RESOLUTION NO. 2024-03-01
A RESOLUTION RECOMMENDING APPROVAL OF A MAJOR SITE PLAN AND
PRELIMINARY PLAT FOR A MIXED -USE RESIDENTIAL AND COMMERCIAL
DEVELOPMENT LOCATED AT LOT 2, CLAYTON SUBDIVISION, RECEPTION NO. 291300,
PART OF SEC. 19, TOWNSHIP 1 SOUTH, RANGE 75 WEST OF THE 6TH PM., TOWN OF
FRASER, COUNTY OF GRAND, STATE OF COLORADO
WHEREAS, on January 14, 2024, Greg Bechler, as Managing Partner of Byson
Investments, LLC, a Colorado limited liability company, submitted a Major Site Plan and
Preliminary Plat application requesting approval of the development of four townhome units and
a commercial building on Lot 2 of the Clayton Subdivision; and
WHEREAS, Byson Investments, LLC, a Colorado limited liability company, is the current
owner of the property; and
WHEREAS, following a review of the submitted plans and documents by Town Staff and
applicable referral entities, the application was considered during the regular meeting of the
Fraser Planning Commission held on March 27, 2024 through a properly noticed public hearing;
and
WHEREAS, Town Staff has determined that this application is in compliance with the
Land Development Code of the Town of Faser when the conditions listed below have been
addressed.
NOW THEREFORE BE IT RESOLVED that the Fraser Planning Commission has voted
to recommend approval of this development application with the following conditions:
1) Applicant must address all Planning review comments in the letter dated March 22, 2024
2) Applicant must address referral review comments from:
a. Whitmer Law Firm (as Town Attorney) — dated March 12, 2024
b. Merrick (as Town Engineer) — dated March 15, 2024
c. East Grand Fire Protection District No. 4 — dated March 14, 2024
d. Xcel Energy — dated March 8, 2024
e. Mountain Parks Electric, Inc. — dated March 12, 2024
3) The preliminary plat shall be effective for a period of one year from the date of Planning
Commission action. At or before the end of the one-year period, the applicant must have
submitted a final plat for approval as outlined in Section 19-3-225(c)(3) of the Fraser
Land Development Code.
APPROVED AND ADOPTED THIS 27TH DAY OF MARCH, 2024.
