The legal opinion is below: In my opinion, the Town may use CPA funds to update its Housing Production Plan (the “Plan”), as the purpose of the Plan is to create and support community housing. Specifically, the application states that in updating the Plan, the Town will analyze the affordable housing needs of the Town, conduct community outreach, prepare possible solutions to increasing the availability of affordable housing in the Town, and detail implementation strategies. I note that many other municipalities have used CPA funds for this purpose. Please feel free to contact me if you have questions. Also, the CPC referral was contingent on Heather providing an operating budget listing revenues and expenses for running the SSAL program year to year to both the Housing Partnership and CPC prior to your 8/19 meeting. The legal opinion is below: The application submitted by Latham Centers states that it seeks CPA funds to develop 7 studio apartments on its property at 1439 Main Street for occupancy by low-income individuals with disabilities as part of its Strong Start in Adult Living (SSAL) Program (the “Project”). The Program provides educational, social, mental, and/or physical support to young adults with disabilities, including providing housing in the 7-unit group home for young adults with low incomes, to prepare them to enter the workforce and live independently. As mentioned previously, the Town may expend CPA funds to acquire, create, preserve and support community housing, and to rehabilitate community housing acquired or created using CPA funds. In my opinion, the Town may use CPA funds for the Project as it constitutes the support of community housing, provided that it enters into a grant agreement with Latham Centers, providing that the CPA funds may be used solely for the construction of the 7 studio apartments (and not the other Project improvements). It is my recommendation that Town obtain an affordable housing restriction on the property (for a term of at least 30 years) to ensure that the studios are occupied by persons who have incomes not exceeding 80% of the area median income and satisfy Anti-Aid Amendment concerns. Projected Statements of Operations and Changes in Net Assets Transitional Aged Apartment Program For the Years Ending June 30, Operations Brewster Housing Coordinator Update July 2021 Jill Scalise Ongoing Activities/ Projects 1.Community Outreach and Education (Housing Production Plan (HPP) Strategy #13) Responded to email and phone requests for information and assistance, 65 total requests for housing information (36) or assistance (29). Office hours held on Thursdays from 10-12. Outreach for Community Development Block Grant (CDBG) for Housing Rehabilitation and Childcare included email blast, website, newspaper, social media, and Zoom and in-person information sessions. 2.Brewster Affordable Housing Trust Fund (BAHT) (HPP Strategy #7) & Community Housing Parcel off Millstone (Select Board Strategic Plan Goal H-3, HPP Strategy #15) The drafting of a Request for Proposal (RFP) for the property has been taking place at public Trust meetings with the guidance and assistance of Laura Shufelt, Mass Housing Partnership (MHP). The Trust set a goal to complete the RFP draft in August and to present the RFP to the Select Board in September. 3.Redevelop Existing Properties for Affordable Housing (HPP Strategy #6) Serenity Brewster (55+ rental housing, 27 affordable units): Residents began moving into units as Phase 1, 41 studios, opened. Phase 2, 91units, expected to open in 2022. With Donna Kalinick, met with Elevation Financial and HAC about Local Action Unit (LAU) application, fair housing marketing plan, and affordable unit lottery. Gathered information about monitoring units. Created timeline for LAU and affordable lottery. Latham Centers (Educational, 8 rental apartments): Provided Site Plan Review comments. 4. Comprehensive Permit Projects (HPP Strategy #14) Toured Terrapin Ridge in Sandwich, recently constructed neighborhood of 30 affordable rental units.  Brewster Woods (30 affordable rental units): Construction begun, attended on-site construction meeting. Received numerous requests for information about Brewster Woods apartments and applications. Habitat, Red Top Road (2 affordable homes, ownership): Comprehensive Permit app expected in August. Eastward Companies: informal meeting with housing and planning staff for revised, potential project. 5.Preservation of Housing and Related Support of Brewster Residents Community Development Block Grant (CDBG) housing rehabilitation applications opened. Followed up with interested residents from earlier outreach, there were 34 pre-apps for the FY20 funds. Coordinated outreach with The Resource Inc., included Council on Aging (COA) and Rec Dept. in the efforts. The Select Board held a Public Hearing and approved being the lead community for a FY21 regional grant application written by Bailey Boyd. Obtained Letters of Support (LOS) for the FY21 application. Brewster Rental Assistance Program (B-RAP) managed by Housing Assistance Corporation (HAC). Referred residents to HAC for assistance. Brewster COVID-19 Relief Fund: Provided staff support for housing requests. 6.Subsidized Housing Inventory (SHI) (HPP Strategy #10) Follow-up continued on SHI homes. Received notice of owners’ intent to sell their SHI home. 7.Accessory Dwelling Units (ADU) (HPP Strategies #1 &2): Worked with Building Dept. on ADU units. 8. Housing Production Plan (HPP): Funding application with letters of support submitted to CPC. 9.Collaboration (HPP Strategy #9) Attended Citizen’s Housing and Planning Association’s (CHAPA) Listening Session and launch meeting of Brewster Housing Coalition. Participated in Lower Cape Housing Funding Planning Meeting, Habitat for Humanity Zoom Conversation, and Making the Case Zoom Call. With Donna Kalinick, met with new director of Brewster Housing Authority (BHA). Provided LOS for HAC ADU grant application. Personnel Worked with: Assessor, Building Dept., CPC, COA, Health Dept., Housing Partnership, Housing Trust, Planning Dept., Select Board and Town Administration. Attended Housing Trust & Select Board meetings. Provided comments for Select Board Strategic Plan. Brewster Housing Partnership Minutes 8-4-21 1. Call to Order – 6:01 p.m. 2. Declaration of a Quorum – Quorum was present 3. Meeting Participation Statement – For remote participation via Zoom 4. Discussion to determine Partnership’s comments and input for submission to the Brewster Select Board on Strategic Plan Goals and Action Priorities Discussion resulted in recommendations to the Select Board as follows: • The BHP requests to be included as a stakeholder in discussions and to establish a collaboration with the CPC to pursue an amendment to the Town’s Community Preservation Act (CPA) formula to increase the percentage allocation of funds, so that a greater percentage (preferably 50%) of those funds collected by the Town are automatically allocated for Affordable Housing purposes. • Requests that the Select Board consider incorporating the costs required to employ a professional Housing Coordinator into the Town’s annual budget (as opposed to funding the position annually via CPA funds) for FY 2023. • Consider making a commitment to incorporating an affordable housing component in the acquisition and development of the Cape Cod Sea Camp’s bayside and Long Pond properties. 5. Discussion of an alternative name for the pending development project off Millstone Road – It is noted that there has been some confusion caused by referring to the development and another project involving Millstone Road. The BHP wishes to encourage a consensus in the town to refer to the project with a different name. No conclusion from this meeting; will revisit the discussion. 6. Community Development Block Grant (CDBG) for Housing Rehabilitation and Childcare Update and Letter of Support – The members voted to send a letter of support for the grant. 7. Updates from Housing Coordinator – Brewster Woods, Serenity/Wingate, Habitat, Eastward, etc. – See attached. 8. Updates from Standing Committee Liaisons: a. Affordable Housing Trust – Vanessa Greene will be the representative from BHP to the trust. b. CPC – referral of Housing Applications – none to report. 9. Scheduling of future discussions related to potential rationale and/or criteria for Local or Regional Preference in Brewster-Sponsored housing projects and programs – this will be held for a future meeting. 10.
