CALL TO ORDER CITY COUNCIL TEMPLE CITY, CALIFORNIA REGULAR MEETING APRIL 1, 2014 AGENDA ITEM ?.A-1 Mayor Blum called the City Council Regular Meeting to order at 7:34 p.m. in the Council Chambers located at 5938 Kauffman Avenue, Temple City. 2. ROLLCALL PRESENT: ABSENT: ALSO PRESENT: 3. INVOCATION Councilmember -Sternquist, Vizcarra, Yu, Chavez and Blum Councilrnember -None Interim City Manager Penman, City Attorney Vail, City Clerk Kuo, Administrative Services Director Hause, Parks and Recreation Director Burroughs, Assistant to the City Manager I Economic Development Manager Haworth, and Planning Manager Starns Father Neiman from St. Luke's Church, 5605 Cloverly Avenue, provided the Invocation. 4. PLEDGE OF ALLEGIANCE Jerry Jarnbazian, Temple City businessman, led those present in the Pledge of Allegiance to the Flag. 5. CEREMONIAL MATTERS-PRESENTATIONS A. PET OF THE MONTH Diane Rios, Outreach Committee Lead on the San Gabriel Valley Humane Board Advisory Group, introduced the featured pet for the month, Rusty. Rusty is a six plus years old Chow mix. He is eligible for the shelter's "Senior to Senior" adoption program (Senior citizens who adopt senior pets pay half the usual adoption fee). Those interested in adopting him can call the San Gabriel Valley Humane Society at (626) 286-1159. City Council Minutes April1, 2014 Page 2 of 14 B. NATIONAL LIBRARY WEEK PROCLAMATION Mayor Blum and City Council presented a proclamation to Jing Li, Temple City Library Manager, proclaiming April 13-19 as National Library Week and. Karen Noyes, Temple City Children Librarian, announced upcoming library events. C. FARMER'S MARKET UPDATE Gretchen Sterling, Farmer's Market Manager, provided City Council with an update on the City's Farmer's Market and invited City's non-profit organizations to take the opportunity to connect with the community at the Farmer's Market every Sunday. 6. PUBLIC COMMENTS ON ITEMS NOT LISTED ON THE AGENDA Jerry Jambazian, Temple City business owner, commented that two women (Rita Padilla and Franca Scorsone) from Temple City were honored by Assemblymember Ed Chau, and received the 2014 Women's History Month Leadership Award. Manuel Gouveia, Upper San Gabriel Valley Water District, introduced the organization and announced upcoming activities. 7. CONSENT CALENDAR Mayor Blum pulled item 7.1. for further discussion. I. ADOPTION OF RESOLUTION 14-4983 ESTABLISHING THE TEMPLE CITY GENERAL PLAN ADVISORY COMMITTEE (GPAC); ADOPTING GPAC BYLAWS; AND APPOINTMENT OF MEMBERS TO THE GPAC The Temple City General Plan Update known as the "Temple City 2050 Mid- Century Plan" is an opportunity to plan the future of Temple City and will set the direction of the City for the next generation. As part of the update process, staff has proposed to establish a GPAC consisting of up to 13 residents to advise staff and our consultants on issues raised during the process, to facilitate public participation, and to make a recommendation to the Planning Commission and City Council on an updated General Plan, a Specific Plan for the intersection of Las Tunas Drive and Rosemead Boulevard, and an updated Zoning Code. Mayor Blum commented that he prefers to table this item until the City hires a Community Development Director so the Director can be involved with the formation of the GPAC. City Council Minutes April1, 2014 Page 3 of 14 Mayor Pro Tem Chavez made a motion to table this item to the May 6, 2014 City Council meeting. Seconded by Councilmember Sternquist and unanimously carried. Action: Tabled the Adoption of Resolution 14-4983 which establishes the Temple City General Plan Advisory Committee (GPAC), adopts by-laws for the GPAC, and appoints members to serve on the GPAC to the City Council meeting of May 6. Councilmember Yu moved to approve the remaining items on the Consent Calendar, seconded by Mayor ProTem Chavez and unanimously carried. A APPROVAL OF MINUTES The City Council is requested to review and approve: 1) Minutes of the City Council Special Meeting of March 18, 2014; and 2) Minutes of the City Council Regular Meeting of March 18, 2014. Action: Approved. B. TRANSPORTATION AND PUBLIC SAFETY COMMISSION ACTIONS - MEETING OF FEBRUARY 26, 2014 The City Council is requested to review the Transportation and Public Safety Commission actions of their meeting of February 26, 2014. Action: Received and filed. C. TRANSPORTATION AND PUBLIC SAFETY COMMISSION ACTIONS - MEETING OF MARCH 12, 2014 The City Council is requested to review the Transportation and Public Safety Commission actions of their meeting of March 12, 2014. Action: Received and filed. D. PUBLIC ARTS COMMISSION ACTIONS-MEETING OF MARCH 19, 2014 The City Council is requested to review the Public Arts Commission actions of their meeting of March 19, 2014. Action: Received and filed. City Council Minutes April1, 2014 Page 4 of 14 E. ADOPTION OF RESOLUTION NO. 14-4982, APPOINTING CATHERINE BURROUGHS TO THE OVERSIGHT BOARD FOR THE FORMER TEMPLE CITY COMMUNITY REDEVELOPMENT AGENCY AB x1 26, the redevelopment dissolution bill, required each successor agency to have an oversight board comprised of seven members seated prior to May 1, 2012. It also allows the Mayor of the successor agency to appoint two of the seven oversight board members (i.e., one member representing the City who formed the Redevelopment Agency-City Manager and one member representing the employees of the Agency-Assistant to the City Manager I Economic Development Manager). With the termination of the City Manager's contract, staff recommended appointing Parks and Recreation Director, Catherine Burroughs to fill the vacancy. While the City currently has an Interim City Manager, Mr. Donald Penman, his time is limited both in the number of hours he can work at the City of Temple City and the time he will serve as Interim City Manager. Action: Adopted Resolution No. 14-4982 appointing Catherine Burroughs to serve as the City's representative on the Oversight Board of the Former Temple City Community Redevelopment Agency. F. FINAL SUBDIVISION MAP APPROVAL FOR TRACT MAP NO. 71205, A SIX- UNIT CONDOMINIUM PROJECT AT 5535 SANTA ANITA AVENUE Based upon the finding that the final map is in substantial compliance with the tentative map, staff recommends that the City Council receive the work agreements and improvement securities for road and sanitary sewer improvements, and approve the final map for the project. Action: 1) Reviewed the findings of the County of Los Angeles Department of Public Works as enumerated in the attached letter; 2) Received the Subdivision Improvement Agreement; 3) Approved the final subdivision map for Tract No. 71205 and dedications indicated on the map; 4) Authorized the Interim City Manager to execute the Subdivision Improvement Agreement; and 5) Authorized the City Clerk to certify Parcel Map No. 71205. RENEWAL OF THE MUNICIPAL LAW ENFORCEMENT SERVICES AGREEMENT WITH THE COUNTY OF LOS ANGELES FOR LAW ENFORCEMENT SERVICES WITH THE LOS ANGELES COUNTY SHERIFF'S DEPARTMENT As a contract city, Temple City has traditionally entered into a Municipal Law Enforcement Services Agreement with the Los Angeles County Sheriff's Department. The California Contract Cities Association and representatives of various contract cities have been working on the preparation of the new Municipal Law Enforcement Services Agreement, which would provide for a five-year renewal through June 30, 2019. A uniform agreement is used by the County and all of the contracting cities for these services. Renewal of the Municipal Law Enforcement Services Agreement will ensue that the services provided by the Sheriff's Department will continue uninterrupted. Action: Approved the renewal of the Municipal Law Enforcement Services Agreement with the County of Los Angeles; and authorized the Mayor to execute the agreement. H. APPROVAL OF CONSULTANT SERVICES AGREEMENT FOR INSTALLATION OF ELECTRONIC CONTENT MANAGEMENT SYSTEM (ECMS), ECMS ANNUAL SOFTWARE SUPPORT AND DOCUMENT SCANNING SERVICES; AND APPROVE PURCHASE OF A DESKTOP SCANNER AND ELECTRONIC CONTENT MANAGEMENT SYSTEM City Council's approval of the Consultant Services Agreement for an ECMS will further the City Council's goal of government transparency. Other benefits of implementing an ECMS are: prevention of lost records, ability to manage and locate documents quickly, make images centrally available, and safe keeping of records in case of a disaster. Document imaging will be implemented in phases beginning with the City Clerk's Office (i.e., City Council and City Commission meeting minutes, resolutions and ordinances). Once these public documents have been scanned and labeled, they will be made available to the public on the City's website. Scanning of other department documents will commence as resources are available. Action: 1) Awarded Consultant Services Agreements to ECS Imaging, Inc. (ECS), to install a Laserfiche electronic content management system (ECMS), provide training, and provide annual service maintenance and support services for ECMS; City Council Minutes April 1, 2014 Page 6 of 14 2) Awarded Consultant Service Agreement to ECS to provide document scanning services; and 3) Authorized the City Manager to execute the Consultant Services Agreements for installation of ECMS, annual support, and scanning services in an amount not to exceed $33,450 (i.e., $6,890 to install an ECMS, provide training, and provide annual service maintenance and support services for ECMS; and $26,560 for the document scanning services). J. ADOPTION OF RESOLUTION NO. 14-4985 APPROVAL OF PAYMENT OF BILLS The City Council is requested to adopt Resolution No. 14-4985 authorizing the payment of bills. Action: Adopted Resolution No. 14-4985. 8. UNFINISHED BUSINESS A. SECOND READING AND ADOPTION OF ORDINANCE NO. 14-987 REPEALING AND ADOPTING A NEW CHAPTER OF THE TEMPLE CITY MUNICIPAL CODE (TCMC) TITLE 3 (PUBLIC SAFETY) CHAPTER 1 (FIRE CODE) ADOPTING BY REFERENCE THE 2014 LOS ANGELES COUNTY FIRE CODE (TITLE 32) AS THE CITY OF TEMPLE CITY FIRE CODE Temple City is part of the Consolidated Fire Protection District for Los Angeles County. The District provides fire protection and reviews plans for new construction Citywide. As part of the District, the City of Temple City is required to operate under the Los Angeles County Fire Code, except when making amendments for local conditions. The City Council reviewed this item on February 4, 2014 and introduced the proposed ordinance. There were no comments by the City Council or the members of the public, and no changes to the ordinance were made. Planning Manager Starns gave a brief summary of the staff report. Mayor Pro Tem Chavez made a motion to waive further reading and adopt Ordinance No. 14-987 repealing existing and adopting a new Chapter to the Temple City Municipal Code Title 3 (Public Safety), Chapter 1 (Fire Code), thereby adopting by reference portions of the 2014 Los Angeles County Fire City Council Minutes April 1, 2014 Page 7 of 14 Code (Title 32) as the City of Temple City 2014 Fire Code. Seconded by Councilmember Yu and unanimously carried. 9. NEW BUSINESS A. APPROVAL OF WATERCOLOR DESIGNS FOR ROSEMEAD BOULEVARD TILE MURALS Tile mural designs for Rosemead Boulevard directory monuments are fine art representations illustrating five iconic scenes of life in Temple City. Entitled, ''Temple City Today," this mural collection portrays the community's celebratory traditions and cultural values as experienced by families and immigrant residents. The final watercolor designs incorporate the Commission's recommended modifications to ensure each mural narrative is an accurate interpretation of community life, and adheres to artistic best practices. Assistant to the City Manager I Economic Development Manager Haworth gave a brief presentation of the staff report. Artist Queijan answered City Council questions regarding the mural designs and mural making process. Mayor Blum opened public comment. Mayor Blum closed public comment. Councilmember Yu made a motion to approve artist Carole Choucair Oueijan's final watercolor designs for five tile murals to be installed on Rosemead Boulevard directory monuments, thereby initiating the fabrication process. Seconded by Councilmember Vizcarra and unanimously carried. B. INTRODUCTION AND FIRST READING OF ORDINANCE NO. 14-992 AMENDING THE TEMPLE CITY ZONING CODE AND DOWNTOWN SPECIFIC PLAN TO REQUIRE A CONDITIONAL USE PERMIT FOR MEDICAL OFFICES AND SIMILAR USES This code amendment is intended to be an interim option that will regulate massage businesses in accordance with SB 731 until a comprehensive massage and "Day Spa" ordinance is adopted. The proposed ordinance should also have little impact to the medical community. Since the beginning of the year we have had only one business license application for a medical office. Planning Manager Starns gave a brief summary of the staff report. City Council Minutes April1, 2014 Page 8 of 14 Mayor Blum opened public hearing. Mayor Blum closed public hearing. City Attorney Vail commented that a moratorium would be not useful since it is unclear if the City would be able to enforce it due to the state law (i.e., Senate 731) that was passed. Requirement of a conditional use permit (CUP) would allow the City the ability to impose an interim operational type of regulations and monitor these types of businesses. Councilmember Sternquist made a motion to introduce Ordinance No. 14-992 for first reading by title only amending the Temple City Zoning Code and the Downtown Specific Plan to require a Conditional Use Permit for Medical Offices and similar uses; waive further reading of Ordinance No. 14-992; and schedule the second reading of the ordinance for April 15, 2014. Seconded by Council member Yu and unanimously carried. C. PUBLIC HEARING: CONSIDERATION OF COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FUNDS FOR THE HOUSING REHABILITATION LOAN PROGRAM, AND ASBESTOS TESTING AND ABATEMENT PROGRAM FOR FISCAL YEAR (FY) 2013-14 The City Council is recommended to approve the increased allocations for the Housing Rehabilitation Loan and Asbestos Testing and Abatement Programs for FY 2013-14. Any CDBG funds not used during FY 2013-14 will go back into the City's unallocated CDBG fund balance and would be eligible for reallocation back into the Housing Rehabilitation Loan and Asbestos Testing and Abatement Programs for FY 2014-15. Associate Planner Gulick gave a brief summary of the staff report. Mayor Blum opened public hearing. Mayor Blum closed public hearing. Councilmember Yu made a motion to appropriate CDBG funds programmed for next fiscal year (FY 2014-15) to the current fiscal year (FY 2013-14) programs: increasing the Housing Rehabilitation Loan Program by $150,000 and increasing the Asbestos Testing and Abatement Program by $50,000. Seconded by Councilmember Sternquist and unanimously carried. D. ADOPTION OF RESOLUTION NO. 14-4984 CONFIRMING THE MAYOR'S APPOINTMENTS OF CITY COUNCILMEMBERS AS DELEGATES AND ALTERNATES TO OTHER AGENCIES AND ORGANIZATIONS City Council Minutes April1, 2014 Page 9 of 14 Each year the City Council reorganizes, and with City Council input, the Mayor reviews and selects representative delegates and alternates to other governmental agencies and/or organizations. Councilmembers serving as the delegate to these governmental agencies provide recommendations regarding issues that may affect cities in Los Angeles County. Delegates to these governmental agencies and/or organizations also have official voting responsibilities. City Clerk Kuo gave a brief summary of the staff report. Mayor Blum opened public comment. Jerry Jambazian, Temple City business owner, asked which Councilmembers were assigned to which organizations and agencies. Mayor Blum closed public comment. Councilmember Sternquist made a motion to adopt Resolution No. 14-4984 confirming Mayor's appointments to City Council committees, agencies and organizations. Seconded by Mayor Pro Tern Chavez and unanimously carried. E. INTRODUCTION AND FIRST READING OF ORDINANCE NO. 14-991 AN ORDINANCE OF THE CITY OF TEMPLE CITY ADOPTING THE REORGANIZED CITY OF TEMPLE CITY MUNICIPAL CODE AND ENACTING A NEW CODE NUMBERING SYSTEM FOR THE MUNICIPAL CODE OF CITY OF TEMPLE CITY With the recent increase of ordinance adoptions, it has become evident that the current method of organizing the Municipal Code is antiquated, difficult and cumbersome for staff to add new sections to related subjects within a Chapter's Article(s). Staff has already had to present ordinances to City Council this past year to amend duplicate Section numbering. The new proposal would allow for an expandable numbering system (e.g., Sterling's standard x-y-z numbering system) which better accommodates future expansion of the Municipal Code. Mayor Pro Tern Chavez made a motion to introduce Ordinance No. 14-991, adopting the reorganized City of Temple City Municipal Code (Municipal Code) and enacting a new numbering system for the Municipal Code; waive further City Council Minutes April1, 2014 Page 10 of 14 reading of Ordinance No. 14-991; and schedule the second reading of Ordinance No. 14-991 for April 15, 2014. Seconded by Councilmember Vizcarra and unanimously carried. 10. COMMUNICATIONS-None 11. RECESS TO SUCCESSOR AGENCY TO THE TEMPLE CITY COMMUNITY REDEVELOPMENT AGENCY MEETING At 8:56 p.m., the City Council recessed to the Successor Agency Meeting. UPDATE FROM CITY MANAGER Interim City Manager Penman announced upcoming City events: Six vacancies up for appointment on three City Commissions-Parks and Recreation, Planning, and Transportation & Public Safety Commissions. Youth Committee is also recruiting for three one-year appointments. Application forms are available online and at City Hall. Deadline for Commission openings is April 30 and May 30 for the Youth Committee. The standing committee discussed final project details and the grand opening event taking place May 10, 2014. B. SCHOOL DISTRICT/CITY STANDING COMMITTEE (Mayor ProTem Chavez and Mayor Blum)-Formed 1/3/2012 Mayor ProTem Chavez reported on the standing committee meeting of March 25, Tuesday. The standing committee discussed having a joint meeting of City Council and School Board members before end of the summer. C. CITY CODE REVIEW STANDING COMMITTEE (Mayor ProTem Chavez and Councilmember Vizcarra)-Formed 11/6/2012 None D. CIVIC CENTER MASTER PLAN STANDING COMMITTEE (Councilmember Yu and Mayor Blum)-Formed 5/13/2013 None E. FUTURE DEVELOPMENT OF CITY PROPERTIES STANDING COMMITTEE (Councilmember Vizcarra and Mayor Blum) -Formed 2/18/2014 None H. LAS TUNAS DRIVE STREETSCAPE AND PEDESTRIAN IMPROVEMENT AD HOC COMMITTEE (CouncilmemberVizcarra and Yu)-Formed 7/3/2012 Councilmember Yu reported on the ad hoc committee meeting of March 28, Friday. The ad hoc committee reviewed the status of the project, funding options and project timeline. The purpose of the ad hoc committee is to review possible options to increase business and pedestrian traffic on Las Tunas City Council Minutes April1, 2014 Page 12 of 14 Drive. He reported on next course of actions for the project. Councilmember Vizcarra left the meeting at 9:06p.m. Mayor Blum disbanded the Las Tunas Drive Streetscape and Pedestrian Improvement Ad Hoc Committee. Discussion regarding Las Tunas Drive Project will be continued by the Las Tunas Downtown Revitalization Standing Committee. I. STRATEGIC PLANNING AD HOC COMMITTEE (Councilmember Yu and Mayor Blum) -Formed 4/2/2013 Mayor Blum announced that this ad hoc committee will be disbanded after its meeting on Friday, April 3, 2014. Discussion regarding the City's Strategic Plan will be continued by the Strategic Plan Implementation Standing Committee. J. AUDIT AD HOC COMMITTEE (Mayor ProTem Chavez and Councilmember Yu)-Formed 1/27/2014 None K. FACILITIES, PUBLIC WORKS AND INFRASTRUCTURE AD HOC COMMITTEE (Mayor ProTem Chavez and Mayor Blum)-Formed 2/4/2014 None L. CITY ATTORNEY LEGAL SERVICES AD HOC COMMITTEE (Mayor ProTem Chavez and Councilmember Sternquist)-Formed 2/4/2014 Mayor ProTem Chavez reported on the standing committee meeting of April 1, Tuesday. The standing committee reviewed the City's legal contract to ensure that services are provided and billed reasonably. The standing committee will schedule another meeting and bring recommendations to full City Council for consideration. 15. COUNCIL ITEMS SEPARATE FROM THE CITY MANAGER'S REGULAR AGENDA A. COUNCILMEMBER STERNQUIST Councilmember Sternquist reported on the following: California Association Code Enforcement Officer Conference she attended; tour she took with the Library Commission to City of Claremont. Claremont's Friends of the Library raised $200,000 towards the renovation of their Children's Library; and Foothill City Council Minutes April1, 2014 Page 13 of 14 Transit's new Facebook page that lists deals they offer to the public. She also informed residents not to panic should they see Crane Flies in the City. Crane Flies look like giant mosquitoes and is a food source for baby birds. B. COUNCILMEMBER VIZCARRA Councilmember Vizcarra also commented on the California Association Code Enforcement Officer Conference he attended. He reported on the Temple City High School Band fundraiser event. The band will be marching in the 2015 Tournament of Roses Parade. C. COUNCILMEMBER YU Councilmember Yu shared that he attended an informational session hosted by Herald Cancer Association regarding Hepatitis B infection. He encouraged all to include testing for Hepatitis B virus as part of their annual checkup. This virus can cause damage to the liver and cause liver cancer. Councilmember Yu asked Interim City Manager to add an item to the next City Council meeting agenda allowing Council to discuss the possible amendment to the voluntary expenditure ceiling for elective offices ordinance. D. MAYOR PROTEM CHAVEZ Mayor Pro Tern Chavez reported that he also attended the Temple City High School Band's fundraiser event. He encouraged the community to donate to the band to help towards purchase of new equipment and uniform for their participation in the 2015 Tournament of the Roses Parade. He also reported about a dinner he attended in honor of the Australian Sister City President's visit to Temple City. He encouraged the youth of the community to apply for the City's Youth Committee. E. MAYOR BLUM Mayor Blum commented that he has noticed more cities conducting their municipal elections by vote-by-mail only. He suggested that the City may want to look into this further. 16.
