in the amount of approved non-residential development based upon these proposed modifications to the Waterstone Master Plan. . . . Minutes - February 28, 2005 Monthly WOI1lshop Page 3 of4 MInutes Approved: March 14, 2005 57 Peter Henn distributed a background analysis for converting Parcel 6 of the Waterstone Master Plan from Multi-Family to Single-Family and maintaining the approved number of residential units within the Waterstone Project for the Board to review for their April Board Meeting. 6. Discuss Impervious Surface Limits at Hampton Pointe Shopping Center and the Possibility of Using Pervious Paving Materials This Item was deleted from the Agenda earlier in the meeting. 7. Discuss Possible Meeting Dates with State Representative Bill Faison 8: 19: 13 PM After some discussion, and by consensus, the Board agreed on March 31st or 24th at 7:30 PM as possible meeting dates. Town Manager Eric Peterson will run the dates past Bill Faison and get back with the Board to confirm a date. 8. Consider Approval of Eagle Scout Project on Town Land Near Lake Ben Johnston 8:22:49 PM After some discussion, and upon a motion by Commissioner Hallman, seconded by Commissioner Dancy, the Board moved to approve the Eagle Scout Project on Town Land near Lake Ben Johnston as presented by a vote of 4-0. The motion was declared passed. 9. Update from the Town Manager on the Police Chief Search 8:29:53 PM Town Manager Peterson reported that the Town has received 100 applications for the position of Police Chief and the deadline for applications is Friday, March 4th. Currently, the Town has arranged for 15 of these candidates to have a video interview. The Manager stated that the finalist candidates (approximately 4) will be invited back to Hillsborough for another day and a half of interviews and exercises. One of the assessment exercises will involve the candidates making a presentation to an audience of about 55 people as well as answering questions from the Town Manager. The audience members will be given rating/comment forms so they can share their thoughts and perceptions about the finalists. The audience will include citizens, business operators, police officers, department heads, elected officials, and the media (essentially a representation or sample of customers that the new Chief will be working with on a regular basis). To assist in helping select an audience that represents a good sample of the citizens of Hillsboro~ the Manager requested that the Mayor and each Commissioner invite three citizens to participate in this exercise. He stated that the interviews/exercise will likely take place on Thursday, April 21 51 from 6:30 PM to 9:45 PM. 8:39:09 PM Added Item on meetings with EDC, Chamber, Tourism Board Mayor Phelps suggested that any called meeting be discussed with the Town Board and at least a two week notice be given of the meeting. . . . Minutes February 28, 2005 Monthly Wor1tshop Page 4 of4 Minutes Approved: March 14, 2005 58 8:48:51 PM After a brief discussion, and by consensus, the Board agreed that possible dates for the meeting with representatives of the Economic Development Commission, the Chamber or Commerce, and the Tourism Board would be April 4th or April 12th at 7:00 PM. 10. Closed Session to Receive an Update on the Litigation Regarding the Coloniallpn Upon a motion by Commissioner Lowen, seconded by Commissioner Dancy, the Board moved to go into Closed Session for the purpose of discussing litigation regarding the Colonial Inn by a vote of 4-0. The motion was declared passed. 11. Other Upon returning to Open Session, it was determined that there was no other business. 12. Adjourn Upon a motion by Commissioner Lowen, seconded by Commissioner Dancy, the Board moved to adjourn at 9:50 PM by a vote of 4-0. The motion was declared passed. Respectfully submitted, Donna F.
